HomeMy WebLinkAbout2002-07-24 Conservation Commission MinutesMinutes, Reading Conservation Commission, July 24, 2002 Minutes of the Reading Conservation Commission Selectman's Meeting Room, Town Hall Wednesday, July 24, 2002 Present: Karen Schneller, Doug Greene, Thad Berry, Commissioners; Pat Lloyd, Vice- Chair; Will Finch, Chair; Fran Fink, Administrator; Kelley Meier, Recording Secretary. Absent: Larry Goulet, Commissioner; Leo Denney, Harold Hulse, Consultants. The Chair calls the meeting to order at 7:05 PM. Old/New Business 48 Park Street, RGB 2002-18 The Commission reviewed the draft OOC and amended the finding about the gazebo. The gazebo is going to be kept, but moved to be near the pool. . Ms. Lloyd moved to issue the Order of Conditions with the Findings and Conditions as amended this evening. Mr. Berry seconded. Voted in favor, 4-0-0. 294 Main Street, DEP 270-79, RGB 2002-6 Fleet Bank did not have a proposal ready for the packet, and did not appear at the meeting. The Commission asked Ms. Fink to send a letter with an August 7 deadline for submittal. 16 Margaret Road, DEP 270-354, RGB 2001-17 Mr. Finch updated Commission about this project. The grass is coming in well, things look good. Ms. Lloyd moved to issue a Certificate of Compliance. Mr. Berry seconded. Voted in favor, 4-0-0. 10 Haverhill Street, North Reading Mr. Finch reported what was said at the meeting in North Reading on 7/23/02. The North Reading Commission approved bordering and isolated wetlands lines and 100-year flood elevation, but did not delineate riverfront area. 468 West Street Ms. Fink went over a draft memo and updated the Commission. There was discussion about local regulations - whether or not exempt. Mr. Greene came in at 7:20 PM The last paragraph is going to be left as is for now and get advice from other people. Ms. Lloyd moved to send the memo dated July 25, 2002 as drafted. Mr. Berry seconded. Voted in favor, 5-0-0. Minutes, Reading Conservation Commission, July 24, 2002 Public Hearing: Notice of Intent, Harvest Road, RGB 2002-17 Ms. Lloyd moved to continue the hearing to August 14, 2002 at 7:30 PM, in this present room. Mr. Greene seconded. Voted in favor, 5-0-0. Spence Farm Ms. Fink showed the Commission the Comprehensive Permit application and site plan. They asked her to draft and send comments to the ZBA for the first public hearing, and to note that the Commission will discuss the project further at their next meeting on August 14, 2002. 7:44 PM - Public Hearing: Notice of Intent, 340 Lowell Street, DEP 270-373, RGB 2002-16 Richard Kirby from LEC represented the owners, who were also present. Mr. Kirby described the property and discussed what the home owner would like to do. The one-car garage will be replaced with another one-car garage with an addition on top. The work will be conducted in the buffer zone. The garage will not be any larger, but the same size as it is now. The owners had received comments from Natural Heritage. The Commissioners reviewed the draft Findings and Conditions for the OOC. Mr. Berry made a motion to close the Public Hearing. Ms. Lloyd seconded. Voted in favor, 5-0-0. Ms. Lloyd moved to approve the OOC as amended tonight, Mr. Berry seconded. Voted in favor, 5-0-0. 8:00 PM - Public Hearing: Notice of Resource Area Delineation, 1503 Main Street, RGB 2002-19 The applicant did not appear. Ms. Lloyd moved to continue the hearing to August 14, 2002 in the present room at 7:45 PM. Mr. Greene seconds. Voted in favor, 5-0-0. The Commission discussed the observations from the site visit on Monday. There is dead vegetation in the area that was filled and then cleared under an Enforcement Order in 1998. Herbicides might have been sprayed on the plants. The owner had not responded to a request for information or attended the site visit. The fill that was moved in 1998 is stockpiled closer to the southern lot line, with weedy vegetative cover. The Commission asked Ms. Fink to send a letter to the owner asking him to attend the meeting on August 14. Old/New Business 1090/1100 Main Street Ms. Fink spoke with Tom Goddard about the memo dated June 11, 2002. Mr. Goddard seemed eager to get the work done, probably in August. She drafted a letter for the Commission to review. Mr. Berry made a motion to accept the letter. Ms. Lloyd seconded. Voted in favor, 5-0- 0. Minutes, Reading Conservation Commission, July 24, 2002 St. Athanasius Church Ms. Fink updated the Commission about the drainage problem in the parking lot. The Commission asked Ms. Fink to send a letter with time limits for submitting a drainage design and constructing it. Sunset Rock Lane Mr. Finch reported observations from recent site visits. Loaming and seeding around the wall between Lots 4 and 5 is only partially done, rocks had been placed in the voids on Lot 4, but not Lot 2. Ms. Fink reported that a drainage diverter had been installed in front of the garage on Lot 4, and agreed that the vegetation is not complete. Mr. DeGennaro mentioned that he had just finished with the drain yesterday right before the rain storm and it worked. Mr. Berry reported that the stone had been placed on the forebay berm and the detention basin outlet had been modified. There was fresh seeding on Lot 2, but no growth yet. Mr. Berry moved to accept the forebay berm and detention basin outlet. Ms. Lloyd seconded. Voted in favor, 5-0-0. Mr. Berry made a motion to approve the existing wall between lot 4 and 5 and revoke the previous requirement to construct a concrete wall. Ms. Lloyd seconded. Voted, 4-0-1. Mr. Berry made a motion to approve the existing upper wall on lot 2. Ms. Lloyd seconded. Voted, 4-0-1. Mr. Berry made a motion to send a letter requesting that the gaps in the lower wall on Lot 2 be plugged, and that additional loam, seed, and mulch be applied to bare spots on Lot 2. Ms. Lloyd seconded. Voted, 4-1-0. There was some discussion about a minor bond reduction. Mr. Berry made a motion to reduce the bond by $15,000 from $20,000 to $5,000. Ms. Lloyd seconded. Voted, 4-1-0. The Commission asked Ms. Fink to send a letter to the owner of Lot 2 concerning erosion problems and lack of vegetation along the new wall he recently built. She will also send a letter to the owner of Lot 3 asking for removal of grass clippings from the detention basin. The Commission discussed including a long-term maintenance requirement in the Certificate of Compliance for continued inspection and maintenance of the retaining walls and vegetated slopes. The Commission, discussed -working with-CPDC to plant the street trees. Minutes, Reading Conservation Commission, July 24, 2002 Ms. Shneller left at 8:34 PM. Pondview Lane Subdivision, DEP 270-345, RGB 2000-52 Ms. Lloyd moved to approve the revised site plan for Lot 8 as an insignificant plant change. Mr. Berry seconded. Voted in favor, 4-0-0. 49 Gray Coach Road The 45 days have come and gone for wetland delineation for this project, Ms. Fink suggests a letter. 14 Forest Street (minor project) The owners would like to add pool and deck. Mr. Berry made a motion to approve the Minor Project Permit. Ms. Lloyd seconded. Voted in favor, 4-0-0. Minutes for approval Ms. Lloyd made motion to approve the minutes for August 15, 2001; August 22, 2001; and June 27, 2002, as amended. Mr. Greene seconded. Voted in favor, 4-0-0. Ipswich River Watershed Association There has been a request for a letter of support from communities for a grant application by IRWA. Mr. Berry moved to support them with a letter. Ms. Lloyd seconded. Voted in favor, 4- 0-0. 1321 Main Street The owner put fill in the wetland and buffer zone. Ms. Fink contacted the owner, Susan Woods, for a site visit. Hopes to get back out there Friday to do a wetlands delineation. Ms. Lloyd moves to send a letter ordering removal of fill and trash, and site stabilization. Mr. Berry seconded. Voted in favor, 4-0-0. Fanta Lane Ms. Fink did a site visit. There were no hay bales out or anything, something needs to be done. The posts on the Kurchian Woods entrance are unstable, maybe digging hole and putting cement down there to keep it stabilized. The owner hasn't done it yet. Lilacs were put on side of entrance way. Carnation Circle Everything looks fine and everything was repaved. Need to send letter to close file. Ms. Lloyd moved to close file. Mr. Berry seconded. Voted in favor, 4-0-0. 24 Harold Avenue not thick yet. The owner would like a bond reduction (bond is $10,000), 3,000 is the total for if the sod to be replaced again, if needed, and $2,000 for as-built plans. Voted in favor, 4-0-0. 31 Dividence The house on the corner of Dividence Road and Zachary Lane is for sale. The buyer would like to take down house and build a new one. He would like to know whether there are wetlands present. The Commission decided he should file a Request for Determination. 64 Pasture Road Ms. Fink reported on a site visit with the former owner. Work is complete. A $2,000 bond being held. Ms. Lloyd moved that the Commission issue a Certificate of Compliance and release the $2,000 bond in full. Mr. Berry seconded. Voted in favor, 4-0-0. 37 Latham Lane Mr. Berry made a motion to extend the Order of Conditions to 2004. Ms. Lloyd seconded. Voted in favor, 4-0-0. 41-43 Wilson Avenue Ms. Fink reported findings from a site visit. A number of items remain to be addressed. The Commission asked Ms. Fink to send a letter to RHA itemizing the remaining work. Motion to adjourn made by Ms. Lloyd at 9:33 PM. Mr. Berry seconded. Voted in favor, 4-0-0. 5
