Absent: Thad Berry, Karen Schneller, Commissioners; Leo Kenney, Consultant. Old/New Business Wood End Cemetery, DEP 270-269, RGB 1995-10 Mr. Greene reported findings from the site visit. Ms. Fink went over some items from the Order of Conditions. Ms. Lloyd moved to approve the Certirficate of Compliance. Mr. Finch seconded. Voted in favor, 4-0-0. 49 Gray Coach Road, DEP 270-368, RGB 2002-4 Ms. Fink reported on the wetland delineation with Steve Eriksen. The boundary was determined to be within the woods about 5 feet off the lawn. Ms. Lloyd moved to waive the site plan requirement for the delineation. Mr. Goulet seconded. Voted in favor, 4-0-0. 1090-1100 Main Street Ms. Fink updates the Commission about the clean up and what has been going on, she will meet with the owner next week. 7:16 Public Meeting, Request for Determination of Applicability, Kathleen and Gregory Zager, 41 Dana Road, RGB 2002-29 Ms. Zager was present. She would like to put in an in-ground pool. A site visit was done. There were some yard clippings in the wetlands in back of the property. The Commission asked Ms. Zager to remove them. Ms. Fink passed out the draft conditions. The Commission talked about adding the piles of compost on property to the conditions. Ms. Zager talks about her neighbors that are doing the same thing. Ms. Lloyd moved to have a negative determination with conditions. Will seconded. Voted in favor, 4-0-0. 7:30 Public Hearing, Notice of Intent, Harvest Road, single-family house, RGB 2002-17, Dorothy Jones The Commission's consultant could not attend this meeting. Minutes, Reading Conservation Commission, September 12, 2002 Ms. Lloyd moved to continue this Public Hearing to Sept 25 at 7:20 PM. Will seconded. Voted in favor, 4-0-0. Sunset Rock Lane, DEP 270-295, RGB 1997-26 Ms. Fink did a site visit today and updated the Commission about it. She thinks that there should be a little more seeding in a few locations. Ms. Fink finished Conservation Restriction and she put a letter in the mail to all the neighbors to come and sign the paper. 1503 Main Street Mr. Greene and Ms. Fink reported site visit findings. The household trash had been removed. Ms. Lloyd moved for Ms. Fink to issue a letter closing the 1998 Enforcement Order. Mr. Finch seconded. Voted in favor, 4-0-0. 7:44 Public Hearing, Notice of Intent, 87 Walkers Brook Drive (Texaco Station), Motiva Enterprises, hazardous waste cleanup, DEP 270-376, RGB 2002-27 Mike Bingham, LSP from CEA, was here to talk about the project. A new proposed grading plan and storm water management plan were reviewed, along with a response sent by Frank Postma to questions raised in the previous hearing. Also, the Fire Chief is reviewing the proposed work to make sure that it can be conducted safely near the tanks and pumps. Ms. Lloyd move to continue the hearing to September 25 at 8 pm. Mr. Finch seconded. Voted in favor, 4-0-0. 8:17 Public Hearing, Request for Amended Order of Conditions, Walkers Brook Crossing, Walkers Brook Drive, DEP 270-352, RGB 2001-14 Dave Pickart from VHB presented the amendments to the site plans. Ed Shaw, Brad Latham, and Mark Nogueira were also present for the applicant. The front parking lot is now 60 feet from the brook and the ZNV/RFA has been widened in several other places. Overall, there is a one-acre reduction in ZNV/RFA between the OOC plan and the new plan. The MSF wall is required by DEP to eliminate previously proposed 1:1 slopes on the cap and provide adequate space for the volume of waste to be capped. More trees can now be planted along the brook next to the MSF wall and the cap will not reach the brook in this area. The trees will be able to shade the brook. The MSF face will not have to be mowed. At some locations, the wall is about 45 feet away from the wetland, but at the pinch point it is less than 10 feet. The wall is shorter in this area, so the gravel base does not extend into the brook. Some parking spots were lost, but Jordan's understands. Typographical errors in the floodplain delineation, the grading in front of the restaurant, and the MSW labelling have been corrected. Hay bales lines have been clarified. The "TRC" label refers to a tool rental center inside the Home Depot building. Mr. Finchasked whether there is adequate room for trees to grow between the MSW wall - and the brook. Mr. Pickart responded that their landscape architect has assured that they will. Minutes, Reading Conservation Commission, September 12, 2002 Mr. Goulet asked whether the MS W wall is the cap. Mr. Nogueira stated that the clay layer is the cap. There will be a gas collection layer behind it. Ms. Fink asked about possible timing for development of the area where the hotel and office were originally proposed. A second NOI may be needed for future work in that area unless the proposal comes in very soon. The Comissson reviewed the draft Amended Order of Conditions and made a few revisions at the suggestion of Mr. Latham. Mr. Finch moved to close public hearing for Amended Order of Conditions. Ms. Lloyd seconded. Voted in favor, 4-0-0. Mr. Finch moved to approve and issue the Amended Order of Conditions for this project, with amendments talked about this evening. Ms. Lloyd seconded. Voted in favor, 4-0-0. 8:53 Public Hearing,.Abbreviated Notice of Resource Area Delineation, 40, 42, and 70 West Street, Archstone-Smith Operating Trust, RGB 2002-28 Mr. Greene commented on the site visit findings. Kurt Olsen made a presentation. The land north of the property was burned. He described the vegetation between the site and the street drain outlet from the roadways to the north. There are signs of water discharging from the outlet, but not wetlands vegetation or a defined channel connected into this site. They have not yet found out where the water that leaves the site from the on-site wetlands is going. They are assuming that the on-site wetlands border a downstream wetland. Ms. Fink had drafted an attachment to go with the AN]2AD. The Commission reviewed it. Ms. Lloyd moves to issue the Order of Resource Area Delineation as amended tonight. Mr. Finch seconded. Voted in favor, 4-0-0. Ms. Lloyd moved to close the public hearing. Mr. Finch seconded. Voted in favor, 4-0-0. Old/New Business 468 West Street, Comprehensive Permit application Ms. Fink updated the Commission. Joan Langsam is supposed to draft an opinion about the applicability of the local wetlands bylaws. Ms. Fink will check the status. Commission consultants Ms. Lloyd moves to reinstate Harold Hulse to be consultant. Mr. Goulet seconds. Voted in favor, 4-0-0. 52 Charles Street Ms. Fink did a site visit today and informed the Commission on what's going on. 115 Charles Street Kerry McCormack and-Ms. Fink had inspected the site together. He is getting ready for occupancy. He will bring a landscaping plan to the Commission. Minutes, Reading Conservation Commission, September 12, 2002 Pleasant Street The Water Department is planning to install a water main under the town-wide maintenance permit. YMCA, Arthur B. Lord Drive They would like a Certificate of Compliance. They didn't realize that they didn't have one. Ms. Fink will send them a list of remaining items to complete. Burbank Arena, Symonds Way Ms. Fink had meeting and site visit with the rink manager and construction engineer. The owner had on-going problems with dumping. They are ready for a Certificate of Compliance. Ms. Fink will review the file. Minor Projects 46 Bond Street The owner, Mr. Hollis, was present. Ms. Lloyd moved to approve the proposed deck as a Minor Project Permit. Mr. Goulet seconded. Voted in favor, 4-0-0. The Commission discussed the fact that the site plan shows the lawn extending onto the adjacent Maillett Conservation Area. Mr. Hollis said it had been there for 28 years. Mr. i' Finch thought the Commission had expressed concerns about this area during a site visit in 2000. Ms. Fink will review the records and report at the next meeting. 34 Plymouth Street There is a retaining wall in the buffer zone, far enough from the wetland boundary. Ms. Lloyd moved to accept the Minor Project Permit. Mr. Goulet seconded. Voted in favor, 4-0-0. 422 Grove Street There are several dead trees within falling distance of the house. Ms. Lloyd moved to accept tree removal as a Minor Project Permti. Mr. Goulet seconds. Voted in favor, 4-0-0. Annette/Apple Gate Lane Ms. Fink got call from neighbor about owner putting up a fence with a gate. She had met with him before and advised him that he needed a permit, but he had not came back. She asked him to stop work and come to Town Hall to get a permit. Ms. Lloyd moved to accept fence as a Minor Project Permit. Mr. Goulet seconde. Voted in favor, 4-0-0. Timothy Place Ms. Lloyd moved to authorize Ms. Fink to sign off on the Certificate of Occupancy for the second house. Mr. Finch seconde. Voted in favor, 4-0-0. Minutes, Reading Conservation Commission, September 12, 2002 Fanta Lane A site visit done by Ms. Fink. Ms. Lloyd moved to authorize Ms. Fink to sign off on the Certificate of Occupancy for the first house. Mr. Goulet seconded. Voted in favor, 4-0-0. 25 Brook Street This site in good shape, nice and tidy. Ms. Lloyd moved to authorize Ms. Fink to sign off on the Certificate of Occupancy for the house. Mr. Goulet seconded. Voted in favor, 4- 0-0. 28 Francis Drive There had been complaints that people are digging in their backyard. Ms. Fink is going to do a site visit on 9.13.02 119 Van Norden/Fairchild Selectmen have received preliminary Comprehensive Permit plan and request to enter Local Initiative Project with developer. Peter Hechenbleikner was present and discussed anticipated process for review. Ms. Lloyd made a motion to adjourn at 10:01. Mr. Goulet seconded. Voted in favor, 4- 0-0.
