HomeMy WebLinkAbout2003-10-22 Conservation Commission MinutesMinutes, Reading Conservation Commission, October 22, 2003 U l: I ASS. . vJa t Minutes of the Reading Conservation Commission Selectmans's Meeting Room, Town Hall _ October 22, 2003 Present: William Hecht, William Finch, Doug Greene, Kelley Meier, Rebecca Longley, Commissioners; Fran Fink, Administrator; Linda Boutoures, Secretary The meeting was called to order at 7:00p.m. Old/New Business Harold Avenue PRD, DEP 270-301, RGB 1998-12 Mr. Mahoney and Mr. Lynch, (owners) were present. Mr. Mahoney is very concerned with anyone coming on to his property. Mr. Mahoney wanted to know from the Commission who would be held responsible if anyone was to get hurt on property. Mr. Mahoney suggested the wording of the Conservation Restriction be looked at very carefully. Fran Fink said she would ask Town Counsel how strong her feeling is on the wording of the Conservation Restriction. This will be put on the Agenda for the November 5t' meeting. Timothy's Place, DEP 270-322, RGB 1999-24 Peter Zanni and James Phelan, developers, were present. A new plan as-built was submitted and reviewed. William Hecht moved to approve the Certificate of Compliance with conditions in perpetuity. Will Finch seconded. Voted 5-0-0 in favor. 25 Brook Street, DEP 270-370, RGB 2002-13 Gary Short, owner, was present. A site visit was done Sunday. One tree was marked to be cut and two were marked to be limbed. Mr. Short was not certain when he would have the trees cut. Fran Fink suggested if trees were not to be cut now, applicant could come back for a Minor Project permit instead of leaving the Order of Conditions for the addition open. Applicant agreed to leave the order open until the trees comedown Will Finch moved to approve the Certificate of Compliance for 25 Brook Street, and Rebecca Longley seconded. Voted 5-0-0 in favor. 7:30p.m. Public Hearing, Notice of Intent, Archstone-Smith Operating Trust, 40-42 and 70 West Street, RGB 2003-46 Rick Latini and Bob McCullough were present for the applicant. Mr. Latini went over revisions to the plans as discussed at their last meeting. Erosion controls were revised, subject to future refinement by the contract. A utility plan was added. A wetland replication plan was added. Rebecca Longley asked Mr. Latin to go over several details in the drainage design. He showed her what she was asking about. She also asked about herbaceous plants in the replication area. Mr. Latin said a New England wetland seed mix could be used. Doug Greene asked where the final existing outlets were for the drainage system. Mr. Latini said records were not complete in Woburn, but they will examine in the field. Fran Fink distributed and memorandum and went over her comments. Overall, Joe Delaney and Fran Fink think the drainage system is on target. However, there are some details to refine. Minutes, Reading Conservation Commission, October 22, 2003 Mr. Latini responded with the following: • A copy of the NOI will be submitted to the Army Corps of Engineers for comments. • Soil test pits will be done tomorrow and the storm water drainage plan will be revised as needed • They would like to use area drains in landscaped areas. Can add sumps to them. • There is some leeway in the DEP Storm Water Management Policy concerning depth to the water table for detentions basins. Soils are tight glacial till. • They will conduct bedrock/ledge explorations next week. • The final decision on the West Street layout will be made by the Selectman under the Comprehensive Permit. Will Finch said the silt fence line is not long enough. Then he moved to continue the hearing until November 5`h at 8:00p.m. Kelley Meier seconded. Voted 5-0-0. Old/New Business continued 320 Haverhill Street, DEP 270-_, RGB Site visit on Sunday. There is still planting to be done, final pavement coat on driveway. Hydroseeding will be done. Will Finch moved to approve the Occupancy Permit, Rebecca Longley seconded. Voted 5-0-0 in favor. 473 Lowell Street, RGB 2002-38 Fran Fink reported that the Town Engineer had no problems with the proposed infiltration system design. Will Finch moved to approve the infiltration system design, William Hecht seconded. Voted 5-0-0 in favor. 19 Dean Road, RGB 2003-17 Applicant wants to enlarge the deck under present Determination. Kelley Meier moved to approve the revised site plan, William Hecht seconded. Voted 5-0-0 in favor. 46 Bainbridge Road, RGB 2003-21 The owner was not present. Will Finch reported on several options discussed during the site visit for roof runoff. Fran Fink suggested sending applicant letter requesting soils test and infiltration system. Lot 5 Pondview Lane John Henson, owner, was present and requested approval of certain plan revisions. The Commission scheduled and site visit and will continue the discussion at the November 5 h meeting. Adams Way, DEP 270-333, RGB 2000-8 Fran Fink reported on a site visit with Ed Oteri. She discussed a follow-up letter with the Commission, and they approved sending it. Applicant needs to renew Order of Conditions and come before the Commission to discuss remaining work. The Commission will make a site inspection. 7 Harvest Road, DEP 270-372, RGB 2002-17 Fran Fink received report from Mickey Marcus and read this to the Commission. There will be a spring site visit with the Commission and Mr. Marcus. Rebecca Longley moved to issue an Occupancy Permit, Kelly Meier seconded. Voted 5-0-0 in favor. 34 Mill Street, Enforcement Order The Commission ratified the Enforcement Order. 294 Main Street, Enforcement Order Fran Fink reported that the owners fired the contractor. The new contractor met with Fran-on--Monday. There is grading on both sides of the stream, landscaping will be today. Fran will follow-up with site visit. Minutes, Reading Conservation Commission, October 22, 2003 44 Pitman Road, Notice of Violation The former owner called, contractor will do work Saturday. Fran will follow-up with site visit. 29 Dividence Road, DEP 270- RGB 2003- _ The Commission reviewed a bond estimate from Engineering and approved a bond in the amount of $7,500. 115 Charles Street, DEP 2870- RGB Fran Fink reported observations from recent site visit: backyard scraped clean of all vegetation beyond limits of work; fill and loam were brought in; area around pool was regarded and a new retaining wall was built; safety fence had been removed but not replaced; a few bushes were planted. Most of this work was not part of the approved plan. The Commission will make a site visit on November 2. Fran will send letter to owner regarding a future site visit and need to mulch or seed bare soils. 26 Nelson, 704 Haverhill, 70 Forest, 3 Indiana and 34 Duck Kelley Meier moved to close the Minor Project files, William Hecht second. Voted 5-0-0 in favor. Minutes William Hecht moved to accept the minutes of August 27'', 2003, Kelly Meier seconded. Voted 4-0-1 in favor. 8 Strawberry Hill Lane Kelly Meier moved to close the Minor Project file for planting shrubs and to order the owners to cease mowing within the ZNV. William Hecht seconded. Voted 5-0-0 in favor. Pondview Lane Fran Fink did a site visit, some landscaping and paving has been done. 210/275 Salem Street Fran Fink did site visit, called Lightship Engineering to fix tarps over stockpiles that had come loose. Water Main - Walkers Brook Drive Fran Fink reported that work is proceeding. She will continue to monitor closely. 14 Strawberry Hill Road DEP issued Superceding Order of Conditions, but applicant had not appealed RGB decision. A letter will be sent to the applicant. 29 and 37 Frank Tanner Drive Discussed confusion on trees to be cut down. Need good marking system in future. 8 Morgan Park Fran Fink will do a site visit with Building Inspector and owner to review drainage/water table concerns. 24 Harold Avenue The Commission directed Fran Fink to send a violation notice and fine of $100 for mowing the ZNV. 87 Walkers Brook Drive Fran Fink reported that a new hazardous waste status report has come in. She will review and report to Commission. At 9.30 PM, Will Finch moved to close the meeting, Rebecca Longley seconded. Voted 5-0-0 in favor.
