HomeMy WebLinkAbout2004-05-26 Conservation Commission MinutesMinutes, Reading Conservation Commission, May 26, 2004 Minutes of the Reading Conservation Commission Selectman's Meeting Room, Town Hall May 26, 2004 Present: Doug Greene, Will Finch, Bill Hecht, and Jamie Maughan, Commissioners; Fran Fink, Administrator The meeting was called to order at 7:00 p.m. Old/New Business 25 Lucy Drive Mr. and Mrs. Columba, owners, were present. Fran Fink reported a violation noted during a site inspection, namely clearing and grading conducted in Buffer Zone and possibly in the wetland without a permit. Commissioners had also inspected. They expressed concerns about steepness of resulting slope, lack of topsoil, and absence of Zone of Natural Vegetation. Commission requested surveyed site plan showing existing wetlands boundaries, topography, stone wall, and structures. They also requested proposed grading and planting plan to address the concerns raised. The owners agreed to provide the plans before June 23. A letter will be sent. Reading Memorial High School, Oakland Road, OOC, DEP 270-416, RGB 2003-51 Dave Capaldo, architect, DPC, and Josh Alston, engineer, JNEI, were present. The Commission reviewed the pre-construction conditions, including plans for Phase 1 of construction. The construction sequence plan needs additional work, but the Commission authorized work to begin for Phase 1. The Administrator will work with the contractor on the rest of the sequence. The Commission asked for the Storm Water Pollution Prevention Plan. Public Hearing, Notice of Intent, 107 Walnut Street, RGB 2004-14 The hearing was postponed to June 9, 2004 at 8:15 PM at the request of the applicant. Public Hearing, Notice of Intent, 1503 Main Street, RGB 2004-15 The Chairman opened the hearing. Steve Eriksen, engineer, Norse Environmental, presented revised site plans including tree lines, limits of work, and roof infiltration systems. He reported that the Board of Health will require new soils tests for the septic design. Plan still shows clearing over reserve area and house is farther east than original plan. The Commission raised concerns about the extent of tree clearing and grading and their impact on the health of remaining trees and the function of the Buffer Zone. They also questioned the size of the garage. IVED CLERK DING, MASS. 1005 FEB 6 ~ All: 1i Minutes, Reading Conservation Commission, May 26, 2004 Joe Cloonan of the Reading Open Land Trust said ROLT was in contact with the applicant about possible donation of some portion of the land to them. Bill moved and Jamie seconded to continue the hearing to June 9, 2004 at 8:00 PM. Voted 4-0 in favor. Public Meeting, Request for Determination of Applicability, 53 Batchelder Road, RGB 2004-19 The Chairman opened the meeting. Alicia Botticelli-Tarasuk presented the plan to move a shed, cut 3 trees, plants shrubs and lawn, and add fencing in the back yard. Proposed work is in.the Buffer Zone. The Commission asked for information on the species of shrubs to be planted and asked that the extension of the lawn end 25 feet or more from the rear lot line. The applicant agreed this limit. The Commission reviewed and revised draft Conditions. Will moved and Bill seconded to issue a negative Determination with the Conditions as amended this evening. Voted 4-0 in favor. Public Hearing, Notice of Intent, between 201 and 275 Salem Street, DEP 270-423, RGB 2004-13 At the request of the applicant the hearing was postponed to June 23, 2004 at 7:45 PM. Public Hearing, Request to Amend Order of Conditions, DEP 270-352, RGB 2001-14, Walkers Brook Crossing The Chairman opened the hearing. Brad Latham, Attorney, and Ed Shaw, Dickinson Development, were present. The Commission reviewed a letter drafted by Fran concerning the revised site plans. Mr. Shaw presented additional plans to change the face of the retaining wall in certain areas from vegetation to stone. The draft letter was amended. The Commission asked for a site visit and a final construction sequence to be scheduled in the near future. Bill moved and Will seconded to close the hearing. Voted 4-0 in favor. Bill moved and Will seconded to issue the draft letter as amended. Voted 4-0 in favor. Public Hearing, Notice of Intent, 26 Glenmere Circle, RGB 2004-20 The Chairman opened the hearing and presented the Commission's site visit report. Kevin McDermott, the applicant, was present and described the proposed work to add a room and a garage to the house. Fran gave a site visit report and described observations of soils, plants, and surface water that indicate the wetlands boundary includes much of the rear and side yards. Thus, at least part of the proposed work would be in the wetland, and any remainder would not meet the Minutes, Reading Conservation Commission, May 26, 2004 setback requirements. She proposed a second site visit with the applicant's wetland delineator to review the wetland indicators and revise the boundary on the site plan. Mr. McDermott agreed to arrange the visit. Bill moved and Jamie seconded to continue the hearing to June 23, 2004 at 7:30 PM. Voted 4-0 in favor. Old/New Business: 19 Zachary Lane, Order of Conditions, DEP 270-236, RGB 1991-10 Mr. Dell'Anno, owner, was present. The Commission needed more time to review the as-built plan, ZBA records, and engineer's analysis. Jamie questioned how pervious the pavers actually are, and Mr. Dell'Anno said they had been accepted by the ZBA before they were installed. He had not yet recorded the deed restriction that the ZBA required as a condition of their approval. The Commission continued the discussion to the June 9, 2004 meeting. 3 Zachary Lane, Order of Conditions, DEP 270-411, RGB 2003-41 Will moved and Bill seconded to authorize the Administrator to approve the planting plan if it meets the Conditions of the Order. Voted 4-0 in favor. 40 Azalea Circle, Order of Conditions, RGB 1991-3 Bill moved and Jamie seconded to grant an Extension Permit for two years beyond the present expiration of the Order. Voted 4-0. 118 Fairchild Drive, Determination of Applicability, RGB 2003-26 Fran reported a site inspection. Site is stable and work is complete. Jamie moved and Bill seconded to close the DA file. Voted 4-0. 20 Melendy Drive, Order of Conditions, DEP 270-391, RGB 2003-8 Fran reported a site inspection. ZNV bounds and silt fences needed some attention. Pondview Lane Subdivision, Order of Conditions, DEP 270-345, RGB 2002-52 Will moved and Bill seconded to accept a revised site plan for Lot 9 as an insignificant plan change under the Order of Conditions. Voted 4-0 in favor. 58 Chequessett, Determination of Applicability, RGB 2000-25 and Minor Project Permit Fran reported a site inspection. Site is stable and work is complete. Bill moved and Will seconded to close the DA and MP files. Voted 4-0. Adams Way, Order of Conditions, DEP 270-333, RGB 2000-8 The Commission received no response from Ed Oteri to the Enforcement Order. 80 New Crossing Road, Order of Conditions, DEP 270-285, RGB 1996-9 Minutes, Reading Conservation Commission, May 26, 2004 After noting a lack of response to memorandum sent in March, the Commission asked Fran to send a letter to the owner requesting that actions be take to resolve the outstanding issues by the first Commission meeting in July. 335 Main Street The Commission decided to contact the owner and arrange a site inspection to follow up on the tree cutting violation and drainage concerns raised last winter. 294 Main Street Fran reported invasive plants coming up in the wetland restoration areas and banks. The Commission decided to contact the owner and arrange a site visit to identify and address concerns. 7 Seaver Road Fran reported a recent site inspection. Foundation has been excavated and there is water in the bottom, along with peat and grey layers. Area probably was a wetland, filled at time that house was constructed. Owners will be reminded to submit planting plan. Minor Projects Will moved and Bill seconded to accept Minor Project permits for work at 30 Chequessett (fence), 10 Summer Avenue (deck), 25 Lucy Drive (above-ground pool), 213 Charles (shed), and 242 Forest Street (above-ground pool). Voted 4-0 in favor. New Elementary School, Sunset Rock Lane Fran reported conditions observed during a recent site visit. The Commission asked her to send a letter to the School Department concerning problems that need to be addressed. 123 Lilah Lane Fran reported a site inspection. Site is stable and work is complete. Will moved and Bill seconded to close the DA file. Voted 4-0.. Sunset Rock Lane Subdivision The Commission reviewed a letter from the developer, Peter DeGennaro, requesting release of the Letter of Credit. The Commission asked Fran to send a reply that the money will be released as soon as the street trees have been planted. Johnson Woods The Commission reviewed CPDC memos. Fran will meet soon with Bill Bergeron and Joe Delaney soon.. 54 Haystack A site inspection will be made before the next Commission meeting. The meeting adjourned at 10:30 PM.
