Work will include construction of boardwalks, trail clearing and marking, and steps on steep slopes. The Commission approved the project and signed the proposal. Walkers Brook Crossing, Amended Order of Conditions, DEP 270-352, RGB 2001-14 Ed Shaw was present to request occupancy for the Phase 1 buildings. He described work that will be carried out during the next month, including landscaping around Chili's and Home Depot, invasive species removal and replacement planting, and planting the roadway shoulders along Walkers Brook. The CPDC has modified the street tree requirements along the opposite site of Walkers Brook Drive because there are already a number of trees present. Dickinson will plant three large oaks to fill in the gaps. Mr. Shaw submitted the revised Operation and Maintenance Plan, including settlement monitoring: He will submit foundation as-builts, and Chili's and Jordan's hazardous material handling policies soon. The Order of Conditions calls for Dickinson to post a bond or other surety prior to the occupancy of the first building to guarantee the remaining work. Mr. Shaw explained that they had posted a $3 million bond with DEP for all work on the site as part of the landfill capping approval. To date, DEP has released $750,000. The remainder covers all remaining work shown on the plans approved in the Order of Conditions. The contractor estimated that $4 million worth of work was left at the end of June and less than $3 million will be left by the end of July. He requested that the Commission waive the surety under the Order of Conditions because the work is already guaranteed. The Commission decided to inspect the site on July 27 and consider the waiver request during their meeting on July 28. 25 Lucy Drive, Violation notice Mr. and Mrs. Colomba were present with a proposed restoration planting plan and an application for a Minor Project permit for a deck. Vote: 4-0 in favor. Minutes, Reading Conservation Commission, July 14, 2004 Public Hearing, Notice of Intent, Meadow Brook Golf Club, 292 Grove Street, RGB 2004-18 The Chairman opened the hearing. Warren Cochrane and Joe Orzel were present. Mr. Cochrane said DEP has not yet issued a file number. Mr. Cochrane said that he had contacted the Health Administrator about abandoning the septic system, but does not have a definitive response yet. He believes the system is located between the pool house and the wetlands. He is reluctant to conduct the soils test for the roof infiltration system at this time because of the risk of hitting the septic system. Thus, he would like to wait until after the pool is closed for the season in early September. The Club is working to stabilize the eroded portion of the hillside. The Commission reviewed and amended a draft Order of Conditions. Mr. Finch moved and Mr. Hecht seconded to close the public hearing. Vote: 4-0 in favor. Mr. Finch moved and Mr. Hecht seconded to issue the Order of Conditions with the Findings and Conditions as amended this evening, pending receipt of a file number from DEP. Vote: 4-0 in favor. Mr. Greene moved and Mr. Hecht seconded to release the Town portion of the state fee for wetland delineation. Vote: 4-0 in favor. Mr. Finch moved and Ms. Longley seconded to close the public hearing. Vote: 4-0 in favor. Mr. Hecht moved and Ms. Longley seconded to issue the Order of Conditions with the Findings and Conditions as amended this evening. Vote: 4-0 in favor. Ted Moore, applicant, Bob Gargano, contractor, Bill Bergeron, engineer, and Brad Latham, attorney, were present. Ms. Fink reported that a meting had taken place with staff and Town Counsel concerning access over the Town land at the end of Longwood Road. Counsel is working on appropriate documents. She also reported that a demolition application had been filed and work was underway to renovate the barn without a Building Permit. Minutes, Reading Conservation Commission, July 14, 2004 Mr. Sparages submitted a plan showing more information about the existing drainage systems and said the catch basins had been cleaned recently. Some of them are blocked. He is working on plant inventories for the wetlands replication plan. Ms. Fink reviewed comments from DEP on the file number notice and described observations of groundwater elevation, buried peat layers, and unnatural fill materials made during the soils tests. She raised questions about the filing fee and said that more time is needed to review the materials submitted on July 8 with the Town Engineer. An abutter stated that he would support removing the ATM kiosk from the plan and saving the existing trees there and in the skate park area. Mr. Finch moved and Mr. Hecht. seconded to continue the hearing to July 28, 2004, at 8:00 PM. Vote: 4-0 in favor. Public Hearing, Notice of Intent, 311 Haverhill Street, DEP 270-429, RGB 2004-24 The Chairman opened the hearing. Mary Grimmer, applicant, and Peter Flink, engineer, were present. Mr. Flink reported the outcome of recent soils test and presented a revised site plan. The basement sump pump outlet will be directed to the rear of the property. The soils can support the dry well design. Ms. Longley questioned the wetlands delineation at flags A5- A7, based on a site inspection. Mr. Flink said the delineation was done in 2002. The Commission asked the Administrator to check the delineation. The Commission discussed the proposed drainage design and grading. Mr. Finch moved and Mr. Hecht seconded to continue the hearing to July 28, 2004, at 8:15 PM. Vote: 4-0 in favor. Public Meeting, Request for Determination of Applicability, Brian Paglia, 59 Dana Road,' RGB 2004-25, The Chairman opened the meeting. Mr. Hecht gave a site visit report and said that the wetland delineation looks accurate. The Commission reviewed draft Conditions. Ms. Longley moved and Mr. Hecht seconded to issue a negative Determination of Applicability with the Conditions as drafted. Vote: 4-0 in favor. 15 Timothy Place, Request for Amended Order of Conditions Because revised site plans were not submitted, the Commission continued the hearing to July 28, 2004, at 8#0 PM. 4 Minutes, Reading Conservation Commission, July 14, 2004 Old/New Business 80 New Crossing Road, Order of Conditions, DEP 270-285, RGB 1996-9 Because the owner has not responded to recent correspondence regarding the need to finsh the work for a Certificate of Compliance, the Commission will send a letter with deadlines for response. 48 Whittier Road, Order of Conditions, DEP 270-401, RGB 2003-27 The owner did not submit an as-built plan. The Commission will place the request for Certificate of Compliance and bond release on the agenda for July 28 if the plan arrives. Adams Way, Order of Conditions, DEP 270-333, RGB 2000-8 The Commission reviewed a draft letter to Ed Oteri concerning the taking of the bond for failure to finish the work. They asked the Administrator to. have Town Counsel review it and then send a final version to Mr. Oteri. 7 Harvest Road, Order of Conditions, DEP 270-372, RGB 2002-1 Mr. Finch moved and Ms. Longley seconded to issue a Certificate.of Compliance with conditions in perpetuity for the project. Vote: 4-0 in favor. Mr. Finch moved and Mr. Hecht seconded to release the $20,000 surety account in full, including all interest that has accumulated to date. Vote: 4-0 in favor. 320 Haverhill Street, Order of Conditions, DEP 270-386, RGB 2003-2 The owner did not submit an as-built plan. The Commission will place the request for Certificate of Compliance and bond release on the agenda for July 28, if the plan arrives. 28 Francis Drive, Enforcement Order Ms. Longley reported that during the site inspection in a recent rain storm, water was flowing under both fences after removal of the peastone. Ms. Fink reported that after the storm today there was a small puddle on the Aronis property. The Commission asked the Administrator to send a letter to Mr. Aronis stating the the Commission is satisfied with the work he has completed to restore flow in the swale. 107 Walnut Road, Order of Conditions, DEP 270-430, RGB 2004-1.4 At the advice of Mike Abell, DEP Northeast Regional Office, the Commission will send a letter to the owners directing them not to plant any shrubs in the vernal pool. A copy will be sent to DEP. 539 Pearl Street, Determination of Applicability, RGB 2003-43 The Commission reviewed. and accepted a revised plan for driveway layout and landscaping. However, they observed rain water flowing through a gap between the roof and the gutter during a site inspection in a storm. A letter will be sent accepting the plan and directing the owner to repair the gutters. Sunset Rock Lane, new elementary school, Order of Conditions DEP 270-341, 2000-38 The Commission reviewed a site plan revision for playground equipment north of the building. Mr. Greene moved and Mr. Hecht seconded to accept the revised plan as an insignificant plan change under the Order of Conditions. Vote: 4-0 in favor. Proposed changes to 310 CMR 10.00 - Buffer Zone projects The Commission reviewed proposed changes in the wetlands regulations by DEP. A letter will be sent commenting on various concerns. 54 Haystack Road, Order of Conditions, DEP 270-355, RGB 2001-18 Ms. Fink reported that neither the Building Inspector nor the Town Engineer had approved the retaining wall construction. A letter will be sent to the owner directing him to remove the wall and replace it with an interlocking block wall as approved.
