Old/New Business
60 Haverhill Street, Order of Conditions, DEP 270-407, RGB 2003-31
The Commission reviewed a revised site plan for replacement of a porch.
Mr. Hecht moved to accept the revised plan as an insignificant plan change under the
Order of Conditions. Ms. Longley seconded. Voted 4-0 in favor.
Doug Greene arrived after the vote.
Public Hearing
468 West Street, and 6 Kelch Street, Johnson Woods, Notice of Intent, DEP 270-424,
RGB 2004-10
The Chairman opened the hearing.
Bill Bergeron of Hayes Engineering, Bob Gargano, contractor, and Brad Latham,
attorney, were present for the applicant.
Mr. Maughan asked about the status of the Peterson site that was originally included in
the NOI. Mr. Latham said the site was no longer part of the proposal and any work on
the site that the Petersons intend to do would have to come under a separate permit
application. The Petersons have been notified by Mr. Moore that they may no longer use
the driveway on the Johnson Woods land.
Mr. Bergeron stated that a copy of the NOI had been sent to MNHESP and that he will
forward a copy of the certified mail receipt when it arrives.
There was general discussion about the extent of the Commission's jurisdiction over the
proposed work. The Commission explained that jurisdiction in this case extends beyond
work in wetlands and buffer zones because of the changes in drainage characteristics
throughout the site and the applicability of the DEP Stormwater Management Policy to
those changes. Thus, the Commission generally has authority over the drainage system
and the areas that contribute to it, even areas and system components outside of the buffer
zones.
There was general discussion about how to handle Partial Certificates of Compliance and
individual Certificates of Occupancy.
There was general discussion about marking trees to be saved and other limits of work.

There was general discussion about phasing and sequencing of work and limiting the
extent of disturbed areas within the site during construction.
The Commission reviewed the Attachment to the Order of Conditions drafted by Ms.
Fink, along with certain revisions requested by Mr. Latham. The Commission amended
the draft Attachment.
Mr. Finch moved to grant a waiver under Section 3.1) of the Reading Wetlands Protection
Regulations for the location, grading, and surface of the proposed driveway from
Longwood Road Extension to the proposed single-family house. Ms. Longley seconded.
Voted 5-0 in favor.
Mr. Hecht moved to grant a waiver under Section 3.1) of the Reading Wetlands
Protection Regulations for the proposed level spreader at the outfall of the infiltration bed
in the southern end of the site (Res 02). Mr. Finch seconded. Voted 5-0 in favor.
Mr. Hecht moved to issue the Order of Conditions with the Attachment as amended this
evening. Ms. Longley seconded. Voted 5-0 in favor.
The Commission closed the hearing and adjourned the meeting at 11:45 PM.
