August 18, 2004 Present: Bill Hecht, Chairman, Will Finch, Doug Greene, Becky Longley, and Jamie Maughan, Commissioners; Fran Fink, Administrator The meeting was called to order at 7:00 p.m. Old/New Business Johnson Woods, Order of Conditions, DEP 270-424, RGB 2004-10 Brad Latham, attorney for Johnson Woods, requested that the Commission support the conveyance of an access easement over the Town Conservation land at the end of Longwood Road for the existing Leary and Peterson Houses and the new Savarino house that is part of the Johnson Woods project. In addition to the Commission's support, the proposal must also receive the support of Town Meeting and the Legislature because the land is protected under Article 97. The Commission can set conditions on the easement with respect to width of pavement, number of houses served, and other matters. Will moved to submit the appropriate articles for the Town Meeting Warrant to enable the Commission to create the easement. Doug seconded. Voted 5-0 in favor. Public Hearing, Notice of Intent, 1503 Main Street, DEP 270-425, RGB 2004-15 - Bill opened the hearing. Harry Gresek, applicant, was present. The Commission reviewed new soil test data for the septic system and roof infiltrators. The Commission and Mr. Gresek discussed various factors related to the position of the house on the lot. Mr. Gresek agreed to provide at least a 35-foot Zone of natural vegetation between the lawn and the wetland boundary and to remove the reserve area to avoid some tree clearing east of the house. He will revise the plan. Becky moved to continue the public hearing to September 8, 2004 at 7:30 PM. Doug seconded. Voted 5-0 in favor. Public Hearing, 15 Timothy Place, Request for Amended Order of Conditions, DEP 270-398, RGB 2003-16 Bill opened the hearing. Nick Diranian, applicant, was present. The Commission reviewed a revised site plan and noted a number of problems related to setbacks, roof drains, inaccurate measurements, lack of fencing, placement of gravel below the lower retaining wall, and other probems. Fran also reported that during a recent site visit, it appeared that the upper stone wall under construction might be approaching the front lot line or even over it. Will moved to permit the proposed deck and stairs to be located no closer than 31 feet from the wetland boundary. Doug seconded. Voted 5-0 in favor. The Commission requested that Mr. Diranian prepare and submit an accurate site plan showing present site conditions by survey and proposed work by scale. They requested that no further work be done until a final site plan has been approved. Wood End School, Order of Conditions, DEP 270-341, RGB 2000-38 Will reported a recent site visit. The final work approved for the northwestern detention basin in July has still not been completed. The Commission discussed various approaches to relieve the ponding that has persisted in the basin all summer. They asked Fran to contact the design engineer to discuss solutions. Walkers Brook Crossing, Amended Order of Conditions, DEP 270-352, RGB 2001-14 The Commission reviewed the emergency response plan submitted by Chili's. They were concerned about the timing of completion of the detention basin in Phase 2 that serves the building in Phase 1. They also were concerned about the completion of work in Walkers Brook Drive. Will moved to authorize the Administrator to sign off on Occupancy for Chili's. Doug seconded. Voted 5-0 in favor. 80 New Crossing Road, Order of Conditions, DEP 270-285, RGB 1996-9. Plans arrived too late for review during this meeting. The Commission will continue this matter on August 25, 2004. Pondview Lane, Order of Conditions, DEP 270-345, RGB 2000-52 The Commission reviewed the as-built site plan and site visit reports for Lot 1. They noted several minor erosion problems and asked Fran to contact the new owner about them. They also requested an inspection of the subdivision with the developer. Will moved to issue a Partial Certificate of Compliance for Lot 1 of the subdivision. Doug seconded. Voted 5-0 in favor. 175 Franklin Street, preliminary subdivision plan The Commission reviewed a proposed subdivision plan for 175 Franklin and a draft memorandum. They had previously issued an Order of Resource Area Delineation for the property. They amended the memorandum. Will moved to send the memorandum to the CPDC as amended this evening. Becky seconded. Voted 5-0 in favor. Reading Memorial High School, Order of Conditions, DEP 270-416, RGB 2003-51 The Commission reviewed a site visit report from Fran. There were some concerns about erosion controls that the contractor has been asked to address. Mill Street beaver dam the beaver dam at Mill Street will be lowered to prevent flooding of the adjacent septic system in North Reading. The meeting adjourned at 11:00 PM. 2
