' LE R I i Selectman's Meeting Room, Town Hall _ mA s s. n ,gym October 27, 2004 tG~' lb P 2: 57 Present: Doug Greene, Chairman, Will Finch, Vice, Bill Hecht, Jamie Maughan, and Becky Longley, Commissioners; Fran Fink, Administrator The meeting was called to order at 7:00 p.m. Old/New Business: 500 West Street - Violation Kevin Jaynes, owner of 500 West Street was present. Bob Nordstrand and Ben Nichols of ROLT were present. The Commission discussed recent work at the site including a swimming pool, fence, and landscaping. Work was in the buffer zone and the owner did not submit a Notice of Intent. Some of the work affected the adjacent land of ROLT. After discussing the site inspection report and maps available, the Commission requested that Mr. Jaynes submit a surveyed site plan of present conditions to indentify the extent to which the work complies with wetlands regulations and lot boundaries. Then, the applicant can file a Notice of Intent for any corrective work. Public Hearing, Notice of Intent, 7 Heritage Drive, DEP 270-433, RGB 2004-31 The Chairman opened the hearing. Mr. and Mrs. Pember were present. The Commission reviewed and amended draft findings and conditions. The Pembers asked several questions, and the Commission answered. Mr. Finch moved to close the public hearing. Mr. Maughan seconded. Voted 5-0 in favor. Mr. Finch moved to issue an Order of Conditions permitting the work, with the findings and conditions as amended this evening. Ms. Longley seconded. Voted 5-0 in favor. Public Hearing, Notice of Intent, 15 B Street, RGB 2004-30, The Chairman opened the hearing. Mr. Tremblay was present. The Commission reviewed information concerning ownership of the adjacent land. Part of the driveway and certain landscaping materials from 15 B Street extend into the abutting property. The Commission reviewed and amended draft findings and conditions. Mr. Tremblay asked several questions, and the Commission answered. Ms. Longley moved to close the public hearing. Mr. Finch seconded. Voted 5-0 in favor. s. Mr. Finch seconded. Voted 5-0 in favor. YMCA, Order of Conditions, DEP 270-304, RGB 1998-16 The Commission reviewed the Grant of Conservation Restriction and request for Certificate of Compliance. Ms. Longley moved to the accept the Grant of Conservation Restriction. Mr. Greene seconded. Voted 5-0 in favor. Ms. Longley moved to issue a Certificate of Compliance to the addition to the YMCA. Mr. Finch seconded. Voted 5-0 in favor. 46 A Street - Violation The Commission reviewed a site inspection report of a violation at 46 A Street, including location of a shed and fence in wetlands and buffer zone without a Notice of Intent. The Commission asked Ms. Fink to send an Enforcement Order for the relocation of these structures. 9 Mill Street, North Reading, DEP 245-1037 The owner has appealed the Superceding Order of Conditions issued by DEP, and North Reading Conservation Commission has joined the appeal. A preliminary meeting will be scheduled by DEP soon. 335 Main Street - Violation The owner has not responded in full to the previous violation notice. A second violation notice will be sent with deadlines for responses. 248 Main Street, Order of Conditions, DEP 270-296, 1997-35 Plans to finish the driveway and parking lot are complete. The owner will be contacted to begin the work and discuss the pending Conservation Restriction and maintenance plan. Wood End Elementary School, Sunset Rock Lane, Order of Conditions, DEP 270-341, RGB 2000-38 The Commission reviewed the status of work and will send a letter to the School Department concerning remaining items. 80 New Crossing Road, Order of Conditions; DEP 270-285, RGB 1996-9 A site visit is scheduled for October 28 to review status of work. Reading Memorial High School, Oakland Road, Order of Conditions, DEP 270-416, RGB 2003-51 The Commission reviewed several site inspection reports. Sediments have reached the Abedona River on more than one occasion. The Commission will'contact the contractor to resolve problems, and review the status again on November 3. Minutes, Reading Conservation Conunission, October 27, 2004 Water Main, Ash Street to Walkers Brook Drive, Order of Conditions, DEP 270-403, RGB 2003 -29 The Commission reviewed the as-built site plan. Grading is acceptable. The contractor will be asked to seed the disturbed areas. Walkers Brook Crossing, Order of Conditions, DEP 270-352, RGB 2001-14 The Commission reviewed a site inspection report. A letter will be sent to the developer and Eric Rulison will be contacted to monitor the detention basin work. Lob's Pound Mill Conservation Area, Order of Conditions, DEP 270-418, RGB 2004-2 Mr. Maughan moved to grant a waiver for a picnic table located less than 25 feet from the wetland. Mr. Greene seconded. Voted 4 in favor-0 opposed - 1 abstained (Mr. Finch). 105 Arcadia, Determination of Applicability, RGB 2002-10 The Commission reviewed a site inspection report. A deck, patio, and walkway have been constructed that do not conform to the approved plan. A letter will be sent to the owner. Johnson Woods, Order of Conditions, DEP 270-424, RGB 2004-10 The Commission reviewed a site inspection report. The contractor will be contacted about removal of the contaminated soils in the orchard. The meeting adjourned. 4
