Minutes of March 10, 1999 Town Hall Selectmen's Meeting Room
PRESENT: Chair Nancy .Eaton, Members, Harold "Luckyā€˛ Hulse, Will Finch,
Mark Gillis (7:32), John Casciano, Vincent Falcione, Conservation Administrator Karen
DeFrancesco, and Recording Secretary Kathy Morgan
ABSENT: Leo Kenney
7:10 PM The meeting was called to order.
Members welcomed Vincent Falcione as a new member of the Commission.
Minutes A motion was made and seconded that the Minutes of 12/30/98, be accepted as
corrected. Voted: 4-0-1, V. Falcione abstained. A motion was made and seconded that
the Minutes of 1/13/99, be accepted as corrected. Voted: 4-0-1, V. Falcione abstained.
A motion was made that the Minutes of 1/28/99, be accepted as corrected. Voted:
4-0-15 V. Falcione abstained. A motion was made and seconded that the Minutes of
2/10/99, be accepted. Voted: 4-0-1, V. Falcione abstained. A motion was made and
seconded that the Minutes of 2/24/99, be accepted as corrected. 4-0-1, V. Falcione
abstained:
7:30 PM Request far Extension Permit EP #270-260, RCrB# 1994-14, by 70
Haverhill Street A motion was made and seconded that the permit be extended from
7/15/98 to 7/15/99. Voted: 4-0-1, V. Falcione abstained.
7:31 PM Request for Extension Permit RGB # 1995-34, Cory Lane Estates
A motion was made and seconded that the permit be extended from 10-7-98 to 10-7-99.
Voted: 4-0-1, V. Falcione abstained.
7:35 PM Rublic Meeting - 1503 Main St Collins Realty Trust, RGB# 1999-3
The applicant, Mr. Gresek, wasn't present. The information submitted was felt to be
insufficient. The removal of fill is to be replaced back to the limit by hand. It was the
consensus of the members that the Administrator send Mr. Gresek a letter that a
delineation is not necessary and that substantial fill should be removed by 4/21/99, or legal
action will be taken. A motion was made and seconded to close the Public Meeting.
Voted: 5-0-1, V. Falcione abstained. A motion was to issue a positive determination.
Voted: 5-0-1, V. Falcione abstained.
7:45 PM Public Meeting - 26 Nelsen Avenue RGB# 1999-4 The applicant, Rose
Alteriso, was present at the meeting. She wishes to construct an addition to the right side
of her existing single family house. The addition is to be located in a lawned area within
100-feet of a stream. The Administrator advised that the addition will be, at its closest

point, 32 feet from the stream, Members advised that haybales should be used and all
excavated materials should be removed and disposed of properly. A motion was made
and seconded to close the public meeting. Voted: 6-0-0. A motion was made and
seconded to issue a negative determination with standard conditions. Voted: 6-0-0.
8:08 PM Public Hearing - 76 Causeway Road, Mass Highway Dept DEP# 270 xxx,
RGB# 1999-5 The applicant is requesting to remove approximately 500 cubic feet of
contaminated soil, they believe to be petroleum. They plan to dig no deeper than 5 ft. The
soils will be stockpiled for approximately 7-10 days then taken to Maine. Eighteen soil
borings have been done. The wetland line, determined from a previous filing, is at the
fence. A RAM plan has been submitted to DEP and the 21 waiting days have passed. The
Commission members would like more information on groundwater data, more detailed
disposal information, and a timeline. A motion was made and seconded to continue the
Public Hearing to 3-24-99 at 8:30 PM. Voted: 6-0-0.
8:30 PM Plan Change - 170084 Pleasant Street, DEP# 270-310, RGB# 1998-29
Chris Emilius explained that because the soil is better for the foundation and for
maneuvering the house into the lot, the RHA is requesting the removal of three trees to
relocate the house 3' closer to Wilson Street, They plan on replanting mature trees.
Mr. Kramer; 184 Pleasant St., stated the trees shouldn't be cut and mentioned that the
sidewalk was not outlined on the plans. Mr. Krupa, 1.62 Pleasant St., asked which came
first, moving the foundation or cutting the trees. Mr. Emilius stated cutting the trees, Mr,
Krupa also wanted to know when the water tests were done, and if this move would affect
the drainage, Mr. Emilius answered that the tests were done in February and that the
drainage shouldn't change. W. Finch suggested that another ground water test be done.
A motion was made and seconded that this plan change be considered an insignificant
plan change with the conditions that the Administrator approves replanting of trees and
the applicant gets the approval of the Board of Health, Voted: 6-0-0.
9:30 PM Continued Public Meeting - 11 Norman Road RGR# 1998-26
A motion was made and seconded to continue the Public Meeting to 5/19/99 at 7:30 PM.
Voted: 6-0-0.
9:40 PM Public Hearing - 24-30 Bay State Road EN 270 xxx, RGB# 1999-6
M. Gillis abstained from the project. The applicants, Mr. and Mrs. Cain were present
along with John Ogren from Hayes Engineering. Mr. Ogren explained plans for a three
house subdivision to be named Melendy Drive, The project will have deep sump catch
basins with gas hoods which will be diverted to the stormwater management area. Two of
the houses are located within the 100' buffer. Chair mentioned that Mr. Kenney advised
her that he would like to see the full 100' protected., Charles McDonald, 41 Canterbury
Dr., is concerned with flooding and stated that the residents on Canterbury Dr, are
opposed to the project unless it can be proven that there will be no increased water in the

area. He submitted a petition. Paul Coyne, 25 Govenors Dr., is concerned with the
stormwater management being so close to his house. He asked how the stormwater area
would be maintained. Mr. Ogren explained that an easement would be given to the town.
Mr. Tahmosh, 37 Canterbury Dr., is concerned with flooding and mosquitoes and
requested the applicant move the stormwater management area. Mr. McDonald asked if
the data submitted was accurate and up to date and asked if new data could be requested.
He was advised that the project has already been approved by the Board of Health. Mr.
McTaggart, 30 Bay State Road, stated that since the Peter Sanborn Place project went in
the area seems dryer. Mr. Cain, 24 Bay State Rd., stated that Lot 1. will be their house,
Lot 2, their daughter's, and Lot 3 will be sold. Mr. Ogren stated that because of the
grading over the pipe, the stormwater management area would be difficult to move. Mr.
Duval, is concerned this project will cause a water problem in the area. A motion was
made and seconded to continue the Public Hearing to 3/24/99, at 9 PM, in this room, and
without further notice. Voted: 5-0-1, M. Gillis abstaining.
Town Warrant Articles
Article 20 - Wood End Cemetery. A motion was made and seconded that the
Conservation Commission recommend that Town Meeting approve to support the subject
matter of Article 20: Voted: 6-0-0.
Article 21- 72 Van Norden. A motion was made and seconded that the Conservation
Commission recommend that Town Meeting approve to support the subject matter of
Article 21 with the amendment that it go to the care and custody of the Conservation
Commission pursuant to Chapter 40, Section SC. Voted: 5-0-0.
Commission's position on the new Conservation Commissioner: The Commission
reiterates not to recommend Mr. Pacillo while litigation is pending and recommends Beth
Ann Matathia.
11:00 PM A motion was made and seconded to adjourn. Voted: 5-0-0.
