Minutes of Wednesday, May 5, 1999 Town Hall Selectmen's Meeting Room
PRESENT: Chair Nancy Eaton, Members, Darold "Lucky" Hulse, John Casciano (7:05)
Will Finch, Bethann Matathia (9:45), Vincent Falcione, Consultant Leo' Kenney,
Conservation Administrator Karen DeFrancesco and Recording Secretary Kathy Morgan

7:00 PM The meeting was called to order,
7:01 PM Violation 1503 Main Street Mr. Gresek, the owner, was present. The
Administrator did a site inspection on Tuesday, 5/4/99, and found that the owner was in
the process of removing the fill. Mr. Gresek advised members that he had dealt with Mr.
Nadeau in the past and was told to remove the top piles and file an ANORAD. He also
mentioned a court action in 1995. Chair advised him that no wetland action was taken in
1995. Chair advised him that no work should be done on his property until he has filed for
an RDA and a delineation is made. The Administrator advised Mr. Gresek to stabilize the
area with some type of grass mix but he shouldn't mow it. She also advised members of a
pile of fill still present at the property. Members agreed that the $100 fine for activity
without approval should remain.
7:15 PM Public Hearing - 12 Timb rneck rive, DEP#270-xx_x, RGB# 1999-13
The public announcement was read and the attendees sworn in. Mr. Trodden, the owner,
explained the 20'x 40' inground pool, with accompanying deck and landscaping that he
would like to do at his property. Members felt that Flags 4 to 6 should be moved to the
property line due to the observation of skunk cabbage. The owner was asked about the
debris being dumped at the Timberneck Swamp. The Red Oak on the 25' line was asked
to be saved. Mr. Richards, an abutter, is concerned with having water problems after the
pool is installed. Chair explained similar situations where pools have gone in and there's
been no adverse affects.
A motion was made and seconded to close the public hearing. Voted: 5-0-0.
Discussion: Ok to remove pine trees, stock piles should be 100' away from the wetland,
and save the Red Oak on the 25' line. A motion was made and seconded to set Flags 1-4
as shown on the plan dated 4/12/99 last revised 4/28/99, Flags 4-6 to follow the property
line, and Flags 6-9 as shown on the plan and also to approve with the discussed
conditions. Voted: 5-0-0.
7:40 PM Public Meeting - 39 Criterion Road, RGYN4 1999 11
Mr. Roberts, the owner was present. He explained to members his proposal for a 16'x 32'
inground pool in the area that the existing above-ground pool exists. The contractor will
_be_removing fill off-the-property A-motion was made and seconded to close the public
meeting. Voted: 5-0-0.

A motion was made and seconded that a negative determination be issued with conditions
as discussed and the standard conditions. Voted: 5-0-0.
7: 45 PM Minutes A motion was made and seconded to approve the minutes of 4/7/99
as amended. Voted: 5-0-00.
7: 47 PM Reappointment of Members: A motion was made and seconded to
recommend to the Board of Selectmen the appointment of V. Falcione and W. Finch.
Voted: 5-0-0.
7:50 PM Violation 13 Nelson Ave The Administrator advised members that the owner
has been filling in his back yard which he was advised not to do in 1967. The
Administrator will send the owner a second letter and if there is no response after a week,
a third letter will be sent and fines issued.
7:55 PM Violation- 532 Pearl Street The Administrator advised members that the
owner has removed the fill from the area and advised they will file with the Conservation
Commission if further work is to be done.
8:00 PM _Public Meeting - 306 Haverhill Street, Archdiocese of Boston Father Tom
Connolly explained the needs the church, St. Athanasius, est, in 1960, has for additional
space for meetings and educational classes. George Raseak, Architect, explained that the
structure, a one story building with a flat roof, will be constructed within the current
paved area and will have drywells for roof runoff. There will be a decrease of 5,000 sq. ft.
from impervious to lawn. A site visit was conducted 5/4/99 and Chair reviewed site notes.
Father Connolly agreed they would remove the debris off the property. A motion was
made and seconded to close the Public .Meeting. Voted: 5-0-0.
A motion was made and seconded to issue a negative determination with the standard
conditions and two copies of a revised plan showing the fill material to be removed in the
NW corner of the property. Voted: 5-0-0.
8:30 PM Continued Public Meeting - 33 Lynn Village Way, RGB# 1999-9 Members
revisited the site and observed staked area. A motion was made and seconded to close
the public meeting. Voted: 4-0-1, Mr. Hulse abstained. A motion was made and
seconded to issue a negative determination with the standard conditions, re-watering and
stabilization of 3-1 slope around the pool. Voted: 4-0-1, Mr. Hulse abstained.
8:40 PM Issuance of (Order of Conditions - 24-30 Bay. State Road, D P# 270-31
RGB# 1999-6 The Administrator is to get an estimate for a bond amount on the project.
A motion was made and seconded to approve and issue the Order of Conditions as
- amended. Voted: 6=0-0 (This item was internipted and finished at 10:00 PM)

9:10 PM Continued Public Meeting - 270 Lowell Street, RGB# 1999-10 A motion
was made and seconded to continue the Public Meeting to 5/19/99 at 7:15 PM. Voted:
5-0-0.
9:11 PM Public Hearing - 908 Main Street, DEN 270-xxx, RGB# 1999-14 The
public announcement was read and attendees sworn in. Atty. Stephen Columbus and
Karen Malarkey, LEC Environmental Consultants, were present for the applicant. Ms.
Malarkey advised that the surveyors are to review the stakes on the property a north-
easterly flag to be added and Flags 24, 30 & 32 will be added and Flags 48 and 50 will be
connected. A site visit was conducted 5/4/99 and Chair reviewed the site notes. Members
noted debris at the NE and rear property line. Atty. Columbus stated there is no sub-
division planned, possibly an ANR for a second structure.
Donald Smith, 927 Main St., asked where the town stands on the easement to the culvert
on that property. Chair informed him that the Article was withdrawn from Town Meeting.
Mr: Columbus will ask his client about it.
Some neighbors complained of flooding because of the clogged culvert. The
Administrator will talk with the Town Engineer about it. L. Kenney stated that there has
been some dumping by neighbors into the wetlands. Mr. Mack, 911 Main Street, advised
members that Mrs. Minotti's son has a landscaping business and has been dumping on the
property.
A motion was made and seconded to continue the public hearing to 5/19/99 at 8:00 PM,
in this room, with no further notice. Voted: 5-0-0.
9:45 PM Recess taken.
9:50 PM Public Hearing - 25 Cory Lane Estates (Lot #3) DEP# 270-xxx, RGB#
1999-15 The public announcement was read and attendees sworn in. Attorney Senior
and Paul Finocchio were present. Atty. Senior explained their need for an additional
355 sq. ft. to the footprint and he stated there would be no increase in drainage area.
Paul Finocchio said the grading will remain the same with the elevation of the garage and
top of the foundation noted on the plans dated 4/27/99. The haybale line is staked.
Atty. Senior advised that a set of plans showing changes was submitted to both
Conservation and the building inspector. Chair advised that the plan change was never
brought before the Commission and they were never made aware of any changes. The
Administrator has no authority to approve plan changes.A motion was made and
seconded to continue the hearing to 5/19/99 at 8:30 PM, held in the Selectmen's room,
with no further notice. Voted: 5-0-0.

10:00 PM Reanest for Certificate of Compliance - 6 Rice Rd (Lot it) DFP# 2'70-SO
The Administrator explained that this was an old lot that was split, Lot A has already
received a Certificate of Compliance. A motion was made and seconded to issue a
Certificate of Compliance. Voted: 6-0-0.
11:10 PM A motion was made and seconded to adjourn. Voted: 6-0-0.
