7:05 PM The meeting was called to order.
7:06 PM MinutesA motion was made and seconded to approve the minutes of 5/5/99
as amended. Voted: 5-0-0.
7:12 PM Minor Project- 136 Willow Street Applicant proposes to build a wrap-
around deck, 40' from his rear property line. A motion was made and seconded to
approve the minor project for an open-slotted deck. Voted: 5-0-0
7:15 PM Public Meeting - 71 Red Gap Lang., RGB# 1999-16
Jean Marie Leahy, the owner was present. She would like to prune back some honey
locust trees on her property. The owner misunder the Administrator and thought she had
- ' been given permission to trim the hemlocks on her property line and, therefore, she only
put the pruning of the honey locust trees on her filing. She would also like to trim the
hemlock on her property line. Chair reviewed the site notes of 6/1/99. The Administrator
noted that the hemlock may not be on her property. Richard Holmes, 77 Red Gate Lane
the abutting neighbor, is concerned that his privacy would be deminished if the hemlock
were cut back and would prefer to keep the buffer that exists to keep the noise level out.
Minor Project: A motion was made and seconded to approve as a minor project signoff
the pruning of a red maple tree and honey locust overhanging the dwelling. Voted: 5-0-0
A motion was made and seconded to close the Public Meeting. Voted: 570-0
A motion was made and seconded to issue a positive determination for the removal of the
honey locust tree. Voted: 3-1-1, B. Matathia, N. Eaton, and W. Finch in favor,
J. Casciano against, H. Hulse abstained. Motion failed.
A motion was made and seconded to issue a negative determination with the following
conditions; 1) removed by a certified arborist to the property line, 2) all debris to be
removed off site, 3) no material to be dropped into the resource area. Voted: 3-2-0,
N. Eaton, W. Finch, and J. Cascione in favor, B. Mathahia and H. Hulse against. Motion
failed.

The applicant was advised that she could request to reopen the hearing, request a
continuance, or appeal to DEP for the Commission's failure to take action.
After an indication that the applicant was in favor of reopening the hearing, a motion was
made and seconded to reopen the Public Meeting. Voted: 5-0-0.
A motion was made and seconded to continue the Public Meeting to June 16, 1999, at
8:30 PM, in the Selectmen's room, with no further notice to the abutters, at the request of
the applicant. Voted: 5-0-0.
7:55 PM Continued Public Meeting 11 Norman Road, RGB# 1998-26
During the site visit, members, based on soil and ground vegetation, felt that Flags 9-15
were incorrect and should be brought closer to the proposed house location. Chair
explained that, until he could prove otherwise, the Commission would have to rely on data
on the FEMA map. A motion was made and seconded to continue the Public Meeting to
7/28/99, at 7:30 PM, in the Selectmen's room, with no further notice to the abutters, at the
request of the applicant. Voted: 5-0-0.
8:25 PM Public Meeting - 52 Summer Avenue, R YB# 1999-17
Mr. and Mrs. Plankey, the owners, were present. The owners would like to install some
drainage around their foundation to eliminate water in their basement. Chair read the site
notes of 6/1/99. The Administrator stated her concerns with the slope in the back and
with discharging into the wetlands. The applicants were requested to obtain more
information. A motion was made and seconded to continue the Public Meeting to
6/16/99, at 9:00 PM, in the Selectmen's room, with no further notice to the abutters, at
the request of the applicant. Voted: 5-0-0.
8:50 PM Public Rearing - 218 & 224 Salem Street, DEP# 270-xxx, RGB# 1999-19
The public announcement was read and attendees sworn in. Mr. Iapicca, the owner, was
present along with his attorney Charles Arthur. The owner explained the events up to this
point with respect to the changes in grade elevation. The applicant was advised to submit
revised plans showing the compensatory storage area, indicate where the haybale line is
with respect to the compensatory storage area, make sure the grade elevations coincide
with the grades in the field and locate indicate some larger trees. A motion was made and
seconded to continue the Public Meeting to 6/16/99, at 9:30 PM, in the Selectmen's
room, with no further notice to the abutters, at the request of the applicant. Voted: 6-0-0.
9:22 PM Continue Public Hearing 2_ 5 Cory Lane Estates (Lot #3), DEP# 270-319,
RGB# 1999-15 The public announcement was read and attendees sworn in. Attorney
Senior and Paul Finocchio were present for the applicant. Revised plans for Lot 3 dated
5/24/99 and additional conservation restriction for Lot 4 dated 5/24/99 deed restriction
was submitted and forwarded to Town Counsel. Also an aerial view showing any

additional structures dated 2/10/99 was submitted. Chair reviewed site notes. The
Administrator instructed that the workers install a second row of haybales at the end of
the riprap. Members were concerned that the back stairs end where the ZNV begins in the
back yard. The applicant agreed to bring the stairs up against the house so that they
would end at the 35' mark. The Commission and Attorney Senior reviewed the proposed
deed restriction. L. Kenney suggested to members that it should be stipulated that a
Certificate of Compliance will not be given if the grades aren't met. The applicant will
submit an amended plan showing the stairs brought up against the house.
A motion was made and seconded to close the Public Hearing. Voted: 6-0-0.
A motion was made and seconded to issue an Order of Condition with the following
conditions. 1) reflect haybales, 2) haybales around the edge of the pavement, top of the
slope and around the catch basin grates, 3) estimate of proposed rough grades on plans
date last revised 5/24/99 prior to further construction on the site and approved by the
Administrator, 4) amended plan showing stairs abutting the house, 5) revised deed
restriction. Voted: 5-1-0, N. Eaton against.
10:10 PM Public Hearing -135 Oak Street, RGB# 1999-18
The public announcement was read and attendees sworn in. William Bergeron, Hayes
Engineering was present for the applicant Donald Johnston. The abutting neighbor has a
wetland flagged area and from the closer point this property is 54'away. The proposed
dwelling is outside of the 100' buffer. Mr. Bergeron will add the property name to the
plan. He stated that some trees would remain but an established lawn would be made.
Tom Lynch, 126 West Street, stated that the area has been dry and that this hasn't been a
typical spring.
A motion was made and seconded to close the Public Hearing. Voted: 6-0-0. A motion
was made and seconded to approve an Order of Conditions for the project as shown on
the plan dated 5/21/99 with the condition that the applicant work with the Administrator
to show which trees can be saved. Voted: 6-0-0.
10:40 PM Public Hearing - 450 Haverhill tmet, DEP# 270-291, RGB# 1997-01
The public anouncernent was read and attendees sworn in. Mr. Larkin, the owner, was
present. A retaining wall will be installed to the east of the wetland up to the driveway,
dividing the wetland and the lawned area. The wall will be drywall. The driveway has
been reduced to 14'. Applicant advised that a draft conservation restriction will be coming
after the plan is approved.
David Schurman, 456 Haverhill Street, requested the Commission/applicant add to the
plan "Mr. Sherman has access through the property.

A motion was made and seconded to close the Public Hearing. Voted: 5-0-1,
B. Matathia abstained.
A motion was made and seconded to approve and issue the amended Order of Conditions
with the conditions that the haybale line be moved between Flags 14 & 15 and add
driveway notation for 456 Haverhill St. Voted: 5-0-1, B. Matathia abstained.
11:00 PM 123 Lilah Lane
The Administrator advised members that the applicant plans to use helical piers to hold the
foundation. They will be installed, hand dug 3' deep, and devices drilled down. The
Administrator recommended sediment barriers be placed in rear. Any fill taken out will be
refilled. Members gave sign off approval to the Administrator. A motion was made and
seconded to approve the installation of the helical piers to hold the construction. Voted:
6-0-0.
11:10 PM Marion Road Chair advised that DEP was on site for a site visit along with
X Eaton, the Administrator, W. Finch and other abutters. Comments were given and 20
days given to submit any additional comments.
11:15 PM 1100 Main Street The Administrator observed that Mr. Goddard has
removed the materials from the wetland area but has now observed that the area is filled
again. The Administrator is to advise the owner to permanently remove all material from
the resource area, give a five day period to be in compliance and then issue a $100 fine.
Voted: 5-0-1, B. Matathia abstained.
11:20 PM A motion was made and seconded to adjourn. Voted: 6-0-0.
