Minutes of Wednesday, June 15, 1999 Town Hall Selectmen's Meeting Room

7:05 PM The meeting was called to order.
7:10 PM Minutes A motion was made and seconded to approve the minutes of 5/19/99
as amended. Voted: 5-0-0.
The June 30, 1999, meeting has been canceled due to Special Town Meeting.
Mr. Hulse submitted his resignation letter effective 7/1/99,
A motion was made and seconded that the Conservation Commission recommend to town
meeting that the Conservation Commission supports the subject mater of Articles 3 & 5 at
the Special Town Meeting on June 30, 1999. Voted: 5-0-1, W. Finch abstained as a
direct abutter.
7:30 PM Public Hearing - End of Symonds Way Town or Reaz ding, DEP# 270 xxx,
RGB# 1999-21 N. Eaton submitted pursuant to, Section 23 (b)(3) a Public Disclosure
Statement of previous relationship to abutter of subject parcel. Ms. Eaton also has a
working relationship with the attorney for the Reading Rifle & Revolver Club. Mr.
George indicated to the Commission that he did not intend on speaking. The applicant,
Peter Hechenbleiker, Town Manager, indicated he wouldn't have any objections to Ms.
Eaton participating in the hearing. Town Engineer, Joe Delaney, explained the proposed
project for an active recreation area to include a baseball diamond and soccer field on the
property formerly referred to as the Nike site behind the Burbank Ice Arena. Along with
the preparation of the fields, a storage shed would be installed and irrigation.
The wetlands have been delineated both by Don Nadeau and Karen DeFrancesco and the
flags around the vernal pool verified. No wetland filling will be done and they have
changed the plan to a single line of sub-drainage. They are looking for a waiver for
encroachment into the ZNV and the 100' vernal pool buffer. Haybales and silt fence will
be placed at the limit of work line. No additional impervious areas will be created. The
town plans to use the same kinds of herbicide and pesticides as on all other fields. They
intend to do repairs to the existing fence. No public rest rooms and trash will be taken
- away the same as all other fields in town. All remaining portions of the property and to
North and East and the land to the West containing the vernal pools will be donated to

Conservation. Fields will be open until b pm on weekdays and 8 am to 7 pm on Saturday
and Sunday. Transferred lighting won't be provided now but may be later, which would
require underground wiring. Plans now are only for mitigation, fencing, irrigation and
loam and seed.
Chair would like to have the transfer of land take place when the Order of Conditions is
issued and not in conjunction with the Certificate of Compliance. L. Kenney was in favor
of the trade of vernal pool buffer encroachment for the land donation but felt Conservation
should receive the land prior to construction.
Bob Ward, President of the Reading Rifle & Revolver Club, stated his concerns about the
maintenance of the fence and keeping the buffer area between the Rifle Club and the
ballfield. Mr. Delaney stated that the limit of work would be 40' from the boundary and
the fence would be maintained by the town.
A motion was made and seconded to close the Public Hearing. Voted: 6-0-0. A motion
was made and seconded to approve and issue an Order of Conditions with the following
conditions: transfer of the land to conservation with the Certificate of Compliance or not
later than a year from issuance of the Order of Conditions; the applicant will come back to
the conservation for approval on lighting and fence maintenance. Voted: 6-0-0.
8:35 PM Public Meeting - 15 Pasture Road, RGB# 1999-20
The applicant Mr. Doyon was present. He proposes to install an 18 x 35 in-ground pool
with a 4' walk surrounding it. He doesn't plan on cutting any trees. A motion was made
and seconded to close the Public Meeting. Voted: 6-0-0. A motion was made and
seconded to issue a negative determination with the condition that any dirt material be
removed off site. Voted: 6-0-0.
8:45 PM Continued Public Meeting - 71 Red Gate Lane, R B# 1999-16
A site visit was conducted and present were N. Eaton, B. Matathia, and V. Falcione.
Members were also allowed to view from the Holmes' side of the hemlocks. Mrs. Leahy
felt the trees being on the west side of the brook didn't provide beneficial shade to the
brook. V. Falcione stated that cutting back dead branches by a professional arborist
wouldn't harm the tree. L. Kenney felt the trees do provide beneficial shade to the brook
but felt that a few branches wouldn't have an adverse affect.
Richard Holmes, 77 Red Gate, wanted to reiterate that they enjoy the benefits of the trees
with regard to the view and as a buffer for noise. Mrs. Holmes felt that Mrs. Leahy
wanted the trees pruned to keep leaves out of her pool.
A motion was made and seconded to close the Public Meeting. Voted: 6-0-0.

that trimming of branches be done by a Mass. Certified Arborist or ISA to professional
standards. Voted: 4-2-0, N. Eaton and B. Matathia against. H. Hulse made a motion to
reconsider the previous vote. B. Matathia seconded the motion. Voted: 4-2-0,1
Casciano and V. Falcione against. A motion was made and seconded to approve the
previous motion. Voted: 4-2-0, N. Eaton and B. Matathia against. The applicant was
requested to notify the Administrator when the arborist is to do the work.
9:10 PM Continued Public Meeting52 Summer Avenue. RGB# 1999-17
Mr. and Mrs. Plankey were present and explained their proposal to diminish water
problems of their house. At the end of each outlet pipe approximately 6" from the top of
the slope they will install a 2 s.f section of riprap consisting of 8" rocks. A motion was
made and seconded to close the Public Meeting. Voted: 6-0-0 A motion was made and
seconded to issue a negative determination with the conditions of erosion controls at the
base of the slope, no equipment beyond the top slope, stockpiling toward the street side,
and any excess material removed off site. Voted: 6-0-0.
9:25 PM Request fpr Certificate of Compliance - 93 Fairchild Drive, DEP# 270-170,
RGB# 1987-8 A motion was made and seconded to issue a Certificate of Compliance.
Voted: 6-0-0.
9:30 PM Request for Certificate of Compliance - 9 Carriage Lane DEP# 270-140,
RGB# 1986-84 A motion was made and seconded to re-sign an original Certificate of
Compliance previously issued 3/8/90. Voted: 6-0-0.
9:35 PM Continued Public Hearing - 218 & 224 Salem Street, DEP# 270-320, R TB#
999-19 The public announcement was read and attendees sworn in. Applicant submitted
new plans dated 6-4-99 showing the existing deck, driveways, retaining walls, and
proposed retaining wall. Will Holt, Professional Licensed Surveyor, explained the
proposed 417 cubic feet compensatory storage area for the 352 cubic feet of filled area.
They plan to have mounded areas to preserve the root system around the trees in the
compensatory storage area. The haybales will be placed at contour line 188 and
compensatory storage at 190. Mr. Holt stated that the applicant needs to lower the
storage area a foot to provide the required compensatory storage area. To the left of
house 218 will be a versa loc retaining wall to accomplish the change in grade. The area
between the compensatory storage area and the haybales will be left to revegetate.
L. Kenney stated that the haybales behind house 218 should have been moved back after
the dry wells were installed. Mr. Iappicca will do hand work around the trees in the
compensatory storage area and the trees in that area will try to be saved. The applicant
will submit an as-built. Mr. Iappicca asked if he could install a fence at house 218 along
the side of the versa loc wall and to the rear area at house 224 along the conservation
bounds. Members approved. The applicant was urged to submit the conservation
restriction materials.

A motion was made and seconded to close the Public Hearing. Voted: 6-0-0. A motion
was made and seconded to approve and issue an Order of Conditions with the conditions
as discussed. Voted: 6-0-0. A motion was made and seconded to lift the cease and
desist order and allow construction on the house at 218 and establish the haybale line at
the ZNV according to the original line. Voted: 6-0-0.

291, RGB# 1997-01 A motion was made and seconded to approve and issue the Order
of Conditions as amended. Voted: 5-0-1, B. Matathia abstaining.

amended. Voted: 6-0-0.

Order of Conditions as amended. Voted: 6-0-0.

deck at the rear. A motion was made and seconded to approve sign-off on the open deck.
