Voted: 5-0-1, R. Tanner abstaining. 7:15 PM Public Meeting - 11 Gateway Circle,, RGB# 1999-28 The owner; Mr. Fiore, was present along with the pool installer from Andrews Gunite Pools. The proposed pool will be 3' deep on one end up to 5 1/2' deep and located in the lawn. Mr. Fiore asked to amend his filing to request that two dead trees be removed and selectively trim two swamp maples. The tree work will be done by Boston Tree Preservation. The yard debris noted on the site visit has been cleaned up. A motion was made and seconded to close the Public Meeting. Voted: 6-0-0. A motion was made and seconded to issue a Negative Determination with the standard conditions. Voted: 6-0-0. 7:25 PM Partial Certificate of Compliance - 659 Haverhill Street DEP# 270-297,. R TB# 1998-03 The applicant is requesting to tear down the existing house to install the utilities for the new house and loam and seed. A motion was made and seconded to issue a Partial Certificate of Compliance with the condition that Mr. Edson post a $500 bond to guarantee loaming and seeding. Voted: 6-0-0. 7:35 PM Continued Public Meeting 11 Norman Road, RGB# 1998-26 A motion was made and seconded to continue the Continued Public Meeting to 8/11/99, at 7:30 PM, at the request of the applicant, in the Selectmen's room, with no further notice to abutters. Voted: 6-0-0. 7:36 PM Continued Public Meeting 64 Track Road, RGB# 1999-22 Joan Lawrence, the applicant, was present and explained the proposed 16' x 24' one-room addition to be erected on a cement slab and an attached deck. A motion was made and seconded to close the Public Meeting. Voted: 6-0-0. A motion was made and seconded to issue a Negative Determination with conditions being removal of any fill off site and stabilization. Voted: 6-0-0. Reading Conservation Commission Minutes to 7/28/99 Page 2 7:40 PM Issuance of the Order o Conditions - End of Symonds Way, DEP# 270- 324_, R TR# 1,992-21 A motion was made and seconded to issue the Order of Conditions as amended, Voted: 5-0-1, R. Tanner abstaining. 7:46 PM Issuance of the Order of Conditions - 218 and 224 Salem St., DEP# 270- 320, RGB# 1999-19 Chair reviewed site notes. The Administrator reported that Mr. iapicca has corrected the haybales and made secure the boundary markers. A motion was made and seconded to approve and issue the Order of Conditions as amended. Voted: 5- 0-1, R. Tanner abstaining. 8:05 PM Continued Public Meeting - 50 Collins Avenue, RGB# 1999-2-5 Because of a lack of quorum for the 7/14/99, meeting, the Public Meeting was continued to tonight. Mr. and Mrs. Alikonis were present for the meeting and explained their proposed 18'x 36' in-ground pool to be located in the lawn area. They would like to amend their filing to include the removal of five trees. The site notes of 7/12/99 were reviewed. Mr. Kenney asked if the homeowners could install a barrier to channel amphibian migration away from the pool. Members asked the homeowners to plant another tree such as a red maple at the wetland boundary. A motion was made and seconded to close the Continued Public Meeting. Voted: 6-0-0. A motion was made and seconded to issue a Negative Determination with conditions being placement of a red maple or similar species, of 1 1/2" to 2" in diameter, in replacement of the five trees and placement of a barrier on the perimeter and no stockpiling. Voted: 6-0-0. 8:30 PM Request for a Partial Compliance - 224 Salem Street, DEP# 270-305, RGB# 1998-18 The grading problem has been resolved. Seeding and completion of the conservation restriction still remain. A motion was made and seconded to issue a Partial Certificate of Compliance with the conditions as discussed. Voted: 5-0-1, R. Tanner abstained. 8:35 PM Continued Public Rearing - 379 Haverhill Street, DEP# 270-332,R_GR# 1999-24 Because of a lack of quorum for the 7/14/99, meeting, the Public Meeting was continued to tonight. The public announcement was read and attendees sworn in, Peter Zanni, Attorney Brad Latham, Leah Basbanes and Jack Rivers were present. The applicants are proposing a. three lot subdivision called Timothy's Place. The house currently located on the lot is a historical house located on an 8 acre parcel of land. The 275' road will be 24' wide with a sidewalk on one side. The cul-de-sac will have a landscaped area in the middle. The detention area will be 2' deep with a 4:1 side slope around. Only one lot and a portion of the road is covered under conservation jurisdiction. There is a vernal pool on an adjoining property which is 125' away from any proposed construction. There will be a change of .44 c. s.f. from pre-development to post development into the wetland. There will be catch basins with 2' - 4' sumps. Reading Conservation Commission Minutes of 7/28/99 Page 3 There is an existing row that cuts through the property. Chair asked that the drainage easement be moved out of the buffer. L. Kenney would like reassurance that the detention pond won't hold water longer than 4 hours. Members would like the road and curbing done before construction to cut down on erosion. Members also asked for more details about the landscaping and any tree removal. Any trees over 8" in diameter should be marked on the plan. Any changes that occur during construction would have to be approved by the Conservation Commission. A motion was made and seconded to continue the Continued Public Hearing to 8/25/99, at 8:30 PM, at the request of the applicant, held in the Selectmen's meeting room, with no further notice to abutters. Voted: 5-0-1, M. Gillis abstaining. 9:30 PM Continued Public Hearing - 268 Franklin Street,DEP# 270-321,_RGB# 1999-23 Because of a lack of quorum for the 7/14/99 meeting, the Public Meeting was continued to tonight. The public announcement was read and attendees sworn in. Elizabeth Wallis, Hayes Engineering, was present for the applicant. Three flag changes were made. Ms. Wallis is to advise Mr. Fantasia that he is in violation for doing work in the buffer without a permit. L. Kenney asked the applicant to show the vernal pool located at the top of the plan and the 100' buffer. A motion was made and seconded to close the Continued Public Hearing. Voted: 6-0-0. A motion was made and seconded to accept the line on the plan dated 6/3/99 and revised 7/14/99 with Flags 1-10A, 10A - 12, following flags up through 15A moving 16A to the pine approximately 6-8' north and following Flag 16A to 21. The applicant is to provide a plan showing wetland flag location changes. Voted: 6-0-0. 9:55 PM Continued Public Hearing - 108 Scotland Road - RGB# 1999-26 Because of a lack of quorum for the 7/14/99, meeting, the Public Meeting was continued to tonight. The public announcement was read and attendees sworn in. Dave Johnson, the applicant and Karen Malarkey, from LEC, were present. The applicant is seeking a waiver to fill 63 s.f of wetlands for a driveway to access the property. A replication area of 295 s.f is proposed and a planting plan submitted. At the top of the wetland area near the house, the applicant is asking for a waiver to do a wetland alteration. He will remove plants and restore after construction. Fill will also be needed for grading. A pervious patio is planned near the rear of the house. A drain pipe drains from his neighbor's property. Applicant plans to make a shallow pit to the west of the house. L. Kenney asked if members should allow filling of a wetland for a driveway. Applicant was asked to revise his plan to try and avoid having to do filling in the wetland. A motion was made and seconded to continue the Continued Public Hearing to 8/11/99, at 9:00 PM, held in the Selectmen's meeting room, with no further notice to abutters. Voted: 6-0-0. 10:35 PM Continued Public Hearing - 908 Main Street, DEN 270-xxx, RGB# 1999- 27 A motion was made and seconded to continue the Continued Public Hearing to 8/11/99, at 8:30 PM, at the request of the applicant, held in the Selectmen's meeting room, with no further notice to abutters. Voted: 6-0-0. A motion was made and seconded to close the Public Hearing. Voted: 6-0-0. A motion was made and seconded to approve an amended Order of Conditions with no extentions to the hearing date and decision date. Voted: 6-0-0. 10:45 PM Request for a Partial Compliance - 25 Cory Lane, DEP# 270-319,, RGB# 1999-15 A stamped surveyor's plan was received. A motion was made and seconded to issue a Partial Certificate of Compliance and remove the cease and desist. Voted: 6-0-0 10:50 PM Request for Reissue of Partial Compliance - 86 Haverhill Street, DEP# 270-260, RGB# 1994-14 A motion was made and seconded to reissue a Partial Certificate of Compliance. Voted: 6-0-0. 10:53 PM Request for an Extension Permit - Coolidge, DEP# 270-306, RGB# 1998- 177 A motion was made and seconded to extend the permit from 8/14/99 to 8/14/00. Voted: 6-0-0. 10:55 PM Request for an Extension Permit - 70 Haverhill Street, DEP# 270-260, RGB# 1994-14 A motion was made and seconded to extend the permit from 7/15/99 to 1/15/00. Voted: 6-0-0. 10:57 PM Plan Change - 406 Haverhill Street, DEP# 270-307, RGB# 1998-24 The house size has been reduced. A motion was made and seconded to determine the plan change to be insignificant. Voted: 5-0-1, B. Matathia abstaining. 10:58 PM Plan Change - Coa Lane, o 2, DEP# 270-287, RC-B# 1996-15 The applicant proposes eliminating the rear wall and sloping grading into the ZNV to bring the grade further out towards the back of his property. A motion was made and seconded to find the plan change to be a significant change. Voted: 6-0-0. 11:05 PM Reorganization A motion was made and seconded to re-appoint Nancy Eaton as Chair and Mark Gillis as Vice Chair. Voted: 6-0-0. A motion was made and seconded to appoint Harold "Lucky" Hulse and re-appoint Leo Kenney as consultants. Voted: 6-0-0. 11:13 PM Minor Project Sign offs 12 Margaret Rd., 75 Mill St., 27 Dana Road A motion was made and seconded to approve the Administrator to sign off on these minor projects.
