Selectmen's Meeting Room
Wednesday, August 8, 2001- 7:00 pm
Present: Nancy Eaton, Chair, William Finch, Thad Berry, Doug Greene and Patricia Lloyd,
Commissioners; and Leo Kenney, Consultant; Fran Fink, Administrator
Absent: Mark Gillis and Vincent Falcione, Commissioners, Harold Hulse, Consultant
Summer/Willow Street: Kevin Fulgoni has proposed a house with frontage on Willow Street. Has
been to Zoning Board of Appeals and they are not willing to grant variance because they feel he's
taking frontage from one place to another. He stated he needs a letter to ZBA stating there is no
chance he'll be able to cross wetlands. Discussed a letter stating old plan was approved; new
riverfront regulations will impact; previous plan shows proposed 16-foot driveway from Willow
Street. 6540 sq. feet of wetlands would need to be filled. Maximum allowable is 5,000 square feet
with double replication, thus that project with driveway access from Willow Street would not be an
approvable project. Applicant needs to file for a new wetlands delineation before we could
determine whether the prior project was permittable. Will Finch moved and Pat Lloyd seconded a
motion that the Commission send letter to ZBA as discussed. Vote: 5-0 in favor.
248 Main Street - Carter and Coleman project Mr. Richard Carter requested the Commission
authorize the administrator to sign off on Certificate of Occupancy (COO) for 2 additional units
leaving one or two. We have already signed off on three units. Planning to tear down former
office soon and then there will be additional paving done. Leo Kenney expressed concern about
signing off on COOs. Will suggested a report by end of month. Tom Ryan inquired when they
were intending to tear down. Mr. Carter said next week. Waiting for sign off on electric and gas.
Pat Lloyd moved and Doug Greene seconded a motion that the Commission authorize the
Administrator to sign off on COO for two units. Vote:. 5-0 in favor.
Pinevale conservation project update: Alexis Horn, who earned her Girl Scout Gold Award for
her work here, brought in map of area and photographs. She stated Leo Kenney had suggested
making a poster, which she showed the Commission. She will submit in framed condition next
week. Commission thanked Alexis for her work.
7:30 pm - Continued Public Hearing DEP 270-353, RGB #2001-11 Notice of Intent, 1375
Main Street, Multi-family housing, driveway, etc. Michael E. Hennessey. Hearing procedures
were read; commission introduced themselves; attendance sheet was circulated; and witnesses were
sworn. New plans were submitted, and an August 2 memo from Town engineer Joseph Delaney
was received, as well as one copy of the ZBA decision.
Fred Geisel, civil engineer for the applicant presented memo in response to last meeting's
comments. Joe Delaney saw some of the revised plans, but-had already drafted his memo. before .
they were received: His memo addresses his concerns. Fran commented she had read the Board of
Appeals decision, which was based on the plans of April 30 design. Had a lot of conditions

about getting additional details. Are requiring as-built plans and required condo association be
established for long-term maintenance. Need to look more at Joe's memo and make sure he's
satisfied. Public works department said culverts in roadway are state owned and state is
responsible for maintenance. He doesn't know who's responsible for pipe on 1369 Main Street.
The Larkins are concerned that wetland delineations might tie the hands of 1369 for future
development. Applicant requested confirmation that the wetland delineation is correct and would
leave the door open in future if pipe becomes unblocked. Fran feels she has more questions to be
addressed at next meeting and recommended continuing the hearing. Philomena Cogley, 1369
Main, stated there is another room on the back of the house, which is not shown on the plan and the
wetland delineation goes through it. Previous owners said pipe had broken and they had water in
basement after broken. The town fixed the problem and then that's when they started getting water
in the yard. For the August 22°d meeting they will submit a landscape plan. Will Finch moved and
Pat Lloyd seconded a motion to continue the Public Hearing at the request of the applicant to
August 22 at 7:30 p.m. Vote: 5-0 in favor.
8:25 pm - Continued Public Hearing DEP 270-357, RGB 2001-20 - Notice of Intent, 37
Latham Lane. The Hearing procedure was read; the Commission introduced themselves; an
attendance sheet was circulated; and witnesses were sworn. Laurie Powers and Anne McNeil
appeared for the applicant. Fran discussed her concerns and noted the filing fee was also an issue.
Lisa Hartunian, 7 Jefferson Circle, was concerned because three trees seem to be losing some
leaves. Consultants said there were a few leaves on the ground, but nothing dramatic. We need a
site plan with topography so we can confirm the site is restored to its original grade. Rita Resco, 31
Latham Lane, direct abutter, requested an update on what was done. Fred Resco, 31 Latham Lane,
raised the question on legislation for pressure testing tanks. Fire department has regulations
regarding underground storage tanks. Will Finch moved and Pat Lloyd seconded a motion to close
the public hearing. Vote: 5-0 in favor. Will Finch moved and Doug Greene seconded a motion to
approve order of conditions to be drafted and finalized and issued at the next meeting. Vote: 5-0
in favor.
8:45 pm - Continued Public Hearing, RGB 2001-19 Notice of Intent - 306 Main Street.
Hearing procedure was read; commission introduced themselves; attendance sheet was circulated;
and witnesses were sworn. Jim Giarrusso, Bohler Engineering, gave an overview of revisions of
plan.
Site visit notes were distributed. Fran said she would like the Town Engineer to review when he
returns. She needs more time to review the material and recommended further continuation to
digest it.
Hud Quistorff said 8-10 borings will be done and analyzed to test for hazardous materials. Some
will need to be done in buffer zone. They asked for guidance re: remediation where test wells and
borings should be done. Will Finch moved and Pat Lloyd seconded a motion that the Public
Hearing be continued until August 22 at 7:10 pm at the request of the applicant. Vote: 5-0 in
favor.
9:15 pm - Public Hearing RGB#2001-21, Notice-of-Intent,-69 Eastwav. construct an addition
ana associates grading in butter zone. Hearing procedures were read; commission introduced
themselves; attendance sheet was circulated; and witnesses were sworn. Site notes and Fran's memo

were distributed. Hayes Engineering presented on behalf of the applicant. Reviewed
administrator's memo. Discussed the need to mitigate effect of increased impervious surface.
Will Finch moved and Doug seconded a motion to continue the Public Hearing until August 22 at
7:45 pm at the request of the applicant. Vote: 5-0 in favor.
Nancy reported on meeting with landfill applicants this afternoon to discuss language and concepts
for Order of Conditions. Commission will start their review of these at the special meeting on
August 9.
Thad Berry left.
Executive Session: Pat Lloyd moved and Doug Greene seconded a motion to go into Executive
Session regarding school litigation to return to open session in approximately ten minutes.
Roll call vote: Pat Lloyd: Yes; Doug Greene: Yes; Nancy Eaton: Yes; and Will Finch: Yes.
4-0 in favor.

Commission will meet with the Board of Selectmen and the School Committee in Executive
Session on September 11, 7-8 pm to discuss litigation concerning the new elementary school.
Minor Projects: 322 Ash Street, rebuild deck. Pat Lloyd moved and Doug Greene seconded a
motion that the Commission approve the Administrator's Minor Project approval. Vote: 4-0 in
favor.
107 Forest Street, remove existing garage and play structure, erect prefab shed. Pat Lloyd moved
and Doug Greene seconded a motion that the Commission approve the Administrator's Minor
Project approval. Vote: 4-0 in favor.
Fran reviewed mail.
Adjournment. There being no further business, the Commission upon motion duly made and
seconded adjourned at 10:25 pm.
