Kenney 7 p.m. Old/New Business 450 Haverhill Street Conservation Restriction Acceptance. Pat Lloyd moved and Doug seconded approving conservation restriction. 4-0 in favor. Pat Lloyd moved to approve Municipal Certification. Doug Greene seconded. 4-0 in favor. Request for Extension Permit under RGB, DEP 270-340. RGB 2000-37, 2-10 Franklin Street, from Oct. 2, 2001 to Oct. 2, 2002. No fee received. Put on agenda for next time. Ratify Enforcement Orders: 201 Salem Street Pat Lloyd moved and Doug Greene seconded ratifying the enforcement order. 4-0 in favor. Commission discussed site visits. 9 Gregory Lane Pat Lloyd moved and Thad Berry seconded ratifying enforcement order. 4-0 in favor. 518 Summer Avenue Pat Lloyd moved and Thad Berry seconded ratifying enforcement order. 4-0 in favor. Ratify change in Documents list OOC, Lot 198 Harvest Road, DEP 270-329, RGB 1999-42. Pat Lloyd moved and Doug Greene seconded deleting reference to letter to zoning board of appeals because we do not have letter and other documents already reference it. 4-0 in favor. Revised site plans and water quality data, Timothy's Place, DEP 270-322, RGB 1999- 24. Pat Lloyd moved and Thad Berry seconded extending permit from Nov. 3, 2001, to Nov. 3, 2002. 4-0 in favor. Pat Lloyd moved and Thad Berry seconded accepting revised plan for Lot 2, Timothy's Place, as insignificant plan change. 4-0 in favor. Mintues - Conservation Commission, October 10, 2001 2 Part of order of conditions required pre- and post-construction water tests. No pre- construction data has been sent in. Post construction water tests were ok except for a trace of barium. Fran Fink suggested revisiting issue of condition for water tests in future. 7:30 Public Meeting, RGB 2001-26 Request for Determination of Applicability, Town Forest off Strout Avenue. Deep bedrock test wells, Town of Reading Public Works Department Peter Tassey, supervisor of Water Treatment Plant, presented. Dwight Dunk, CDM also presented. Entered proof of notification to abutters. John 54 Roma Lane asked about other identifiable roads on map. Fran Fink pointed out Sanborn Lane. Would have work done before spring so shouldn't affect vernal pools. Fran Fink went through her draft of the conditions for the Determination. Pat Lloyd moved and Doug Greene seconded issuing negative determination with conditions as amended. 4-0 in favor. 7:55 Public Hearing, RGB 2001-25 Abbreviated Notice of Resource Area Delineation, 321 Haverhill Street, David and Roberta Maillett Robert W. Smith, engineer and land surveyor, presented. Gave copy of site visit notes. Commission moved flag 7. Mr. Smith will change plan to include moved wetland flag. Fran Fink: noticed other wetland line on other side of street. Commission is not confirming that boundary. Pat Lloyd moved and Thad Berry seconded continuing until Nov. 7 at 7:30 p.m. 4-0 in favor 8:10 p.m. Public Hearing, RGB 2001-27, Notice of Intent, 52 Charles Street, addition to existing house and related grading and landscaping, Kevin A Donofrio Procedure read; attendance circulated; witnesses sworn; commission introduced. Kevin Donofrio presented. Thad moved and Pat second closing public hearing. 4-0 in favor. Pat moved and Thad seconded approving and issuing draft order of conditions. 4-0 in favor. 8:30 p.m. Continued Public Hearing, DEP 270-356, RGB #2001-19 Notice of Intent, 306 Main Street. Raze existing service station and paving, construct new service station, convenience store parking, canopy, grad innd_r_etaining «alls,in lufferone _and Riverfront Area, Getty Petroleum Corporation. Mintues - Conservation Conunission, October 10, 2001 Phil Lombardo, Atty., 339 Main Street, Worcester, and Jim Giarrusso, Bohler Engineering presented project. There is some contamination that will require DEP plan for remediation. Joe Delaney's memo was addressed at group meeting. Fran Fink discussed her memo. Pat Lloyd moved to close hearing. Doug Greene seconded. 4-0 in favor. Pat Lloyd moved and Doug Greene seconded granting waiver of 25-foot setback and 35- foot no build zone. 4-0 in favor. Pat Lloyd moved and Thad Berry seconded approving and issuing draft order of conditions. 4-0 in favor. 8:45 Continued Public Hearing - DEP #270-353, RGB 2001-11, Notice of Intent, 1375 Main Street, Multi-family housing, driveway, drainage, parking, grading, landscaping, and utilities: Michael E. Hennessey. Procedures read; attendance circulated; commission introduced. Frederick Geisel, Civil Environmental Consultants of Peabody, presented project. Has received final approval from Zoning Board of Appeals. Will be applying for curb cut permit. Doesn't anticipate problems with those issues. Fran Fink had some verbal comments. Joe Delaney had no concerns. Fran Fink felt we were ready to close. Pat Lloyd moved and Doug Greene seconded closing hearing. 4-0 in favor. Pat Lloyd moved and. Thad Berry seconded approving the project and issuing order of condition to be approved at next meeting. 4-0 in favor. Revised site plans, Lots 1 and 3 Melendy Drive, DEP 270-312, RGB 1999-6 Pat Lloyd moved and Thad Berry seconded approving revised site plans as insignificant change in Lot 1 of Melendy Drive. 4-0 in favor. Commission requires additional response on Lot 3. Report site visits - Tomorrow at Camp Curtis Guild for snow dumping. As-built site plans, 10 Cory Lane (Lot 12) Fran Fink will send letter saying we got as-built and are trying to contact engineer and ,.clarify status of site. Minor Projects: 42 Lawrence Road (shed), 187 Sanborn Lane (tree) Mintues - Conservation Commission, October 10, 2001 4 Pat Lloyd moved and Doug Greene seconded approving minor project at 42 Lawrence Road. 4-0 in favor. Pat Lloyd moved and Thad Berry seconded approving minor project at 187 Sanborn Lane. 4-0 in favor. 11 Nelson Avenue. Demolished house and put up new one. Nothing beyond edge of hay bales. Pat Lloyd moved and Thad Berry seconded issuing certificate of occupancy at 11 Nelson. 4-0 in favor. Sunset Rock Lot 5 asks about what's going on at Lot 4. Approved plan calls for retaining wall at edge of driveway and grading. Fran Fink did site visit and said owners need to file revised site plan and have it approved. We will not issue certificate of occupancy for Lot 4 at this time. Fran Fink notified Commission that on Friday at 1 p.m. there is a meeting re: testimony in school appeal. Nov. 6, 2001 - meeting about conflict of interest, ethics. etc. Commission decided to change its meeting to Nov. 28 instead of 21. 9:40 Meeting adjourned.
