Present: Chairman Will Finch; Commissioners Doug Greene, Thad Berry, Larry Goulet;
Consultant Harold Hulse; Administrator Fran Fink; Selectmen Rick Schubert.
Absent: Pat Lloyd Vice Chainnan; Vincent Falcione, Commissioner; Leo Kenney,
consultant.
7:00 Opened meeting -The Commission welcomed new member, Mr. Larry Goulet.
379 Haverhill Street (Timothy's Place Subdivision), Order of Conditions, DEP #270-
322, RGB #1999-24: Nick Duranian, prospective owner, and his attorney, Josh Latham,
present. Continued discussion of a donation of approximately 5 acres of Lot 3, Timothy's
Place to the Town for conservation purposes and abandonment of the Town's right-of-way
on the site. Commission made site visit October 21.
Mr. Latham submitted site plan dated October 22 showing proposed lot line. Mr. Finch
asked about removing old vehicles and debris out of the vernal pool. Mr. Latham said might
need bobcat and might cost $5,000-$10,000. If vehicles were cut into pieces on site, cost to
remove might be less. He can get additional estimates. A bobcat could gain access from
Symonds Way. There may be volunteers who would help carry out the debris.
Thad Berry moved and Doug Greene seconded that the Commission support Article '5 of the
November 13 Special Town Meeting Warrant. VOTE: 4-0 in favor.
The Commission also discussed the water quality testing requirement in the Amended OOC
for Timothy's Place. A letter will be sent to Peter Zanni about amending this condition, and
also requesting a detailed plan of the underground detention structure on Lot 3..
7:30 Public Hearing, RGB 2001-28, Notice of Intent, 25 Sunset Rock Lane: Mr.
Finch opened the hearing and read the procedures. Commissioners introduced themselves.
Attendance sheet was circulated.
Colin Johannen, engineer for Rosario Cartolano, applicant, presented the site plan for
drainage improvements, an in-ground swimming pool, grading, shed, and landscaping.
Mrs. Fink stated that she had contacted the engineer for additional information including
drainage calculations, soils data, proposed inverts and elevations, and utility locations. New
site plans and calculations submitted 10/23 were distributed to Commissioners during the
meeting. Neither Mrs. Fink nor the. Town, Engineer had reviewed the. new, materialst__

The Commissioners raised questions about: the adequacy of the depth of cover over the
proposed drain outlet pipe; whether the drainage had to flow across Lot 9; how the drainage
basin would be protected from sediments during construction; what the cause of the
drainage problem was; how proposed work would affect runoff rates from the site; whether
the proposed pool would divert flow around the south side of the house; whether the
proposed pavers around the pool would allow adequate infiltration into the proposed trench;
where proposed fence would go; and what the foundation for the shed would be.
The owners of Lot 9, Mr. and Mrs. Rodrigues, expressed concerns about whether
concentrating all of the runoff in one spot would cause erosion or flooding and would affect
their utility lines. Discussed alternative designs including sheet flow over driveway and use
of leaching catch basin. Discussed inspection and cleanout ports for roof infiltrators,
dewatering basins, pool filter and water sources to fill pool. Engineer agreed to submit
additional information.
Mr. Berry moved and Mr. Greene seconded that Commission continue hearing to November
28, 2001, at 7:30 PM. VOTE: 4-0 in favor.
Lot 3, Melendy Drive, DEP # 270-312, RGB # 1999-6:
Owner and contractor present. Commission reviewed letter from engineer concerning
proposed grading of driveway on revised site plan dated 9/25/2001.
Mr. Berry moved and Mr. Greene seconded to reverse the previous vote of October 10,
2001, and accept the revised site plan as an insignificant plan change. VOTE: 4-0 in
favor.
Commission asked contractor to install erosion control barrier between work area and
detention basin to keep sediments out of basin, and also to protect catch basins in street.
Contractor will call Administrator to check barriers before work begins.
Draft Orders of Conditions:
DEP #270-356, RGB #2001-19, 306 Main Street, Getty Petroleum Corporation:
The Commission reviewed and amended the draft OOC. Mr. Berry moved and Mr.
Greene seconded to issue the OOC as amended. VOTE: 4-0 in favor.
DEP #270-353, RGB #2001-11, 1375 Main Street, Michael E. Hennessey: The
Commission reviewed and amended the draft OOC. Mr. Greene moved and Mr.
Berry seconded to issue the OOC as amended. VOTE: 4-0 in favor. The
Commission also discussed coordinating the taking of a bond with other Town
boards and officials to prevent bonding for the same work twice. A memo will be
sent to the Town Engineer and ZBA.
DEP # 270-361, RGB # 2001-27, 52 Charles Street, Kevin A Donofrio:. The
Commission reviewed and amended the draft OOC. Mr. Berry moved and Mr.
Greene seconded to issue the OOC as amended. VOTE: 4-0 in favor.
Enforcement Order, 454 Grove Street: Mr. Finch had made a site visit the previous
week and did not see erosion controls or seeding as required by the recent Order. Mrs.

Fink reported that New England Forestry had contacted the office and stated that they
would be filing a planting plan for the owners by November 9, 2001. Mrs. Fink will
make a site visit and ask the owners to complete the erosion controls before the next
meeting (November 7). She will also contact the forester about the planting plan.
Enforcement Order, 64 Pasture Road:
Mrs. Fink reported that the pavement has been removed. She will inspect the site with
the owner and discuss whether any further work is needed to smooth the driveway.
Minor Projects:
14 Intervale - Mr. Greene moved and Mr. Berry seconded to accept the Minor
Project for swing set and trees as issued. VOTE: 4-0 in favor.
68 Sanborn - Mr. Greene moved and Mr. Berry seconded to accept the Minor Project
for tree removal as drafted. VOTE: 4-0 in favor.
201 Salem Street, Enforcement Order - Commission approved draft letter to owner
dated October 25, 2001.
Subsequent Town Meeting Warrant Articles
Mr. Berry moved and Mr. Greene seconded to support Article 9 (Community
Preservation Act). VOTE: 470 in favor.
Mr. Berry moved and Mr. Goulet seconded to support Article 23 (RGB Section 5.7
amendments and revolving fund) and to support the recommendations of the Bylaw
Committee that the bylaw and fund matters be voted separately and that certain
punctuation in the bylaw article be amended. VOTE: 4-0 in favor.
518 Summer Avenue, Enforcement Order and Order of Conditions, DEP 270-349,
RGB 2001-6 - The Commission asked the Administrator to make a site visit and to
contact the owner concerning documents needed to support the easement change at Town
Meeting.
9 Gregory, Enforcement Order
The Commission reviewed a letter from the owner dated October 15 in response to the
Enforcement Order issued October 2. Based on the information in the letter, the
discussed amending the deadlines for certain actions under the Order.
Mr. Berry moved and Mr. Greene seconded that the following changes be made:
deadline to construct retaining wall to be November 28, 2001; deadline to grade, loam,
and seed remainder of yard to be June 1, 2002; deadline to submit as-built site plan to be
June 15, 2002; deadline to execute Conservation Restriction remains as February 1,
2002. VOTE: 4-0 in favor.
The Commission asked the Administrator to make a site inspection and make sure that
erosion controls are in place for the winter.

695 Pearl Street - The owner's attorney has asked for agenda time on November 7,
2001. The Administrator will review the present files on this property.
Eric's Greenhouse, Main Street - An abutter called and reported extensive excavation
underway on site. No Building Permits or wetlands permits have been sought recently.
The Administrator will work with the Building Inspector to determine what is occurring
and will contact DEP for status of last project.

Mr. Berry moved and Mr. Greene seconded to approve the Minutes of August 8 and
September 12, 15, and 26 as drafted. VOTE: 4-0 in favor.
Request for Extension Permit under RGB, DEP #270-340, RGB #2000-37, 2-10
Franklin Street - The Commission took no action because the applicant has not
submitted the filing fee for the Extension.
