Minutes of September 14, 1987 DRAFT
Meeting convened at 7:30 p.m. in Room 16, Town Hall, Reading, MA
PRESENT: H. Hulse, Chairman; C. Anthony; M.C.Proctor; W. Childress;
W. Cochrane, Vice Chmn; and J. Nickerson, R. Longley,
Associate Members; Beth MacKillop, Administrator.
UPDATE ON VARIOUS TOPICS
1. a There were 3 candidates for new Members of Commission. A vote
was taken and there was a tie between J. Nickerson and R. Longley.
Mr. Hulse will go with them to Selectmen's meeting and they will
make the decision between both highly qualified Associates.
2. Request for Certificate of Compliance - Colonial Drive Ext. -
Steve Gillis
Material has errors so will modify plans and be on next agenda.
3. Cease & Desist - Eleanor L. Fedele - 2 Beaver Rd - dirt bike trails
through bordering vegetated wetlands.
M r. Edward Fedele came to meeting as his wife was ill. If Board
thinks he has done anything wrong, wants letter from Board. He
believes Town has double standards and has filled in wetlands.
Wants rules and regulations spelled out so he will be sent Article
32 and Chap. 40-131 regulations. A Notice of Intent is needed
for restoration of wetlands. If filing is not received in timely
manner, action should be taken. Material should be received 5
days prior to Oct. 13 meeting. He wants letter from Board to
give to his attorney, spelling out what he can and cannot do.
After much discussion, a motion was made and seconded that material be
received before next meeting so it can be published, otherwise further
action and remedies will be considered to gain restoration.

8:05 p.m. Meeting recessed until Chairman and candidates return from
Selectmen's meeting.
8:25 p.m. Meeting reconvened.
The appointment was given to Joan Nickerson as full Member. Rebecca
will remain Associate Member and Judith Maxted will attend meetings
with the idea of becominfan Associate Member.
Continued Public Hearing --Acorn Lane - Paul F. Cassidy
After discussion, a motion was made and seconded to continue Public
Hearing until Sept. 28, at 8 p.m. VOTED 5-0-0 -
UPDATE Continued
1. b McNamara - Main St. Beth never received forms and Mr. McNamara
doesn't believe his property is in wetlands. Beth brought up
he "load received an abatement because of wetlands, and
suggested Commission make a request for filing to determine
if it is wetlands.

Motion made and seconded that letter be sent to Mr. McNamara to
inform him that Commission will make request for filing if he does
not file. VOTED 4-0-0
1. c Margossian - Pasture Road. He has been consulting with engineer
about his property and has been trying to get a botanist so is
not in any position to give any timing about filing. Mr. Latham
is also trying to meet with experts for additional information.
Mr. Margossian wants to build a home for his family. Beth in-
formed Commission that Cease & Desist was sent out. Three test
pits were dug and vegetation was cut on this lot.
8:35 p.m. Public Hearing - Notice of Intent - Bud Strout
Meeting opened, recorded and motion made and seconded to close
Hearing. VOTED 3-0-1
Order of Conditions will be issued within 21 days.
8:40 p.m. Mr. Cochrane arrived.
8:45 p.m. Public Meeting - Request for Determination of Applicability
Rita Amalfitano - 38 Terrace Park
Meeting opened, recorded and motion made and seconded to close
Meeting. VOTED 5-0-0
Later in evening a motion made and seconded that negative
determination with conditions as outlined be issued.

9 P.M. Public Meeting - Request for Determination of Applicability
Michael Cogan - 1361 Main St.
Meeting opened, recorded and motion made and seconded to close
Meeting. VOTED 5-0-0
Later in evening a motion made and seconded that negative
determination be made with conditions outlined by Administrator.

OTHER
After discussion, motion made and seconded to issue Certificate
of Compliance. VOTED 5-0-0
BILLS Bills were approved and signed
CORRESPONDENCE
Beth received letter from Mr. Lopes, 90 Sunnyside Avenue. He
wants to remove only what he has added. After removal he will have it
surveyed to determine if he has re-established flow of water. As-built

plans appear to be wrong and Beth thinks it should be scrutinized
very carefully. So far he has been unable to get a contractor.
Mr. Hulse walked the whole area and checked fill in area behind stairs
and found only 1" of loam.
After discussion, motion made and seconded to allow removal of fill
necessary to establish swale, seeding and surveying of property.

9:20 p.m. Public Meeting - Request for Determination of Applicability -
Thomas Seraceno - T.A.C. Group
Meeting opened, recorded and motion made and seconded to close
Meeting. VOTED 5-0-0
A Determination with conditions will be issued.
9:35 p.m. Public Meeting - Request for Determination of Applicability -
Laura S. Parsons, 3 C Street
Meeting opened, recorded and motion made and seconded to close
Meeting. VOTED 5-0-0
Later in evening a motion was made and seconded that negative
Determination be issued with conditions outlined by Administrator.

9.50 p.m. Request for Certificate of Compliance - Albert Symes -
Ash Street - Lots 4,5,6,7,8
Beth received letter from Latham & Latham, claiming Mr. Symes had
completed dwellings, except for revegetation and asked for a partial
release.
Letter dated 8/31 also received from Latham & Latham with 2 suggested
alternatives: 1) Hold bond until revegetation is done or 2) issue a
partial Certificate of Compliance and retain part of bond.
After much discussion, a motion was made and seconded that an extension
under Art. 32 for one year be granted.
VOTED 5-0-0
After further discussion, a motion was made and seconded that a partial
Certificate of Compliance on Lots 4 and 5 be issued and deny a
Certificate of Compliance on Lots 6, 7 and 8. VOTED 2-3-0
10:25 p.m. Draft Order of Conditions - Greenhouse Acres
Beth explained Draft Art. 32 Order of Conditions Items 14 and 15 were
discussed in detail. There are some buildings closer than 20 feet to

After much discussion, it was decided to go on and discuss the Ash St.
project. Will come back to finish Greenhouse Acres later.

11:30 p.m. Greenhouse Acres. In all areas, 20 foot buffer will be
required except around buildings 12 and 26.
Motion made and seconded Draft Order of Conditions as amended under
Art. 32, be approved. VOTED 5-0-0
Motion made and seconded Draft Order of Conditions for Greenhouse
Acres, under Art. 131-40, be approved.

11:35 p.m. Draft Order of Conditions for Avalon Estates.
After much discussion and explanations by Beth, a motion was made and
seconded that Draft Order of Conditions as amended under Art. 32,
be issued. VOTED 5-0-0
Motion made and seconded that Draft Order of Conditions for Avalon
Estates, as amended under Art. 131-40, be adopted. VOTED 5-0-0
11:50 p.m. CORRESPONDENCE
Mr. Rivers attended meeting and spoke about wetlands at Sanborn Lane.
Beth read a letter from Rivers Development Cora. about, fevegetation, etc.
Mr. Rivers showed on map changes that they could make for water retention.
He is asking Commission for permission to save trees on property.
Beth wants more detailed plans showing how he arrived at his calcu-
lations. Calculations must be verifiable by Town Engineer and an
acceptable plan submitted with them. No approval was given at this
time.
MINUTES. Motion made and seconded that Minutes of 8/24/87 be accepted
as written. VOTED 4-0-1

12:35 Q.m. The Town Manager requested
regarding Mr. Biggio be answered. Beth
Commission's approval.
