Cochrane, Vice Chairman; J. Nickerson; C. Anthony; S. Hoyt; F. Robie, Assoc. Member and B. MacKillop, Administrator 7 p.m. Public Meeting - Request for Determination of Applicability - Reading Municipal Light Department - to install two (2) street light poles on Waverly Road. Meeting opened, recorded and closed. Later in evening a motion was made and seconded to issue a negative Determination under Chap. 131,540. VOTED 4-0-0 A motion was made and seconded to issue a negative Determination with conditions under Art. 32. VOTED 4-0-0 MINUTES Minutes of March 23, 1988 were accepted as amended. Under CORRESPONDENCE at 8:45 p.m. "Lot B, 2 Sanborn Lane" was added. Also, at 9:05 p.m. regarding letter Beth wrote to Selectmen, the words "re Callan Office Park in Woburn, Reading and Wilmington" were added. VOTED 4-0-0 The Minutes of April 2, 1988 were approved. VOTED 3-0-1 7:15 p.m. Public Meeting - Request for Determination of Applicability - Marlinda Langone (Reading Youth Baseball,Inc.) to install one (1) flag pole at Hunt Memorial Field. Meeting was opened, recorded and closed. Later in evening a motion was made and seconded that Commission issue a negative Determination under Chap. 131, S.40. VOTED 4-0-0 BILLS 7:20 p.m. Bills were approved and signed. CORRESPONDENCE 7:25 p.m. Correspondence was read and discussed. Beth read a letter from Mr. & Mrs. Natale, 25 Grey Coach Road, re- questing permission to remove 3 trees on their property. A motion was made and seconded to accept the Natale's plan to remove 3 trees on their property. VOTED 4-0-0 A motion was made and seconded to amend the above vote by adding "replace 3 trees after removal." Not approved. VOTED 1-3-0 7:30 p.m. Public Hearing - Notice of Intent - Peter M. Small and William N. Whelan, Trustees, Riverpart 93 Realty Trust - to construct a sewer line in front of the Meadow Brook Golf Club to the Wilmington Town Line including a new sewer ejector station at the corner of Strout Avenue and Grove St., improvements to the existing ejector station at Meadow Brook and resurfacing of Grove St., in Reading. Each member of Commission was polled to see if they had enough information. This Public Hearing was opened, recorded and after much discussion, a motion was made and seconded to close Hearing. VOTED 3-1-0 8:35 p.m. Continued Public Hearing - Paul F. Cassidy - Notice of Intent- to construct a roadway; install catch basins, drains and utilities; perform associated grading, replace a drainage ditch with a 12" R.C. drain; implement mitigative measures; and install other appurtenances off Oak St. at Acorn Lane. At applicant's request, Hearing will be continued to 4/27/88 at 8 p.m. CORRESPONDENCE (continued) Beth received a letter from Town Manager re 87 Avalon Road to answer Russell and Norma LeBlanc's letter to Town regarding the detention area behind their home and the Oak St. development utilizing it for storage. Beth will work with Town Engineer regarding this matter and will let commission know what happens. 8:45 p.m. Public Meeting - Request for Determination of Applicability - Laurence D. Healy - to construct a 5x13 foot addition to an existing dwelling at 26 Mill Street. Meeting was opened, recorded and closed. Later in evening motion was made and seconded to issue a negative Determination under C.131,S40. VOTED 4-0-0 A motion was made and seconded to issue a negative Determination with conditions under Art. 32. VOTED 4-0-0 9:00 p.m. Clarence Enos, Enos Circle, appeared before Commission. A motion was made and seconded to accept bond submitted by Mr. Enos. VOTED 4-0-0 A revegetation plan was submitted for approval and also a narrative was submitted mentioning a liner of 6 mil thickness. After discussion, a motion was made and seconded that revegetation plan for Enos Circle be accepted with the exception that liner be 40 mil. VOTED 4-0-0 CORRESPONDENCE (continued) Beth told Commission that Mr. Covino of Louanis Drive had brought in bond of $3500 and recommended Commission accept bond. A motion was made and seconded to accept Mr. Covino's bond. VOTED 4-0-0 Beth read memo from Town Manager re collecting money from Reading Rifle and Revolver Club for use of conservation land. Assessor's office will prepare bill and give it to Commission to send annually. OLD/NEW BUSINESS Mr. Kevin Fulgoni was to appear before Commission tonight but due to lateness of hour (he had 8:30 meeting somewhere else) Mr. Latham spoke for him. Mr. Latham said Mr. Fulgoni has pulled out material that was placed in wetlands and filter fence is in place, and requested that amount of $7,800 bond be reduced, and that Commission not issue a Cease & Desist Order for noncompliance with the Order. The Commission was polled as to their feelings about posting such a large bond. The majority present felt all conditions should be met and Cease & Desist Order should be issued. Nobody wants to punish Mr. Fulgoni, but he did not follow conditions of Order of Conditions. Beth spoke about Selectmen's meeting on April 15 re Article 21, and the l A motion was made and seconded that Beth be allowed to take comp time between the dates of 5/15 and 5/20. In the event of an emergency or the administration of various Conservation matters, Bill Redford will have the responsibility to contact the Chairman, Vice Chairman or other members of the Commission before making a decision.
