Hulse; M.C. Proctor; C. Anthony; J. Lachmayr; J. Biller, Assoc. Member; D. Nadeau, Administrator ABSENT: R. Longley, E. Loschi 7:11 PM Meeting called to order 7:13 PM Motion made and seconded to accept the Minutes of 6/27/90 as corrected. VOTED 4-0-1 7:15 PM Preliminary discussion of the proposed plan change for Ashley Woods and whether there must be a re-filing under Article 32. Don pointed out that this change addresses the problems cited in the order of conditions. 7:35 PM A presentation was made by Steven Hamel (troop 704) in regards to his proposed Eagle Scout project in Kurchian Woods. He proposes cleaning up the area and building a 10, pressure treated bridge set on concrete piers which would have ramps for handicapped access. He also proposes clearing other trails in the area. A suggestion was made that guidelines or conditions be set to control the work. Some concern was expressed about the location of the 3' concrete piers to support the bridge. J. Lachmayr will contact the DEP about whether any paperwork is necessary for water quality certification. 7:56 PM Motion made by C. Anthony that the Eagle Scout project in Kurchian Woods as presented by Steve Hamel be approved with conditions to be set by the administrator. Seconded. VOTED 5-0-0 8:00 PM Public hearing to be opened on the plan change on Ashley Woods under Chapter 131§40 only, not on article 32. A protest is made by the representative of Ashley Woods that the public hearing is not under article 32. The claim is made that the earlier denial is in fact an Order of Conditions and can be re-considered. The local bylaw refers to the state regulations which allow ammendments to an Order of Conditions. Since it was published as a public hearing, Don thinks that this is appropriate under state and local regulations. It should be a hearing to the__change s,_signif,i.cant or insignificant. Don says it can be a significant change and still be handled at this public hearing. A more significant change may require a new Notice of FINAL AMENDED MINUTES 7/11/90 Page 2 Intent. 8:18 PM Public hearing opened under both the state Wetlands Protection Act Chapter 131§40 and the local RWB 5§7 (Article 32) on DEP file #270-219, RWB ,#1990-16 concerning the Ashley Woods subdivision. Peter Ogren of Hayes Engineering presented the changes proposed to meet the Order of Conditions of 6/19/90 and indicated that this is an effort to avoid taking the matter to superior court which is not in the best interest of either the applicant or the town. The proposal is to raise portions of the drainage system by 1' to avoid lowering the detention area. A different type of pipe would be used since there would be 3' rather than 4' of cover. There would now be no impact on the wetland areas and the floor of the basin will be 2' higher than previously proposed. A weep hole in the retaining wall will supply water to existing wetlands. Don gave his evaluation and that of the town engineer. He pointed out that there will be no revegetation now since the wetlands will not be disturbed. There are concerns over the plugging of the weep hole. The town engineer and Don agree that sufficient water will be supplied to the wetlands area. Don suggested several items of concern which can be specified in an amended Order of Conditions. 9:A PM C. Anthony moved to close the public hearing. Seconded. VOTED 5-0-0 9:33 PM H. Hulse moved that the proposed change to DEP #270-219, RWB #1990-16 for the Ashley Woods subdivision be considered a significant change and that it is to be addressed via an ammendment to the existing Order of Conditions. Seconded. VOTED 5-0-0 Don will draft the amended Order of Conditions for the 7/25/90 meeting of the Commission. 9:45 PM Continuation of public hearing on the proposal for 562 Pearl St. by Wood Assoc. DEP #270-xxx, RWB #1990-19. Don Nadeau described the problem with the DEP file number. They need proof that Appendix A was sent to the National Heritage Program. Brian Wood will send proof. Don Nadeau indicated that there had been no response from the NHP. A discussion of the revised calcualtions for the drywell dated 7/11/90 (using 711) indicated that the storage volume is approx. 60 gal. short. The applicant indicated that they will add more crushed stone. Don suggested that the watercourse be moved out of the wetlands. A letter from Leo Kenney concerning the vernal pools was discussed. A discussion of whether the recharge well will lower the water table resulted in the opinion that the clay FINAL AMENDED MINUTES 7/11/90 Page 3 below the sand will preclude any problem. 10:23 PM Bill Robertson's comments were discussed. He feels that they need a verifiable benchmark for the elevations. Brian Wood will see to this. Mr. Wood submitted a copy of a certified plot plan to address the concerns about lot boundaries. The commission needs new drywell calculations, and the new watercourse shown on the plans. Mr. Wood agrees. 10:25 PM H. Hulse left the meeting. 10:50 PM C. Anthony moved that the continued public hearing for 562 Pearl St., DEP 1270-xxx, RWB #1990-19 be continued until 7:30 PM on 7/25/90 with the permission of the applicant. Seconded. VOTED 4-0-0 10:55 PM Discussion of reorganization of the Conservation Commission. 10:56 PM It was moved by C. Proctor that C. Anthony be elected Chairman of the Commission for the period of one year. Seconded by J. Lachmayr. VOTED 4-0-0 10:57 PM A motion was made and seconded that R. Longley be elected Vice Chairman for the period of one year. VOTED 4-0-0 10:58 PM Discussion of a request for a Certificate of Compliance for Lisa Gorlick, Lot 12, #14 Verde Circle, DEP #270-132, RWB #1985-3. No as-built plans were submitted. Certificate cannot be awarded. 10:59 PM Discussion of a request for a Certificate of Compliance for Angelo Petrosino, Rocky Road Subdivision, DEP #270-168, RWB #1987-10. 11:00 PM Moved by C. Anthony that a Certificate of Compliance be issued for Angelo Petrosino, Rocky Road Subdivision, DEP #270-168, RWB #1987-10. Seconded. VOTED 4-0-0 11:02 PM Discussion of a request for a Certificate of Compliance for James Biller, 523 Franklin St., DEP #270-199, RWB 11989-9. 11:06 PM Moved by C. Anthony that a Certificate of Compliance be issued for James Biller, 523 Franklin St., DEP #270-199, RWB #1989-9. Seconded. VOTED 4-0-0 11:06 PM Discussion of a request for a Certificate of Compliance for Kevin FINAL AMENDED MINUTES 7/11/90 Page 4 Fulgoni, 16 Margaret Road, DEP #270-176, RWB #1987-17. The work has not been completed and the Commission has been waiting for Ted Cohen, town counsel, to provide information on pulling the bond. The concensus is to proceed with pulling the bond and that no Certificate of Compliance can be issued. 11:10 PM Discussion of claiming the bond against the Greenhouse Acres development, DEP #270-162, RVB #1987-3. A $19,000 bond is help by Travelers Indemnity of Hartford, Conn (1987-3, 9/17/87). Don has sent a memo to town counsel about the matter. 11:15 PM Discussion of a memo from town manager to Tony Fletcher and Don Nadeau about the situation at 19 Pasture Rd. The matter was referred to town counsel. The situation on Pasture Rd. was litigated and settled between the town and the developer without input from or feedback to the Commission. 11:18 PM C.
