ABSENT: R. Longley, J. Nickerson
7:05 PM Meeting called to order. Mr. Jim Keigley, a prospective associate
member was present to observe.
Don reported that the order of Conditions for Ashley Woods is
written, but not available for review by the commission. A meeting
was scheduled for 8/1/90 at 7:00 PM to issue the Order of Conditions.
Discussion of the need for a full list of meeting dates for the year.
Discussion of the need to publish the modified local bylaw and
regulations prior to the fall town meeting. A meeting was scheduled
for 9/5/90 to discuss the changes including the elimination of
specific references to the 1978 state regulations. The local bylaw
should be made complete to stand by itself, and should include the
100' buffer zone regulations. Input from and coordination with other
local boards is needed.
7:15 PM Don presented a brief overview of the agenda, including several new
items not on the printed agenda.
7:34 PM A potential problem on N. Main St. was discussed by Brian Wood of
Wood Assoc. where two trees have died suddenly near a gas station.
He raised the question of a toxic spill in the area.
7:35 PM The Continued Public Hearing (NOI) on the Vaughn property at 562
Pearl St. (DEP#270-xxx, RWB#1990-19) by Wood Assoc. is reopened under
State Chapter 131§40 and RWB Article 5§7.
Brian Wood indicated that he has not yet been able to get DEP to
issue a file number. He has sent proof for the third time of his
notification of the National Heritage Program. The Division of
Fisheries and Wildlife has responded. They have no concerns over the
project. Brian Wood explained that the original drywell calculation
was okay, but presented in error. The volume represented by the
crushed stone should have been for each of the two units. The revised
calculations provides adequate storage. The plan has been altered to
move the watercourse to an upland area as requested by Don and the
wetlands area will not be disturbed. The plan now notes a benchmark
as requested.
A DEP file number is needed before the work may begin, and tnls will
be made one of the provisions in the Order of Conditions. Discussion

of the use of a passbook security rather than posting a bond. Don
reported that town counsel agrees that this is acceptable.
Engineering is developing an estimated cost to be used for this
purpose. The applicant requested agreement that he can start work
before the 10 day appeal period. The Commission cannot give such
authorization.
7:51 PM E. Loschi moved to close the Public Hearing for the Vaughn property
at 562 Pearl St. as presented by Wood Associates (DEP#270-xxx,
RWB#1990-19). Seconded. The Order of Conditions will be issued at
the special meeting on 8/1/90.

7:55 PM Discussion of the situation raised concerning the dead trees on N.
Main St. J. Lachmayr will call the DEP to investigate.
8:06 PM Open Public Hearing (NOI) for the Reading DPW concerning town well
82-20 (DEP# 270-xxx, RWB# 1990-21) under Chapter 131§40 and RWB 50.
Ted McIntire, assistant director Reading DPW, discussed the filing of
the NOI and the situation with the town water supply. The pumping to
waste from 82-20 has accomplished what was intended. The town forest
well is now safe. Modifications to the water treatment plant for
in-plant aeration have been bid and the first half will be completed
by January, 1991 at which time pumping to waste will be stopped.
The concern in the NOI is primarily the mitigation of the iron and
other sedimentation accumulating at the bottom of the splash steps
and going into the wetlands. Two rows of hay bales will be used as a
barrier. The sediment will be cleaned by hand periodically. Final
cleanup will also be by hand with no heavy equipment needed. The
water both upstream and downstream is being monitored for VOC's as
required by the DEP and EPA.
Ben Nichols, representing the Town Forest Committee, raised several
concerns including the size of the sedimentation area and the
disposal of the removed material.
Don indicated that the removal and proper disposal will be included
in the Order of Conditions.
8:50 PM J. Lachmayr moved to close the Public Hearing (NOI) for the Reading
DPW (DEP# 270-xxx, RWB#1990-21 on town well 82-20. Seconded.

8:51 PM Opened Public Meeting (RDA) for Russell Howse, 721 Haverhill St.
(RWB#1990-24). Discussion of two items. 1)An above ground pool.
2)A possible violation by grading and seeding a lawn within 100' of
wetlands without approval of the Commission.
r_ Don indicated that part of the disturbance is historical and that
much of the work done on the lawn is what would have been required to

stabilize the area except that a siltation barrier and other measures
would have been ordered. The additional impervious area of the above
ground pool is not significant. He recommends that a negative
determination be given for the pool and that the actual extent of the
wetlands be determined by the Commission.
9:10 PM H. Hulse moved that a negative determination be given in response to
the RDA for the 27' round above ground pool at 721 Haverhill St.
(RWB#1990-24) with the stipulation that the vegetated wetland line be
determined by the Administrator and that this line serve as a limit
for any future work. Seconded.

9:17 PM Open Public Hearing (NOI) for the "Old Orchard Road" subdivision by
S ephe- and Beth Ann Matathia and Joseph and Gail Maksou, 439 and 425
Haverhill St. (DEP#270-xxx, RWB# 1990-22) under Chapter 131§40 and
RWB 5§7.
Debora McCartney, Biologist for Hayes Engineering made the
presentation. She indicated that a detention area will be developed
upgrade of the BVW with no alterations to the BVW (unlike the initial
design concept). A landscaped island in the roadway will limit
impervious area. Erosion control will be maintained during the work.
The detention area will be grassed. Existing debris will be removed
during the construction.
Don indicated that there are small variations from the 25' buffer
zone. An isolated depression to the west will be smoothed out.
Grading will send water to the detention area and away from
neighbors. Discussion of restrictions on the grassed detention area
including limitations on pesticides and fertilizers. A site visit
was scheduled for 8:30 on 7/28 with Ms. McCartney present.
10:08 PM E. Loschi moved to continue the Public Hearing for the "Old Orchard
Road" subdivision (DEP#270-xxx, RWB#1990-22) with the consent of the
applicants until the special meeting 8/1/90 at 7:30 PM. Seconded.

10:10 PM Open Public Hearing (NOI) for Robert Kurchian, 284 Franklin St., for
the "Kurchian Woods" subdivision (DEP#270-xxx, RWB#1990-23) under
Chapter 131§40 and RWB 5§7.
William Bergeron of Hayes Engineering made a preliminary
presentation. The project is next to the town conservation land
known as "Kurchian Woods". There will be a 600' road and 10 homes.
An upland detention area will be constructed. The applicants will
make improvements on the town parking area for Kurchian Woods and
provide access to additional parking on non-town property. A drain
easement will encompass the entire detention area.

10:42 PM E. Loschi moved to continue the Public Hearing for the "Kurchian
Woods" subdivision (DEP#270-xxx, RWB#1990-23) with the consent of the
applicants until 8:00 on 8/8/90. Seconded.

10:45 PM Discussion of a request by Mr. Pacy to reinstate an Order of
Conditions for Lot 6, Annette Lane, which has expired (DEP#270-181,
RWB#1987-21). The original Order was issued 3/14/88 under Chapter
131§40 and RWB Article 32. The work was never done, and the site has
not been disturbed. The Order of Conditions under Chapter 131§40 is
still in force until 3/91.
10:57 PM H. Hulse moved that the Commission grant a 2 year retroactive
extension under RWB 5§7 to expire on the same date as the Order of
Conditions under Chapter 131§40 for Lot 6, Annette Lane (DEP#270-181,
RWB#1987-21). The extension will expire 3/14/91. Seconded.

11:00 PM Discussion of pulling the bond for Kevin Fulgoni, 16 Margaret Rd.
(DEP#270-176, RWB #1987-17). Mr. Fulgoni has agreed to do the work
as stated in the Order of Conditions to avoid losing the bond money.
Don indicated that the work as ordered may result in the loss of
trees which may not be necessary and that a plan change should be
investigated.
11:06 PM Discussion of a corrected Certificate of Compliance for Angelo
Petrosino, Rocky Road subdivision (DEP#270-168, RWB#1987-10). The
registry book and page number were incorrect. A corrected
Certificate of Compliance was signed.
11:08 PM Discussion of the Eagle Scout project. J. Lachmayr needs to know if
the bridge will be within the state boundaries and outside of the
federal boundaries to see if the paperwork can be limited. Don will
evaluate.
11:12 PM Discussion of the Pasture Road situation.
11:15 PM Discussion of the article on the Conservation Commission which
appeared in the Reading Chronicle on 7/25/90. It contained many
serious factual errors and did not present a favorable image of the
Commission in many respects. The author will be contacted. He had
promised to let Don proofread the article before publication, but did
not do so.
