Nadeau, Administrator 7:04 PM Call to Order The regular meeting of the Reading Conservation Commission was called to order. 7:08 PM Minutes of 9112190 and 9119190 J. Nickerson moved to accept the minutes for 9/12/90 as amended. VOTED 4-0-2 7:10 PM J. Nickerson moved to accept the minutes for 9/19/90 as amended. VOTED 4-0-2 7:12 PM E. Loschi arrived. 7:12 PM Board of Selectmen's Meeting Discussion of the 9/25/90 Board of Selectmen's meeting attended~;hy C.' Anthony and J. Biller representing the Commission. H. Hulse gaye=a ~a summary of the discussion. The idea of moving the jurisdiction for the Aquifer Protection District to the Conservation Commission k being considered. It was suggested that houses within the District - be flagged on the Assessors computer so that homeowners may be notified of their status within the District. C. Anthony and J. Biller answered questions for the Selectmen and made various suggestions and recommendations concerning the potential problems within the District. J. Biller suggested greater publicity on the subject to the town and then got Mr. Bruce Morang of the Reading Chronicle to agree to publish items and articles related to the Conservation Commission, including the possibility of a regular column as suggested by C. Anthony. Land use studies within the District were also discussed. Several of the Selectmen were concerned with the issue in general and supportive of the concerns of the Commission. 7:23 PM Administrators Report Minutes from the 9/5/90 meeting are needed. R.-Longley and J. Lachmayr will collaborate. Ashley Woods Discussion of the Ashley Woods development. The builder had already put the road in without a pre-construction meeting with the Administrator as required by the Order of Conditions. No hayba e inspection was done, and other conditions were apparently violated. FINAL CORRECTED MINUTES 9/26/90 Page 2 The developer claimed that the work was outside of the 100, buffer zone from the wetlands. Don Nadeau informed him that the work was within the jurisdiction of the Commission because of the proximity of isolated wetlands. 7:30 PM Reading Medical Center (American Trade Park) Plan Change Discussion of a Plan Change for the Reading Medical Center (formerly known as the American Trade Park), 272 Ash Street (DEP #270-200, RWB #1989-1). The plan change is for a change of use due to a change of ownership. The new use is for an office/medical building. The original two buildings will be reduced,to one building with approximately 7000 ft2 less imGianpervious surface. No changes directly impacting on the wetlands or the original Order of Conditions are planned. 7:46 PM H. Hulse moved that the plan change not be considered major or substantial and therefore is insignificant in its impact on the resource area. VOTED 7-0-0 7:51 PM H. Hulse moved that the plans consisting of a cover sheet and five drawings prepared by Arthur R. Giangrande of Design State Survey, Inc. be included into the Order of Conditions as the plan of record. The five drawings are titled: 1. S-1 Site Plan (9/10/90) 2. S-2 Landscape Plan (8/10/90) 3. S-3 Environmental Concerns & Erosion Control Plan (9/10/90) 4. S-4 Sewer Connection & Detail Sheet (9/14/90) 5. D-2 Roadway Plan & Profile (9/14/90) VOTED 7-0-0 7:55 PM An additional copy of the Ashley Woods Order of Conditions was signed. No changes were made. Two originals were requested for legal and filing purposes. 1:58 PM Preliminary discussion of additional dues needed for MACC/MSMCP No budget is available for these expenses. Discussion of taking the money from the Conservation fund or from the interest on that fund. 8:00 PM Plan Change for Azalea Circle/Greenhouse Acres An extension permit for the Greenhouse Acres development (DEP #270-162, RWB #1987-3) was signed on 9/12/90 with an incorrect date. The corrected document was signed. 8:05 PM The proposed plan change (RWB #1987-3 only) by Fafard Corp. for the Greenhouse Acres development was discussed. The proposal is to combine the two separate detention basins in the interior of the development into one basin with gentler slopes. It will consist of a grass swale which will be maintained by the condominium association. FINAL CORRECTED MINUTES 9/26/90 Page 3 8:12 PM H. Hulse moved that the newly submitted plans dated 9/18/90 for the Greenhouse Acres development detention area be considered neither major or substantial and having no significant impact on the resource area. The referenced plan will be added as the plan of record. VOTED 7-0-0 8:14 PM Further discussion of Greenhouse Acres. J. Lachmayr questioned how the work required by the Administrator to repair the perimeter and other areas such as the catch basins was going. The applicant indicated that all required repairs will be completed within the next week. 8:19 PM Request Certificate of Compliance for 87 Walkers Brook Dr. The Texaco station (Star Enterprises, 87 Walkers Brook Dr., DEP #270-204, RWB # 1989-23) has requested a Certificate of Compliance for the final phase of the work. An earlier partial Certificate of Compliance was issued. Don Nadeau raised some questions about elevations missing from the original "as-built" plan as submitted. The tank elevations were given and the other elevations relative to the tank were not changed. The "as-built" is considered sufficient. 8:23 PM J. Lachmayr moved that a final Certificate of Compliance be issued to Texaco (Star Enterprises) for 87 Walkers Brook Drive (DEP #270-204, RWB #1989-23). VOTED 6-0-1 8:27 PM Plan Change for 16 Margaret Road Discussion of a plan change for 16 Margaret Rd. (DEP #270-176, RWB #1987-17). The Order of Conditions was apparently in error in several respects. Compliance would result in removal of several trees due to drastic changes in elevation. The current conditions must be close to the original elevations because of the existing healthy trees. The original engineer interpolated the pre-existing grades incorrectly as well as transposing the "North" orientation on the plan of Order. 8:35 PM R. Longley moved to accept the plan changes as insignificant for 16 Margaret Rd. (DEP #270-176, RWB #1987-17) with conditions to include the seeding of bare spots during the fall 1990 growing season. VOTED 7-0-0 8:38 PM Additional discussion to note that DPW engineering has verified that the "as-built" is "almost" correct. A corrected "as-built" showing all trees and having a corrected "North" arrow, and completion of the seeding are needed for a Certificate of Compliance. 8:39 PM Notice of Non Significance for 41 A Street Discussion of issuing either an Order of Conditions or a Notice of Non-Significance for Herbert and Sheila Monto of 41 A Street (DEP #270-2261 RWB #1990-26). It was therecommendation o the Administrator that a Notice of Non-Significance should be issued FINAL CORRECTED MINUTES 9/26/90 Page 4 concerning the work done in violation of applicable laws at 41 A St. No work was done in the wetlands and the raising of the existing lawn had no impact on the resource area. 8:43 PM H. Hulse moved that a Notice of Non-Significance be issued to Herbert and Sheila Monto of 41 A Street (DEP #270-226, RWB #1990-26) be approved and issued. VOTED 6-0-1 8:49 PM Request for Certificate of Compliance for Lot 10 Beverly Rd. A request for a Certificate of Compliance for lot 10 Beverly Rd. (DEP #207-209, RWB #1989-37) was discussed. Don Nadeau has concerns about runoff/erosion. A berm has been added so that street runoff will no longer be the serious problem it was in the recent past. There are some bare spots which need seeding. 9:10 PM E. Loschi moved that a Certificate of Compliance be issued to Michael Morris for lot 10 Beverly Rd. (DEP #207-209, RWB 11989-37) with conditions (including condition #23) to be in effect for a period of two years. VOTED 7-0-0 9:16 PM Plan Change for Batchelder Estates A plan change for Batchelder Estates, Murray Hills, Inc. (DEP #270-202, RWB # 1989-19) was discussed. An Eastern Engineering Collaborative representative discussed the use of a stilling basin to overcome the fact that the outlet pipe ended up 2" lower than the wetlands into which it drains. The stilling basin compensates for this discrepancy. 9:36 PM H. Hulse moved that the plan change including the stilling basin dated 9/24/90 be considered neither major or substantial and that it has an insignificant impact on the resource area. Additional discussion resulted in the need for a verification of the wetland line and erosion control line by a Registered Professional Engineer as soon as possible. VOTED 7-0-0 9:41 PM Discussion of Pasture Rd. Drainage Problems Discussion of the current drainage problems on Pasture Rd. DPW needs to decide if any work needs to be done and prepare a filing. A discussion of the use of Reed Canary Grass to line the ditch was held. This is a wetlands plant and will help to maintain the operation of the ditch after it is cleaned out. M.C. Proctor questioned whether the drainage pipe was set correctly according to the original subdivision specifications. Other issues stemming from the site visit include questions for Ted Cohen (Town Counsel) about how the final agreement with Mr. Margossian was reached and whether Mr. Margossian built to the plan stipulated in the agreement. In addition, several apparent problems with the final agreement must be addressed. These include the 2% slope "to the front of the property" rather than as worded in the FINAL CORRECTED MINUTES 9/26/90 Page 5 agreement signed by the Commission, the date of the plan referenced, and the lowered cellar elevation. 10:04 PM Certificate of Compliance for Lot I Johnston Circle Brief discussion of the Johnston Circle development. Don Nadeau indicated that Lot 1 is in substantial compliance. 10:09 PM J. Lachmayr moved that a Certificate of Compliance be issued for lot 1 (only) of the Johnston Circle subdivision (DEP #270-152, RWB #1986-4). VOTED 7-0-0 10:11 PM Miscelaneous Old/New Business Discussion of additional dues for MACC ($35.00) and MSMCP ($20.00). 10:12 PM H. Hulse moved that $55.00 for dues ($35.00 for MACC, $20.00 for MSMCP) be paid from the Conservation fund. VOTED 7-0-0 10:15 PM E. Loschi requested a copy of the Conservation Commission Budget be made available to the Commission. 10:16 PM A letter from the Health Department in response to the letter from C. Anthony concerning the dumping of street sweepings in the town forest was discussed. 10:20 PM Discussion of the proposed wetlands delineation method changes contained in a publication received from DEP dated 8/10/90. 10:24 PM Discussion of the need for weekly meetings. No appointments will be made after 9:00 PM and the meetings will adjorn by 10:00 at the latest. The concensus was to try weekly meetings and see if it works out. 10:28 PM Discussion of Generic Water Quality Guidelines received from DEP. 10:30 PM Discussion of Right of Way Guidelines received from DEP including a discussion of herbicide application and information from the Pesticide Bureau. 10:32 PM Discussion of a letter from the Commission to the Selectmen regarding the warrant articles for Fall Town Meeting. 10:40 PM Adjourn M.C.
