Lachmayr; R. Longley; E. Loschi; J. Nickerson; M.C. Proctor; J. Biller, Assoc. Member; J. Reigley, Assoc. Member; D. Nadeau, Administrator 7:05 PM Call to Order The regular meeting of the Reading Conservation Commission was called to order. 7:06 PM Minutes of 9126190 The minutes of the 9/26 meeting were not available for members to review and could not be approved. 7:07 PM Administrators Report Don Nadeau provided information on and copies of various memos and items received in the office to the members of the Commission. He also gave a monthly budget status report. J. Nickerson raised the question of items for next years budget and urged that the Commission begin thinking about this issue. A discussion was held on the status of the Conservation fund and whether the Commission could receive the interest from the fund. Don Nadeau needs some software to help organize his files and make the accumulated information more readily accessible. The Commission was in general agreement. Money from the Conservation fund might be spent both on this and on books and other reference materials so that a library may be set up which is available to both the Commission and to the public as a resource. Update on Margossian Stipulation and Agreement The Administrator provided an update on the Margossian situation on Pasture Rd. The answer from Town Counsel was that the reference to a 1986 plan is a typographical error which will be corrected. Town Counsel indicated that the other stipulations are in conformance with the Conservation Commission agreement. Town Counsel was in agreement with the Administrator that the apparent problem with specification of the front grade is clear from the references to the 1988 plan. Update on Pasture Rd. Drainage Concerns Discussion of Pasture Rd. drainage concerns. A memo was received from A.V. Fletcher of DPW to Don Nadeau in reference to the petition from residents of Pasture Rd. Other materials from A.V. Fletcher to the Town Manager were presented. Mr. Fletcher says that some problems are due to the actions of the abutters and that some are due to not cleaning the open ditch in its entirety since it was constructed in 1969. Many residents of Pasture Rd. were present for the discussion. 7:50 PM Discussion of DEP Notices Don Nadeau reviewed various DEP notices providing technical guidance and information for the Commission. He also discussed a joint meeting FINAL CORRECTED MINUTES 10/3/90 Page 2 scheduled from 7:30 to 8:10 on 10/10/90 with the Bylaw Committee to discuss the proposed changes to RGB §5.7. 7:56 PM Old/New Business Preliminary discussion of several amended Orders of Conditions and other items on the agenda. No new plan has been submitted for 16 Margaret Rd. (DEP #270-176, RWB #1987-17) so that no action can be taken on this item tonight. When the plan is submitted, an amended Order of Conditions will be issued. 8:00 PM Amended Order of Conditions 272 Ash St. A discussion was held on the amended Order of Conditions for 272 Ash St. (DEP #270-200, RWB #1989-1) for Reading Medical Center (formerly American Trade Park). The amended Order of Conditions was signed. 8:08 PM Azalea Circle/Greenhouse Acres Discussion of letter from Don Nadeau to Mr. Ben J. Chirco regarding the Greenhouse Acres detention basin. 8:10 PM R. Longley moved to approve the letter dated 10/3/90 to Mr. Ben J. Chirco in regards to the Greenhouse Acres Detention Basin. (DEP #270-162, RWB #1987-3). VOTED 7-0-0 8:13 PM Batchelder Estates Discussion of a letter from Don Nadeau to Mr. Astone regarding the Batchelder Estates situation. The stilling basin to accomodate the 2" elevation difference is acceptable. 8:15 PM H. Hulse moved that the letter to Mr. Astone be approved. VOTED 7-0-0 8:16 PM Certificate of Compliance for 87 Walkers Brook Drive (Texaco) The Certificate of Compliance for Texaco (Star Enterprises) (DEP #270-204, RWB #1989-23) was signed. 8:17 PM MACC/MSMCP Dues The bill roll for $55.00 for dues was signed. This includes $35.00 additional dues for MACC and $20.00 for MSMCP. MACC apparently used a special method of calculating the amount of dues owed and the dues already paid were insufficient. 8:19 PM Miscellaneous Items of Discussion Discussion of Open Meeting Law questions. J. Nickerson presented various items of interest and discussion. 8:20 PM Discussion by J. Lachmayr of her talk with Bruce Morang of the Reading Chronicle. This was a follow up to the discussion at a preceeding Selectmen's Meeting where C. Anthony and J. Biller got Mr. Morang to agree to publish conservation related articles. J. Lachmayr indicated that the Chronicle will publish an article on the Aquifer Protection District if it is written and submitted by the Commission. FINAL CORRECTED MINUTES 10/3/90 Page 3 J. Biller will undertake to write the article. J. Keigley will obtain and reduce a map of the aquifer protection district to accompany the article. S 8:25 PM M.C. Proctor began a discussion of a retaining wall and erosion problems at lot 10 Beverly Rd. and on the adjacent lot. The Administrator indicated that the existing Order of Conditions is broad enough in its coverage to allow him to address potential problems. 8:27 PM C. Anthony discussed the general problem with changes in projects and the necessity of amending Orders of Conditions. She suggested that more site visits may be necessary for the Commission to remain informed on the progress of projects. 8:30 PM J. Nickerson expressed concern about the Commission not being informed ahead of time about any warrant articles which concern the Commission and possible bylaw changes proposed by other town boards or commissions. Better communication between town boards and departments is necessary. 8:32 PM M.C. Proctor moved to add a paragraph to the letter to Mr. Astone of Batchelder Estates requiring the applicant to submit a plan to scale stamped by a registered professional engineer. VOTED 7-0-0 8:33 PM A question was raised concerning the interest on the Conservation Fund. 8:37 PM Adjourn M.C. Proctor moved to adjourn. Seconded. VOTED 7-0-0 Respectfully submitted J.
