Hulse; J. Nickerson; E. Loschi; M.C. Proctor; J. Keigley, Assoc. Member; D. Nadeau, Administrator ABSENT: J. Lachmayr; R. Longley, V. Chairman; J. Biller, Assoc. Member; 7:07 PM Call to Order The regular weekly meeting of the Conservation Commission was called to order. 7:02 PM Discussion of Conservation Commission Potluck Supper The best tentative date for the potluck supper is Friday, Nov. 30, 1990 at C. Anthony's house. 7:12 PM Administrators Report 7:17 PM Documents urging a no vote on question 3 were passed out by the chairman and upon protest were re-collected. 7:18 PM Matathia/Maksou Appeal Discussion of DEP letter to Matathia/Maksou (DEP # 270-221) in regards to a Notice of Appeal. A site visit is scheduled for Nov. 1, 1990 at 9:00 AM with DEP. Hearing for Bylaw Changes Discussion of Conservation Commission Hearings for bylaw changes. Although not required by law, it was felt that public hearings would be helpful. The Administrator will find an appropriate meeting room for the hearings and determine the best time for them to be held. The best nights are Nov. J or Nov. 8. 7:32 PM Public Meeting - 21 Pasture Rd. A Public Meeting was opened regarding a Request for Determination for 21 Pasture Rd. under RGB §5.7 (RGB #1990-30) with Mr. Donald Yonika acting as the agent for the interested parties. The notice of the Public Meeting was read. Mr. Yonika defined flooding under the Reading Wetlands Bylaw and showed a series of photos taken on Oct. 15, 1990 by A. Hooper. Mr. Yonika suggests that the referenced property is a protectable resource under the Reading Bylaw (i.e. land subject to flooding). The Conservation Administrator read the names of the concerned citizens. The following points were made: • Established the chronology of events noted how the - house was to be-situated and graded. • Recommended that this definition is not a reasonable FINAL CORRECTED MINUTES 10/24/90 Page 2 application of the law. • The court case was settled and provided storage on site. Technically there is land subject to flooding, however applying the law in this case is not a reasonable application of the law. H. Hulse noted that the photographs show construction events and are part of an ongoing project and thus not under control of the Conservation Commission. J. Nickerson noted the preamble H. Hulse moved that the Public Meeting regarding RGB #1990-30 be closed. Seconded. VOTED 5-0-0 8:00 PM Public Meeting - Main Street Sidewalks A Public Meeting was opened to discuss a Request for Determination for sidewalks on Main Street under RGB §5.7 (RGB#1990-31). The sidewalks in question involve lots 19, 20, 21, 50, 50b, and 50c on Assessors Map 140. The notice of the Public Meeting was read. Mr. Nadeau and Mr. Robertson discussed the proposed sidewalks on the West side of Main Street located North of Birch Meadow Drive. The developer of "Fairchild Estates" was requested by CPDC to build this sidewalk as part of a "Linkage" type of project which is to cost $25,000. The section from 1012 Main St. to Forest Drive (350' ±501) is in the Buffer Zone. Two veteran trees (W. Oak) will be saved by locating the proposed sidewalk such that the sidewalk at that point will be 3.5 feet wide rather than the usual D.P.W. sidewalk specification of 4 feet. Some public discussion was in favor of the project. Mr. Tabor of 1002-Main St. spoke to the fact that there is a foot path currently and spoke to the need for Winter plowing; he is not opposed to the project, however. Mr. Tabor was directed to appropriate town officials for discussion of his concerns. H. Hulse moved that the Public Meeting regarding RGB #1990-31 be closed. Seconded. VOTED 5-0-0 8:30 PM Discussion of Warrant Background Statement A discussion was held concerning the Warrant Background Statement. Don Nadeau wants case studies to buttress the arguments. _ 45 PM- Fairwood Acres Extension The proponents of the "Fairwood Acres" development (DEP #270-170, RGB #1987-8) are requesting an extension via a letter from Mr. FINAL CORRECTED MINUTES 10/24/90 Page 3 Peter Ogren of Hayes Engineering. H. Hulse moved that an extension permit for a period of one year be issued under MGL Article 131 §40 (DEP #270-170). Seconded. VOTED 5-0-0 H. Hulse moved that an extension permit for a period of one year be granted under RGB §5.7 (RGB #1987-8). Seconded. VOTED 5-0-0 8:50 PM General Discussion • Earth Removal Bylaw • Invitation to attend a hydrology workshop. C. Anthony, J. Lachmayr, J. Biller and D.
