Chairman 7:02 PM Call to Order The regular weekly meeting of the Conservation Commission was called to order. 7:02 PM Discussion of Minutes Review and discussion of the minutes from 10/17/90. 7:17 PM J. Nickerson moved that the minutes of 10/17/90 be accepted as amended. Seconded. VOTED 5-0-0 7:17 PM Administrators Report 7:19 PM Proposed Amendments to RGB A discussion was held concerning the Public Hearing on the proposed amendments to the Reading General Bylaw §5.7 (The "Reading Wetlands Bylaw"). There is no requirement that a public hearing be held, but Town Counsel has indicated that we may do so. There may be too little time left to post proper notification. The hearing is scheduled for 7:00 PM on Thursday, Nov. 8, 1990 in the Selectmen's Meeting Room. E. Loschi and J. Keigley will help get letters out to all Town Meeting Members to inform them of the hearing. 7:31 PM Board of Health Warrant Article 17 Ruth Cogan, Reading Health Director, presented an overview of Article 17 on the upcoming Town Meeting Warrant which was sponsored by the Board of Health. This article concerns the "Well Closure Law". The current bylaw provisions are obsolete because of the adoption of the 1988 Board of Health regulations. This warrant article will eliminate items concerning construction and destruction of wells which are now covered in the regulations. The Board of Health has amended the Warrant Article since the original publication of the Warrant. 7:44 PM J. Lachmayr moved that the Reading Conservation Commission support Article 17 of the upcoming Town Meeting Warrant as amended by the Board of Health. Seconded. VOTED 5-0-0 FINAL CORRECTED MINUTES 10/31/90 Page 2 7:48 PM Update on Well 82-20 Don Nadeau discussed the current status of Town Well 82-20 (DEP #270-225, RGB#1990-21). The recent rains caused a flooding situation with the water up to the aeration splash steps. The Iron is not settling out, but is washing into the wetlands. Don Nadeau recommends increased erosion control. 7:55 PM Update on Ashley Woods Don Nadeau discussed the status of the "Ashley Woods" development (DEP #270-219, RGB #1990-16). The Town of Reading has received a bond statement in the form of a $30,000 deposit. The Conservation Administrator has notified CPDC that the Conservation Commission no longer has any objection to the release of the lots. 7:57 PM Discussion of DEP Water Certification Forms Preliminary discussion of DEP Water Certification Forms. 7:59 PM There will be a site visit on Nov 1, 1990 at 9:00 am at 439 Haverill St. with DEP representatives in regards to the DEP appeal of the "Old Orchard Park" subdivision Order of Conditions. 8:00 PM Riverways Program A presentation of the Riverways Program was given by Mr. Steve McRae, Ms. Maria Van Dusen, and Ms. Liz Mickeleky of the Department of Fisheries, Wildlife and Environmental Law Enforcement Riverways Program. The goal of the program is the protection of water quality, protection of lands adjacent to waterways, habitats, and the development of recreational uses of state lands. The discussion centered around the use of a Geographic Information System (GIS) and the ability of this system to integrate various types of information about the areas under consideration. The system is able to create maps which illustrate this information in a graphical way which is easy for users to assimilate. They stressed the need for citizen involvement in the Riverways Program and in the updating and correction of the information in the GIS database. 8:45 PM Don Nadeau indicated that he needs information on the meeting date when the wetlands re-delineations for lots 128 and 129 of Phase IV of Sanborn Village were approved. 8:48 PM New/Old Business Certificate of Compliance - Lot 106 Sanborn Village The Certificate of Compliance requested for lot 106 of Sanborn Village cannot be granted at this time. A statement is needed from a RPE stating the deviations from the Order of Conditions. 8:50 PM Sign Extension Permit - Fairwood Acres The extension permit for the "Fairwood Acres" subdivision (Fairwood Acres Realty Trust under RGB#1987-8) was signed. Don Nadeau discussed the policies of the Conservation Commission. He requested that the a vote be taken to set a Commission policy of FINAL CORRECTED MINUTES 10/31/90 Page 3 considering all former decisions on their merits when applying the Reading Wetlands Bylaw to a new case. He indicated that such a policy should be made official for legal and other reasons. 9:15 PM Vote/Sign Determination of Applicability - 21 Pasture Rd. H. Hulse moved that a Negative Determination be issued in regards to 21 Pasture Rd., Donald Yonika, Agent (RGB #1990-30) since the conditions are controlled by a legal settlement. VOTED 5-0-0 9:20 PM Vote/Sign Determination of Applicability - Main Street Sidewalks J. Nickerson moved that a Negative Determination be issued for the Main Street Sidewalk between Birch Meadow Drive and Forest Street (RGB #1990-31) with standard conditions including that the two veteran trees in the right- of-way will not be damaged and will be protected during construction by being wrapped in snow fence or similar material to a height of 10' and that the hay bale line be in place as presented. VOTED 4-0-1 (JL abstain) 9:32 PM Reading Medical Center Amendment Condition 12 of the Order of Conditions for the Reading Medical Center (DEP #270-200, RGB #1989-1) requires an extension of the time allowed for the restoration and reclamation planting. The original 0 of C required that the work be done by the Fall of 1989. Because of the transfer of ownership and change in the use of the building this was not done. The time will be extended to Nov. 1, 1991. The Administrator will write a letter to the file indicating that the extension was approved. 9:41 PM J. Lachmayr moved that Condition 12 of the order of Conditions for the Reading Medical Center project (DEP #270-200, RGB #1989-1) be extended from the Fall of 1989 to Fall 1991 (no later than Nov. 1, 1991) by letter to the file. VOTED 5-0-0 9:43 PM DPW Land Swap Annexation The Commission needs to annex the land swapped to allow the DPW road crossing from the original Order of Conditions for DEP #270-158, RGB # 1986-18 to the Order of Conditions for DEP #270-200, RGB # 1989-1. The portion of land swapped between the Town and the developer of what is now the Reading Medical Center (for the DPW road crossing which was necessary when the new DPW facility and access road was built) must be referenced in the appropriate Order of Conditions (under RGB §5.7 only) in accordance with DEP actions. E. Loschi moved that the Commission annex the portion of the land swapped for the DPW road crossing from the Order of Conditions for ,RGB #1989--1 tothe Order of Conditions for RGB- #1-989--1---in accordance with DEP actions. FINAL CORRECTED MINUTES 10/31/90 Page 4 VOTED 5- 0- 0 9:55 PM Discussion of Town Meeting Presentation A short discussion was held concerning the presentation of the proposed changes in RGB §5.7 which will be made during the Subsequent Town Meeting. 9:56 PM Discussion of Article 21 A short discussion of Article 21 on the Warrant for the upcoming Town Meeting was held. This concerns the formation of a Land Advisory Committee of Town Meeting. This would seem to overlap Conservation Commission authority and is probably not necessary. 10:08 PM Adjournment M.C.
