Nickerson; J. Lachmayr; E. Loschi; M.C. Proctor; J. Biller, Assoc. Member; J. Keigley, Assoc. Member; D. Nadeau, Administrator ABSENT: H. Hulse; R. Longley, V. Chairman; 7:07 PM Call to Order The regular weekly meeting of the Conservation Commission was called to order. The meeting was held on Thursday this week to accomodate the Public Hearing on the proposed amendments to RGB §5.7. 7:07 PM Public Hearing on Proposed RGB §57 The Public Hearing on the proposed amendments to Section 5.7 of the Reading General Bylaws (Wetland Protection), warrant articles 4 through 14 of the November 1990 Subsequent Town Meeting, was opened. In addition to the Commission, Mr. Ron Boucher and Mr. Barry Mitchel were in attendance. 7:11 PM E. Loschi arrived. The proposed amendments to RGB §5.7 are designed to accomplish two basic goals: 1. Maintain the authority currently granted to the Conservation Commission under the existing State Regulations and the local bylaw. 2. Bring the bylaw up to date to reference current state law. General Discussion Mr. Ron Boucher suggested that a general report be given under Article 1 as a lead-in to Articles 4-14. C. Anthony will discuss this with the Moderator, Mr. Paul Dustin. The discussion covered various aspects of the presentation procedure before Town Meeting. The main items discussed included: 1. It was suggested that transparencies be made of D. Nadeau's summary sheets. 2. The concept of keeping the discussion before Town Meeting as simple as possible was emphasized. 3. "Lands Bordering" and the possible interpretations and confusion which might occur. FINAL CORRECTED MINUTES 11/08/90 Page 2 4. Fees - what fees will be charged until the Attorney General approves of the changes to RGB. The current fee schedule should be discussed if this comes up at Town Meeting. 5. The Commission should move Article 8 to the end of the discussion to avoid losing both the references to the 1978 Regulations and replacements such as Article 10 which might result in the loss of significant authority. We should ask that Article 8 be tabled until after Article 14. 6. Rare species including plants. This is not really new jurisdiction since the rare species will be regulated only in the wetlands already covered by the current jurisdiction. 7. The Commission should table Article 12 until after Articles 13 and 14 (and 8) since renumbering is moot without the passage of Articles 13 and 14. 8:39 PM 8:54 9:02 PM Public Hearing Closed The Public Hearing on the proposed amendments to RGB §5.7 was closed. Administrator's Report The Administrator discussed Water Quality Certification procedures. J. Lachmayr left the meeting. 9:04 PM Discussion of Article 21 A discussion was held on a possible stand by the Conservation Commission on Article 21 of the November 1990 Subsequent Town Meeting warrant. This article proposes that a "Land Advisory Committee" of Town Meeting be created to advise Town Meeting. 9:17 PM J. Nickerson moved that the Reading Conservation Commission does NOT recommend Article 21 because it represents a duplication of effort by the Conservation Commission and other town agencies. VOTED 4-0-0 9:19 PM C. Anthony discussed a telephone call from the Town Manager concerning the possibility of a blanket approval for "small" DPW projects. This needs review by the Administrator and will be discussed at the 11/14/90 meeting. A memo was received about the Aquifer Protection District. The problems and education of the public.
