Anthony, Chairman; H. Hulse; J. Nickerson; J. Lachmayr; E. Loschi; M.C. Proctor; J. Biller, Assoc. Member; J. Keigley, Assoc. Member; D. Nadeau, Administrator ABSENT: R. Longley, V. Chairman; 7:09 PM Call to Order The regular weekly meeting of the Conservation Commission was called to order. C. Anthony announced that R. Longley will resign from the Commission due to the increased pressure of'her work. Discussion of the Christmas Party to be held on Saturday, January 19, 1991. 7:15 PM Administrator's Report 7:15 PM New/Old Business Request Certificate of Compliance for 14 Pinevale Ave A Certificate of Compliance for 14 Pinevale Ave has been requested (DEP #270-203, RGB #1989-20). The "as-built" was not done by a Registered Professional Engineer (RPE), but the original plans were not either. D. Nadeau has made a site inspection. The work seems to be okay, but is not quite complete including seeding which has not taken. Discussion of "decking". The poured concrete apron around the pool is not what the Commission had in mind when the original filing was made. The Commission questioned whether the increased impervious area.was included in the original calculations. The sense of the Commission included the following points: 1. Is the "as-built" plan adequate as submitted? 2. Is the grass a concern? 3. The "retaining wall" (two rows of unmortared concrete blocks) are not shown on the original plan. 4. The increased impervious area represented by the concrete apron was accounted for in the original filing. A site visit is scheduled for 9:00 AM Saturday Nov. 17. ruain meeci~g - o recur a~cic__ _ The Public Meeting concerning the Request for Determination for 8 Verde Circle, Marc Freedman, RGB #1990-32, was opened. The FINAL CORRECTED MINUTES 11/14/90 Page 2 Administrator received an anonymous tip that activity was being carried out without any filing. Mr. Freedman has now filed a Request for Determination. He has drilled an Artisian Well 500' deep for irrigation, removed trees, and done other work. 7:51 PM J. Nickerson moved that the Public Meeting on the Request for Determination for 8 Verde Circle, RGB #1990-32 be closed. Seconded. VOTED 6-0-0 The discussion included the possibility of a negative determination with conditions including: 1. The work conform to the submitted plans. 2. Erosion controls be installed as shown on the plans. 3. The erosion controls be approved prior to any work being done. 4. No activity of any kind (as defined under the bylaw) be allowed beyond the "limit of work" line. 5. No machinery or materials shall be allowed on and no work is to be done from the down-gradient side of the silt fence. 8:18 PM J.. Nickerson moved that a NEGATIVE DETERMINATION with conditions as discussed be issued for 8 Verde Circle, RGB #1990-32. Seconded. VOTED 5-0-1 H. Hulse abstained because he is a concerned abutter. 8:20 PM Plan Change - Lot 7 Batchelder Estates A plan change for Lot 7, Batchelder Estates (DEP #270-202, RGB #1989-19) was discussed. A change in the dimensions of the house via an addition to the house which will result in more impervious area is proposed. A stone driveway is proposed instead of blacktop as a trade-off for the increased impervious area. The Commission decided that the modification to the driveway is not acceptable since there is no control over future paving which would negate the offset in impervious area. Additional runoff calculations and possible mitigation are needed. 8:28 PM J. Nickerson moved that the proposed plan change for Lot 7, Batchelder Estates (DEP #270-202, RGB #1989-19 is UNACCEPTABLE because it does not provide sufficient mitigation for the proposed increase in_imnervious area. VOTED 6-0-0 FINAL CORRECTED MINUTES 11/14/90 Page 3 .30 PM Plan Change for Stone Well Road (Old Orchard Rd). A plan change for the "Stone Well Road" (formerly the "Old Orchard Road") subdivision was presented by Mr. William Bergeron of Hayes Engineering (DEP #270-221, RGB #1990-22). The plan change is the result of an appeal by DEP of the Order of Conditions issued by the Reading Conservation Commission. As a result of the appeal, a 700 ft3 replacement area (for the 390 ft3 lost "Bordering Land Subject to Flooding") will be created out of upland on Lot 2. The Commission is requested to support the change so that DEP will withdraw the appeal and remand jurisdiction to the Reading Conservation Commission. The Administrator recommended that a letter to the applicant be placed in the file accepting the described deviation from the Order of Conditions as NOT being a SIGNIFICANT plan change. 8:57 PM H. Hulse moved that a letter be drafted to DEP from the Reading Conservation Commission endorsing the plan change dated Nov. 9, 1990 as submitted. On approval by DEP, the Reading Conservation Commission will incorporate this INSIGNIFICANT change into the existing Orders of Condition (DEP #270-221, RGB #1990-22) as an AMENDMENT. VOTED 6-0-0 9:10 PM New/Old Business DPW "Ditch Maintenance Policy' The Town (DPW) has done minimal drainage maintenance for 8 years. The Town Manager has requested that a generic Order of Conditions be issued for ditch and culvert maintenance. The Commission needs to meet with the DPW to discuss the drainage problems of the Town. The Administrator will set up a meeting. The maintenance of streams will also be discussed with DPW. 9:25 PM Discussion of Proposed Amendments to RGB §5.7 Maria Silvaggi is apparently still concerned that the Commission will lose authority under Article 6. C. Anthony has talked with her to assure her that the other articles will maintain the, current authority held by the Commission. 9:39 PM D. Nadeau discussed a letter to Mr. Hingorani, developer of the Chestnut Knoll Condominiums in North Reading, from the Reading Board of Selectmen denying a hookup for that project to the Reading Sewer lines. The Administrator discussed a development on Family Circle by Mr. Zanni. An Order of Conditions will be issued for lots under our jurisdiction. CPDC has approved the project with the condition that an Order of Conditions be obtained from the Conservation Commission. M.C. Proctor moved to adjourn. Seconded. k FINAL CORRECTED MINUTES 11/14/90
