Hulse; J. Nickerson; J. Lachmayr; E. Loschi; J. Biller, Assoc. Member; J. Keigley, Assoc. Member; D. Nadeau, Administrator ABSENT: M.C. Proctor 7:03 PM Call to Order The regular weekly meeting of the Conservation Commission was called to order. 7:23 PM H. Hulse moved that the minutes of 10/24/90 as amended be accepted. VOTED 4-0-1 W. Lachmayr abstained). 7:25 PM Mr. Bill Bergeron of Hayes Engineering raised a question about a lot on Lilah Lane. A small retaining wall is needed due to a problem with an abutter not grading to the approved plan. Mr. Bergeron would like the Commission to approve the change. 7:30 PM H. Hulse moved that the minutes of 10/31/90 as corrected be accepted. VOTED 4-0-1 (C. Anthony abstained) 7:33 PM Public Hearing - Carriage Estates Phase I Subdivision The Public Hearing for the Carriage Estates Phase I subdivision (DEP #270-227, RGB #1990-33) was opened under MGL Chapter 131§40 and RGB §5.7. H. Hulse abstained from taking part in the discussion as a concerned abutter. This is a subdivision off of the South side of Sanborn Lane. Mr. Bill Bergeron of Hayes Engineering made the presentation. Phase II of Carriage Estates will follow, but each phase has a separate developer and is considered a separate development. The BVW for Phase I was flagged by Ms. Deborah McCartney of Hayes Engineering and has recently been verified by her. The original work was done two years ago by another engineering firm which has now been replaced by Hayes. No alteration will be done within the BVW. The peak runoff rates for a 100 year storm will be lowered in both the westerly direction (towards the Town Forest) and the easterly direction(into__the wetlands) by the drainage system and, the use of a detention basin. The detention basin will serve both the driveways and roadway to reduce the peak runoff. The volume of runoff to the FINAL CORRECTED MINUTES 11/28/90 Page 2 West will be reduced since only the rear portion of the houses on the westerly side of the road will drain to the West now. The drainage system is designed for the miximum 4000 ft2 of impervious area per house although the actual impervious area is expected to be much lower. J. Biller raised the question of the total change in volume of water going to each watershed. Mr. Bergeron reiterated that the peak runoffs are lower as required, but agreed that the total volume of water to the westerly watershed was lower. C. Anthony raised a concern over the lack of rear yards for lots 9-14. It was noted that the wetlands delineation will be restricted to the property included in this filing for Phase I and will not include property which is part of Phase II. J. Lachmayr questioned the lack of tributary watershed information in the calculations. Mr. Bergeron stated that no areas off-site are tributary to the site and thus the assumptions made in the calculations are proper. J. Nickerson and J. Lacyhmayr are interested in seeing both Phase I and II together in the proper context since they are both adjacent to the same wetlands area. J. Lachmayr questioned the references used for the topography shown. The Town of Reading Sewer Benchmark was used as required by CPDC. It was requested that a statement be added to the drawings indicating this as well as adding legends. J. Nickerson is concerned about the detention area and the fact that the inlet and outlet are together on the same side. Mr. Bergeron stated that the detention area is outside the 100' buffer. In response to a question, Mr. Bergeron stated that the catch basins include sumps and gas traps. J. Nickerson questioned the ability of the detention area to cleanse the water since the inlet and outlet are so close to each other. Mr. Bergeron indicated that the entire detention area will fill during severe storms. Mr. Bergeron was requested to allow a two week extension until Dec. 12 at 7:30 PM. A site visit is scheduled for Saturday, Dec. 1 at 1:00 PM. D. Nadeau asked that lots 11-15 have the rear corners of the houses staked, that the inlet and outlet of the detention basin be staked, and that the center line of the road in the vicinity of lots 11-15 be staked. D. Nadeau also indicated that the buyers must be made aware of the 25' restriction of activity and the effect this will have on the use of the rear yards. It was stated and agreed to by Mr. Bergeron that the wetlands delineation for the Westerly and Northerly boundaries of the wetland is restricted to Phase I only. A profile plan with proper benchmark references was requested. In addition, the addition of legends to all maps and the marking of direction of flow for all watersheds was requested of the applicants. 8:33 PM The Public Hearing was opened to public comment. Mr. Richard Doucette of 102 Sanborn Lane is worried about loss of water from his well due to diversion of water away from his property and the adjacent aquifer. He requests that checks be done on quality and pressure of water to ensure that the development does not degrade his well. In response to a question, Mr. Bergeron indicated that access to the FINAL CORRECTED MINUTES 11/28/90 Page 3 Town Forest would be granted. 8:44 PM E. Loschi moved that the Public Hearing for the Carriage Estates Phase I subdivision (DEP #270-227, RGB #1990-33) be continued until Dec. 12, 1990 at 7:30 PM with the consent of the applicant. Seconded. VOTED 4-0-1 H. Hulse abstained because of his status as a concerned abutter. 8:47 PM Public Hearing - Lot 112 Sanborn Village Phase IV The Public Hearing for Lot 112, Lilah Lane, Sanborn Village Phase IV (DEP #270-228, RGB #1990-34) was opened under MGL Chapter 131, §40 and RGB §5.7. H. Hulse abstained from taking part in the discussion as a concerned abutter. Mr. Bill Bergeron of Hayes Engineering made the presentation. The project under discussion IS within the buffer zone. The project will be less than 3500 ft2 of impervious area (the maximum allowed) and the limit of activity line will have sedimentation controls installed. A site visit is scheduled for Saturday, Dec. 1. The elevations for this project use the USGS benchmarks rather than the Reading Sewer Benchmarks. D. Nadeau noted that the Ipswich River comes up to or on to the site. This lot was removed from the original Sanborn Village Phase IV and now needs its own Order of Conditions. Mr. Bergeron was requested to allow a continuance of the Public Hearing until 12/5/90 at 7:30 PM and he agreed. 8:58 PM E. Loschi moved that the Public Hearing for Lot 112, Lilah Lane, Sanborn Village Phase IV (DEP #270-228, RGB # 1990-34) be continued until 12/5/90 at 7:30 PM with the consent of the applicant. Seconded. VOTED 4-0-1 H. Hulse abstained because he is a concerned abutter. 9:01 PM Public Hearing for lots 1281129 Sanborn Village Phase IV A combined Public Hearing for lots 128 and 129, Sanborn Lane, Sanborn Village Phase IV, (DEP 1270-229, RGB #1990-35 and DEP #270-230, RGB #1990-36 respectively) was opened as a concurrent Public Hearing for both properties with the consent of the applicant under MGL Chapter 131, §40 and RGB §5.7. H. Hulse abstained from taking part in the discussion as a concerned abutter. The properties are both within the buffer zone at the end of the Sanborn Lane extension. Mr. Bill Bergeron of Hayes Engineering made the presentations. The applicant is asking to construct dwellings on both lots within the buffer zone. The BVW was determined earlier as part of Sanborn Village Phase IV and a 20' limit of no-activity will be respected. The design allows for up to the maximum allowable 3500 ft2 of impervious area although it is likely that the acutal figure will be less. The design meets the 1/3 side slope criterion and haybales will be used for, sedimentation control. D. Nadeau recommended that siltation fencing be used. The Public Hearings were continued with the consent of the FINAL CORRECTED MINUTES 11/28/90 Page 4 applicant until 12/5/90 at 8:00 PM. A site visit is scheduled for 12/1/90. 9:20 PM E. Loschi moved that the Public Hearings for lots 128 and 129 (DEP #270-229, RGB #1990-35 and DEP #270-230, RGB #1990-36 respectively), Sanborn Lane, Sanborn Village Phase IV, be continued until 12/5/90 at 8:00 PM with the consent of the applicant. VOTED 4-0-1 H. Hulse abstained because he is a concerned abutter. 9:22 PM Discussion of Plan Change Lot 143 Sanborn Village Phase IV Mr. Bill Bergeron explained the details of the plan change for lot 143 of Sanborn Village Phase IV (DEP #270-171, RGB #1987-12). H. Hulse abstained from taking part in the discussion as a concerned abutter. This consists of a 3' retaining wall made necessary because the abutter has not graded his lot according to the approved plan. 9:25 PM E. Loschi moved that the 3' retaining wall on lot 143, Sanborn Village Phase IV (DEP #270-171, RGB #1987-12) be considered an INSIGNIFICANT plan change. VOTED 4-0-1 H. Hulse abstained because he is a concerned abutter. 9:26 PM Recommendation To Fill Commission Vacancy H. Hulse moved that since R. Longley has submitted her resignation from the Conservation Commission to the Board of Selectmen, the Conservation Commission recommend to the Board of Selectmen that J. Biller be appointed a full member of the Commission. VOTED 5-0-0 9:28 PM Administrator's Report 1. Well 82-20 - The haybale line is now finally in place, and has been made double high. The iron is apparently in suspension and still passes through the haybales into the wetlands beyond. J. Lachmayr is concerned with the channeling situation and questions whether the water is allowed to move at too high a velocity as a result. This may exaggerate the problem with the iron reported by the Administrator. The Administrator reports that the levels of organics passing into the wetlands and river are in excess of those allowed. Something must be done about this. 2. R. Longley has submitted her letter of resignation from the Commission. 3. J. Edwards, Town Planner, has sent a congratulatory letter to the Commission on a job well done in FINAL CORRECTED MINUTES 11/28/90 Page 5 regards to the passage of all Conservation Commission sponsored articles on the recent Subsequent Town Meeting warrant. He indicated that the high level of support shown by the Town is very gratifying. 9:47 PM Certificate of Compliance - 16 Margaret Rd. A Certificate of Compliance has been requested for 16 Margaret Rd. (DEP #270-176, RGB #1987-17) by Kevin Fulgoni. The "as-built" plan has been submitted and was accepted and the reseeding is completed. The Administrator indicated that everything appears to comply and recommended that the 25' area of no-activity (to the top of the hill) be maintained in perpetuity and that this area be allowed to return to the natural state. These conditions will be - stated in the Certificate of Compliance. 9:54 PM H. Hulse moved that a Certificate of Compliance be issued for 16 Margaret Rd. (DEP #270-176, RGB #1987-17) with conditions.` VOTED 5-0-0 9:55 PM J. Nickerson moved that the Commission release the bond held on 16 Margaret Rd. (RGB #1987-17 only). VOTED 5-0-0 9:56 PM Discussion with Jonathan Edwards, Town Planner, about the demands on D. Nadeau's time. 10:30 PM Sign Determination of Applicability - 8 Verde Circle The Determination of Applicability for 8 Verde Circle, (RGB #1990-32) was signed. 10:33 PM Certificate of Compliance - 19 Pinevale Ave The discussion of the Certificate of Compliance for 19 Pinevale Ave. (DEP #270-203, RGB #1989-20) will be delayed until next week. 10:35 PM Certificate of Compliance - 106 Sanborn Lane The discussion of the Certificate of Compliance for 106 Sanborn Lane (DEP #270-170, RGB #1987-12) will be delayed until after a site visit scheduled for 12/1/90. 10:36 PM DPW Site Visit The site visit with DPW to discuss the Town drainage issues is scheduled for 12/8/90 at 8:00 or 9:00 AM as determined by DPW. 10:49 PM Adjournment E.
