Hulse 7:10 PM Call to Order The regular weekly meeting of the Conservation Commission was called to order. 7:10 PM Administrator's Report A site visit will be held on Saturday 12/8/90 at 9:00 in the Pasture Road area. Don reminded the Commission that this is to discuss drainage problems both here and in other parts of town with DPW representatives. Mr. Kevin Fulgoni is to receive his performance bond back, but apparently with no interest. The question was raised why such bonds are not put in escrow and whether current bonds are being handled differently than in the past when the funds were placed into general municipal accounts. 7:26 PM Acceptance of Minutes After discussion, J. Nickerson moved that the minutes of 11/8/90 be accepted as amended. Seconded. VOTED 5-0-0 7:32 PM After discussion, J. Nickerson moved that the minutes of 11/14/90 be accepted as amended. Seconded. VOTED 5-0-0 7:33 PM Continued Public Hearing on Lot 112, Sanborn Village Phase IV The Continued Public Hearing on Lot 112, Sanborn Village Phase IV was opened under MGL Chapter 131 §40 (DEP #270-228) and RGB §5.7 (RGB #1990-34). Mr. William Bergeron of Hayes Engineering was present. The report from the Town Engineer was read by the Administrator. Mr. Robertson questioned the cellar floor being lower than approved. Mr. Bergeron pointed out that there is a modified subdivision plan which was accepted by CPDC on 3/27/89 which the Town Engineer apparently does not know of. The cellar floor is in compliance with this modified plan. This situation also applies to lots 128 and 129 of the same development. J. Nickerson questioned the amount of impervious area. Mr. _ Bergeron responded that since a--specific house footprint is not yet available, the maximum allowed is specified to be conservative. Biller questioned the elevation of the road since it is considerably above the natural contour of the land prior to development. Mr. Bergeron responded that this was dictated by the town requirements for the cover over the sewer lines. J. Lachmayr questioned controls during excavation, and the stabilization methods to be used. C. Anthony asked why no retaining wall was specified and was woried about future problems with erosion. D. Nadeau questioned the proposed drainage from the lot. Mr. Bergeron indicated that the front of the lot was to drain to the street and not down into the wetlands. C. Anthony voiced her concern over the potential buyers knowing the problems which may arise with this lot. 8:04 PM J. Lachmayr moved to close the Continued Public Hearing on Lot 112, Sanborn Village Phase IV (DEP #270-228, RGB #1990-34). Seconded. VOTED 5-0-0 8:05 PM Continued Public Hearings on Lots 128 & 129, Sanborn Village Phase IV The Continued Public Hearings on Lots 128 & 129, Sanborn Village Phase IV were opened concurrently under MGL 131 §40 (DEP #270-229, 270-230) and RGB §5.7 (RGB #1990-35, 1990-36). Mr. William Bergeron of Hayes Engineering was present. The question of the minimum cellar floor elevation raised by the Town Engineer was answered previously (see Continued Public Hearing on Lot 112, Sanborn Village Phase IV above) and is in conformance with the modified subdivision plan accepted by CPDC on 3/27/89. The BVW was re-delineated in the past and meets the required performance standards for impervious area . ! within the Aquafer Protection District. The grade of the driveway was questioned in regards to the potential for salt runoff into the wetlands. Mr. Bergeron responded that heating coils could be used and salt use restricted if necessary. The practicality of heating coils was questioned by J. Biller. It was felt that because of the expense, homeowners would be likely to use salt instead of the heating coils and there would be no way of enforcing the restriction on salt. Concern was also raised over driveway wastes draining into the wetlands. D. Nadeau questioned whether catch basins including sumps could be used. The question of the long term maintenance of such structures in a driveway was raised. Mr. Bergeron responded that small sump/gas traps could be used for the driveways and that the homeowner would be responsible for maintenance. Mr. Brad Latham, attorney for the applicants, indicated that a restriction on salt and oil products in the driveway areas was acceptable. J. Lachmayr raised a concern over the rear of the proposed house on lot 129 being so close to the limit of activity. Mr. Bergeron stated that all work will be done from the up-gradient side and that this would not be a problem. 8:26 PM J. Nickerson moved that the concurrent Continued Public Hearings on Lots 128 & 129, Sanborn Village Phase IV (DEP #270-229, 270-230, RGB #1990-35, 1990-36) be closed. Seconded. Voted 5-0-0 -8 i 38- PM- -Certificate of Compliance 19 Pinevale Ave. A discussion was held on the request from Anthony and Barbara FINAL CORRECTED MINUTES 12/05/90 Page 3 DelSignore, 19 Pinevale Ave, for a Certificate of Compliance for the swimmng pool constructed in their rear yard (DEP #270-203, RGB #1989-20). J. Lachmayr read the notes from the site visit by the Commission. The pool appears to be nearer to the house than shown on the plan. The applicant indicated that Mark Boyagian had instructed him not to bother with additional impervious calculations but had agreed with the applicants proposal to eliminate some of the concrete apron on the end of the pool to compensate for the increased width of the apronon the side nearest to the house. Questions were raised about a non-stabilized area of the yard, about a sump pump drain into the wetlands, and what appears to be a fill area. The "retaining wall" consists of two rows of cinder blocks which are not secured in place with mortar or by other means and which was a pre-existing condition. The sump pump drain line was installed several years ago. A question was raised about the concrete apron and the applicant indicated that this was the "decking" referred to in the original application. The sense of the Commission is to require sod for the unstabilized portion of the lawn area, to continue Condition 10 of the Order of Conditions, and to require that the cinder block wall be stabilized with rebars. 9:00 PM Request for Plan Change for Lot 113, Sanborn Village Phase IV A requested Plan Change for Lot 113, Sanborn Village Phase IV (DEP #270-196, RGB #1989-4) was opened for discussion. The Order of Conditions under RGB §5.7 has expired. Mr. H. Butterick was present to represent the owner. The plan changes are due to the fact that the proposed house is smaller than that specified on the original Definitive Plan for Sanborn Village Phase IV (DEP #270-171, RGB #1987-12). The proposed house footprint is less than one-half of the original, no pool or patio is to be built, and a smaller driveway will be constructed. No drywells are to be used. The garage floor elevation is lower at than the original proposal. 9:33 Pm E. Loschi moved that the requested Plan Change be considered INSIGNIFICANT under MGL 131 §40 (DEP #270-196) and RGB §5.7 (RGB #1989-4 (expired)). Seconded. VOTED 5-0-0 9:34 PM J. Nickerson moved that a retroactive extension be granted to RGB #1989-4 to run from 4/27/90 to 4/27/91. Seconded. VOTED 5-0-0 9:45 PM Discussion of Minutes from 11/28/90 9:59 PM E. Loschi moved that the minutes of 11/28/90 be accepted as amended. Seconded. VOTED 4-0-1 (M. C. Proctor abstained) FINAL CORRECTED MINUTES 12/05/90 Page 4 10:00 PM Certificate of Compliance for Lot 106, Sanborn Village Phase IV A request for a Certificate of Compliance was received for Lot 106, Sanborn Village Phase IV (DEP #270-171, RGB #1987-12). The Administrator indicated that lot 106 appears to be in compliance. 10:04 PM E. Loschi moved that a Certificate of Compliance be issued for Lot 106, Sanborn Village Phase IV (DEP 1270-171, RGB #1987-12). Seconded. VOTED 5-0-0 10:05 PM Discussion of potential Vice Chairman candidates for the Reading Conservation Commission. Discussion of the budget for the Commission for the next year. The budget will be submitted as level funded since it consists of only the Administrators salary and a very small travel allowance. 10:11 PM Discussion of a small oil spill in the rear of the Carpenter residence at 114 Hanscom Ave. An oil burner serviceman, working in the house of a neighbor, apparently dumped some oil into a sump which was later pumped to the rear of the yard (which is adjacent to Mr. Carpenter's property) during a subsequent rainstorm. Mr. Carpenter is upset that the town has not pursued the matter further after the Fire Dept. responded to the incident. D. Nadeau will investigate and report to the Commission. He will also either talk to or send a memo to the Fire Department asking them to notify him of any such incidents in wetland areas under the jurisdiction of the Conservation Commission. 10:18 PM Discussion of Orders of Condition Discussion of the Orders of Conditions for Lots 112, 128, 129, Sanborn Village Phase IV. The Commission felt that the use of salt on the driveways should be restricted, along with oil and petroleum wastes which may drain into the wetlands. Some erosion control is needed along the driveway of Lot 128 with vegetation of some sort planted to slow the rate of runoff. New plans with proper legends and benchmarks are needed. 10:37 PM Adjournment M. C. Proctor moved to adjourn. Seconded. VOTED 5-0-0 Respectfully submitted J. Biller Assoc.
