Kathy Klaus of Weston & Sampson presented the project. D. Nadeau gave the administrator's report. The lagoon is con- sidered Land Under Water. However, D. Nadeau felt that the interests do not need to be appl=ied to the lagoon. The Commission was concerned with iron and manganese currently being discharged to the wetlands near the c.learwell. During construction, approximately 50,.000 gpd will dis- charge to the sludge lagoon. Discharge will occur over a two to three month period. J. Lachmayr asked if an en- gineer would be on site during construction to enforce com- pliance. She also asked if Water Quality Certification is required. C. Anthony stated that calcium chloride is not. to be used in this area. W. Robertson said water should be used for control of dust. C. Anthony asked about sludge disposal. It will be removed during construction. J. Nickerson wanted to know what the water elevation in the wetland. is. J. Lachmayr requested that specific, discharge points be labeled with more detail in regards to placement, of ha.ybal.es, removal of sediments, velocity of discharge, and water quality. D, Nadeau suggested that alternate dis- charge locations be considered. J. Nickerson said she would like more information on the excavation before the next meeting. 7:3a C. Anthony re--- quested- that any pertinent -information be delivered to the Commission one week prior to the meeting. He indicated that the report showed "nothing; of .great concern" in regards to aquifer contamina- tion. H. Biller asked if the areas of concern were tar- geted. They were not. He also asked if the testing was coordinated with D. Nadeau, It, was not. P. Ogren was not, aware of the applicant's attorney's agreement to notify the Commission prior to any on-site activity (the agreement was made at the May 28th meeting). Mike McCafferty of Emerson Street, distributed a memo con- cerning contaminants in the Mystic River fill that was al- legedly dumped on site. ' Bill Murphy of 65 Dividence Road suggested that a joint, meeting of the Conservation Commission, CPDC and the neigh- bors be held prior to any work. 8:10 Moved to continue until July 24, 1991 at 7:40. Nadeau commented that, this is a very small area. Motion to issue Certi ficate of Compliance with conditions. Seconded. VOTED 6-0-0 8:25 Dol,- on _~-Q.8 M In Street A Violation Notice was mailed June 11, 1.991 because an. open foundation within 100' of the wetlands was being filled without a per- mit. Mr. Minotti stated that, he was merely pushing fill back into the hole it had been removed from. C. Anthony told Mr. Minotti that his actions were in violation of the Wetlands Protection Act,. If he does not, file a request for Determination by July 10, the Commission will take action. J. Biller gave notice that no work can proceed until the violation is resolved, The Minotti ::s are subject. to fines if they continue to disregard the violation notice. The request was carried over until the July 10th meeting. Edie Netter did not come to discuss an appeal. She would rather avoid an appeal entirely. Hulse did not want to dis- cuss a land swap/donation. until the violation had been resolved. Although the Town Engineer had in- spected the site and found it to be in compliance with the submitted plans, D. Nadeau had not reviewed the site. C. Anthony expressed concern about releasing the bond and signing the Certificate of Compliance before plans were even submitted to the Commission. The closing for Lot 13 was scheduled for June 27, 1991. Motion to issue a Certificate of Compliance for lot 13 of Ashley Woods. Seconded. VOTED 6-0-0 The remainder of the subdivision will be reviewed on July 1.0, 1991. 9:40 There will be a meeting of the Ipswich Diver Watershed Com- mittee on July 17 , 1991 at 3:30 p.m.. L. Kenney commented that he had found a vernal pool and black ash swamp on land that will be covered by the riverways Program. 9:52 Meeting adjourned.
