Town Counsel H. Theodore Cohen arrived. 7:02 Motion made and seconded to enter Executive Session to dis- cuss litigation concerning files #1991-03 and #1991-06. Nadeau presented comments and referenced his memo to the Commis- sion dated August 6, 1991. J. Biller asked why the applicant was bringing fill onto the property and placing it without knowing where the property line is. Mr. Rindone replied that it was an e rror of the contractor piling the fill in the wrong areas, the two times fill. was brought in. J. Biller said he had been to the site twice, and each time the fill had been in- creased. Mr. Rindone said he met with both D. Nadeau and Building Inspector Stuart LeClaire earlier, and it was his understanding that there were no violations at that tim e. J. Lachmayr asked why fill was being brought in if the plan is to remove fill and restore the back yard. Mr. Rindone replied that he has been filling for a long time, so our filing is in the middle of the project. L. Kenney said that he does not feel there is a wildlife benefit to having the field mowed. He asked how long the fill has been placed. Mr. Rindone replied that it has been since last fall. L. Kenney believes it has been since Spring 1990. 8:27 Motion made and seconded that the public meeting RGB# 1991-23 be continued to August 28, 1991 at 9:40 PM. VOTED 4-0-0 8: 34 _Fermi-t_ - B_i _.Q . Meadow Estates, RGB# 9~ (D 0. Bradley Latham, representing the applicant, requested an extension of the Order of Condi- _ tions to June 30, 1992. The original filing was made on January 6, 1989. D. Nadeau noted that the Order expired under RGB,in December 1990. J. Lachmayr asked what the current construction status is. B. Latham said construc- tion is planned to begin in late spring 1992. Motion made to retroactively extend the Order under RGB# 1989-3 from 1990 to December 14, 199 1 . Motion made and seconded to modify original motion to include the extension being contingent upon verification that the appeals were withdrawn. Bradley Latham, Esquire and Deborah McCartney of Haves Engineering, Inc., representing the applicant,, requested an extension of the Order of Con- ditions to September 14, 1992. Attorney Latham stated that the property owners are not developers, and they do not have the financial means to develop at the present time. Nothing has been done on the property. It remains in its natural state. 8:52 Motion made and seconded to grant the Extension Permit un- der RGB# 1990-23 to September 14, 1992. He asked why there is silt fence in one area and only haybales in another. Mr. Murray said he installed the silt fence as an extra protective measure. Driveway aprons, sidewalks, curbing, roadway and utilities are installed. The silt fence is in disrepair. D. Nadeau requested that the extension only be issued after the silt fence is repaired. Mr. Murray said he would fix the fence the next day. 8:59 Motion made and seconded to grant, the Extension Permit un- der RGB# 1989-19 to August 2, 1992. VOTED 4-0-0 Tom Murray will call D. Nadeau when the silt fence is repaired. 9:15 The Commission discussed the Rules and Regulations defini- tions. Nadeau commented about his inspection. C. Anthony asked why all these presentations for drywells to mitigate for impervious area are being presented piecemeal. Why are detention areas designed if, then, almost all of the run-off will be put into drywells? J. Lachmayr stated they are changing the water flow concep- tual design for the entire development, switching from overland flow to direct ground recharge. D. Nadeau said in his opinion the 'groundwater' type direct recharge is more desirable than the overland flow to the wetlands. C. An- thony said that this entire area is very wet already. 10:15 Motion made and seconded that the plan change for Lot 35 Fairwood Acres is a significant change. VOTED 4-0-0 10:30 The Commission discussed with the administrator problems with the administrator's participation during the discus- sion on Lot. 35 Fairwood Acres. Specific comments included: recognizing where the line is between providing technical expertise and policy issues direction; the administrator is a good technical resource upon whom the Commission relies; he should not have given examples of other dry wells that have been accepted -.the issue was whether it was significant vs. insignificant, 11:05 The Commission requested that the Engineering Division determine the boundary between the Fantasia property at the end of Terrace Park Drive and Kurchian Woods Conservation Area. 11:07 Motion made and seconded to adjourn.
