HomeMy WebLinkAbout1994-08-24 Conservation Commission Minutesc L BEADING CONSERVATION COMMISSION Minutes of August 24, 1994 Meeting No. PRESENT: Chair, James Biller; Vice-Chair, Stephen Chapman; Harold Hulse; Nancy Eaton; M. Clifton Proctor; and Joan Nickerson; Associate Member Leo Kenney, arrived at 7:30; and Conservation Administrator, Donald Nadeau ABSENT: None 7:00 PM: The chair called the meeting to order and reported: 1. That the Selectmen would be discussing Mr. Nadeau's position at their meeting on September 6. He encouraged other Members of the Conservation Commission to attend as well. 2. The appointment of a new member would be made at the Selectmen's September 27 meeting. 7:10 PM: DISCUSS POLICIES: Significant Plan Change Requirements: The Committee is attempting to avoid ambiguities on the matter of plan changes. Issues discussed: Appending a plan change to original plan of record and the subsequent conditional change. Mr Nadeau commented that he had distributed a plan change form to the Members stating that Orders of Conditions could be written more specific and that insignificant plan changes would supersede the original. However, he added that the state law is such that significant changes, as designated by the Members, would require a hearing followed by an Amended Order of Conditions. Additional conditions would be handled with a New Order. 7:20 PM: Open Space Requirements: Ms. Eaton and Ms. Nickerson distributed copies of the completed Open Space Requirements project. A meeting to discuss the'same would be held on Thursday, August 25, 1994. Chairman Biller thanked Ms. Eaton and Ms. Nickerson, on behalf of the whole Commission, for the hard work and many hours devoted to the project. 7:30 PM: PUBLIC HEARING - "ASHLEY PLACE - PHASE III" DEP 1270-xxx, RGB# 1994-20 Michael Rosati, representing David Johnson of Marchionda & Associates Inc., was present to address the Commission. Reading Conservation Commission Minutes - August 24, 1994 2. Issues Presented: This project involves the extension of Ashley Place approximately 75' for an additional lot for a single family home. Most of the proposed construction, the storm water detention facility, as well as a portion of the drain line draining the cul de sac will be within the 100' buffer zone. Some of the work associated with the extension of the road falls over the property line onto the next lot (Lot 22), 1100 Main Street. No filling of the resource area is proposed. The project involves the addition of some impervious areas. The existing drainage has been compared and is the same as the proposed area. Administrator's report: The Conservation Commission is awaiting a response from the Engineering Department with regard to hydraulic calculations. Issues discussed: Proponent agreed to a requirement of 7.0" for the hundred year storm versus 6.5" to ensure the enforcement of the Wetlands Protection Act; applicant is to review the rain fall deposition;- concern about necessity of taking trees for the detention area; drainage tie-in to two catch basins; proponent's assurance that 30' run-off pipe along lot line allege would have no impact; proponent's standard practice and explanation of using detention basin as sedimentation basin during construction; proponent's agreement to change plans to reflect 3 to 1 on each side of the earth berm; and revision of rainfall depths. With the absence of a DEP number, Mr. Rosati agreed to an extension of this public hearing until September 7, 1994. Audience participation: Gary Doodlesack, 38 Ashley Place, asked if the current plans would affect the existing detention area, and Mr. Rosati responded that it would not. MOTION - A MOTION WAS MADE AND SECONDED THAT THE PUBLIC HEARING ON "ASHLEY PLACE PHASE III WOULD BE CONTINUED UNTIL SEPTEMBER 7, 1994. VOTED - 6-0-0 8:00 PM: VIOLATION - 404 WEST STREET: Administrator's report: The homeowner submitted an application on August 24, 1994. A hearing is scheduled for September 7, 1994. Audience participation: The daughter of Mrs. Robert Duffy, the homeowner, was present to address the commission. She stated that the homeowner had received approval from the Department of Public Works to install a catch basin in her driveway. They had not been aware that the Conservation Commission required a Request for a Determination. Reading Conservation commission minutes - August 24, 1994 3. 8:30 PM: CONTINUED PUBLIC MEETING - 19 HAROLD AVENUTs Michael Zardi, representing Rock Hill Development, was present to address the Commission. Issues presented: Site was revisited after the Commission had expressed concern relative to the original flagging; vegetation coverage had changed, and the site has been ref lagged; A & B series of reflagging was explained as it is shown on the new site plan; there is added detail in new site plan as requested. Administrator's Report: Subdivision plan had been withdrawn because of significant change in the wetlands. A new filing is expected; revised plans have been submitted. Issues discussed: Commission commented that there were a lot of freshly mowed, disturbed areas between #11 and #17 making it was difficult to distinguish vegetation; there was a question of whether fill had been added to a wetland area; on the new plan, the Conservation Administrator advised moving #1 northeast 25' to stone wall and #3 east 41; another site visit is required. Audience participation: Edward Mahoney, 19 Harold Avenue, commented that to his knowledge, nothing had been filled in since 1976. Fred Boni, 116 Van Norden Road, abutter, justifying his mulch pile, commented that approximately six years ago he had received a Determination that all of the land was not wetland. It was agreed by all parties to continue the hearing until September 21, 1994. For that hearing, the proponent will: obtain more soil samples; present a re-evaluation of wetland vegetation between sites #1 and #11,• reconsider the wetland line between #1 and #17, and take soil samples from #A4 - #A7 in the path. MOTION - A MOTION WAS MADE AND SECONDED FOR A CONTINUANCE OF THE PUBLIC HEARING - 19 HAROLD AVENUE - RGB# 1994-18, UNTIL SEPTEMBER 21, 1994. VOTED 6-0-0 9:05 PM CONTINUED PUBLIC HEARING - "FIMCDU N CIRCLE" DEP # 270-261, RGB# 1994-16 William Bergeron, P.E. of Hayes Engineering, Inc. and O. Bradley Latham, Esq., both representing the applicant, William Andrews, were present to address the Board. Mr. Hulse elected to abstain from this hearing. Issues Presented: Concerns from previous meeting resolved, i.e., revised hydraulic calculations reviewed by Mr. Robinson and submitted to Conservation Commission, and incorporated into new Reading Conservation Commission Minutes - August 24, 1994 4. plan; plans have been severely modified; Best Management Practice Techniques incorporated with regard to gas traps. Mr. Bergeron stated that he had had satisfactory discussions with DPW and Engineering and Board of Health regarding the alternate catch basin and; the proponents also discussed the modified sewer manhole. Administrator's Report: Mr. Nadeau will send a draft Order of Conditions to the members to be discussed at the next hearing. Issues Discussed: silt fence to save trees on the south side; reiteration by Commission regarding the sensitivity of saving trees. Proponent will incorporate notes relative to requested revisions, and will submit a letter to commission. There was no audience participation. MOTION - MADE AND SECONDED TO CLOSE THE CONTINUED PUBLIC HEARING - "FIENEMANN CIRCLE° DEP 1270 -261, RGB # 1994--16 VOTED 5-0-1 (Mr. Hulse abstained) 9:30 PM PARTIAL CERTIFICATE OF COMPLIANCE - LOT 10 (134) ROMA LANE - DEP 0270-227, RGB# 1990-33 Commission Members commented that after a site visit it was determined that recent plantings were in poor condition. Administrator's Report: based on soil, the RGB wetland ZNV encroaches upon area where homeowner wants to put a lawn. The homeowner may re-establish the ZNV, to slope down within 251, and establish the line with plantings. Currently there are hay bales establishing the lines, and the Administrator is relying on the Commission's inspections for homeowner's compliance. Issues Discussed: Partial Certificate of Compliance with expressed provision that visual demarkation is placed as a barrier to mowing .and that natural vegetation be re-established. MOTION - MADE AND SECONDED TO ISSUE A PARTIAL CERTIFICATE OF COMPLIANCE WITH STANDARD CONDITIONS THAT VISUAL DEMARKATION TO EDGE OF LINE BE PLACED AS A BARRIER TO MOWING AND THAT NATURAL VEGETA- TION BE RE-ESTABLISHED AND TO CONTINUE WITH ORIGINAL ACTS OF REGULAR ORDER AS APPROPRIATE. VOTED 5-0-1 (Mr. Hulse abstained) OLDIM BUSINESS: • Sign-Off: 19 Buckskin Drive - Tree Removals Mr. Nadeau commented that there are six trees to remove in the buffer zone; they are well away from the wetlands.
