READING CONSERVATION CON14ISSION

Minutes of September 7, 1994 Meeting No.
PRESENT: Chair, James Biller; Members Nancy Eaton; M. Clifton Proctor; Joan
Nickerson; Associate Member Leo Kenney and Conservation
Administrator, Donald Nadeau
ABSENT: Harold Hulse and Vice-Chair, Stephen Chapman
7:00 PM: The chair called the meeting to order and reported that through
continued negotiations with the Town Manager, the salary classification
increase for conservation Administrator (from 11, Step 6 to 13, Step 1) was
approved by the Selectmen as presented, subject to approval of the necessary
additional funding at the Fall Town Meeting.
Approve Draft Minutes of 8-24-94
MOTION - A MOTION WAS MADE AND SECONDED TO APPROVE THE MINUTES OF AUGUST
24, 1994 AS AMENDED. VOTED - 4-0-0
Discuss Policies:
1. The Commission was unable to discuss policies due to the
Certification of Emergency. However, the importance of allocating time
for the review of policies and plan changes was expressed. Mr. Biller
suggested taking the first agenda item, other than policy and minutes,
at 7:45 PM.
Certification of Emergency - Imagination Station Birch Meadow _Drive; Ruth
Cogan, Director of Public Health
Issues Presented: Ruth Cogan, Director of Public Health and Richard
Hatfield of Waltham Chemical were present to address the Commission regarding
the Emergency Certification issued on September 1, 1994. The Certification
was subject to ratification by the Conservation Commission. Ms. Cogan, Mr.
Hatfield, and Mr. Kenney agreed that there is extensive rodent activity in
the banks of the Aberjona River at Imagination Station. Ms. Cogan requested
approval to cut down the brush from the culvert behind Imagination Station to
the area around the football field. The burrows in this area would be
treated with anti-coagulant bait traps. The park would be closed while the
area is treated. To alleviate the situation, no food would be allowed when
the park is reopened.
Issues Discussed: The Commission expressed concern for the woody vegetation
around the river. Also, they requested that fencing be erected in the area
where the traps would be set. Ms. Cogan agreed with the Commission.
MOTION - A MOTION WAS MADE AND SECONDED TO APPROVE THE EMERGENCY
CERTIFICATION DATED SEPTEMBER 1, 1994 AS WRITTEN WITH AN AMENDMENT STATING
THAT THE BEST EFFORT WOULD BE MADE TO RETAIN THE WOODY VEGETATION UNDER THE
SUPERVISION OF THE CONSERVATION ADMINISTRATOR. VOTED - 4-0-0

7:30 PN: Order of Conditions - Fienemann Circle
DEP# 270-261,RGB# 1994-16
The Commission reviewed the "Draft" for the generic order of Conditions
and discussed additions and alterations. A discussion with regard to final
site inspections and the resulting issuance of Certificates of Compliance was
held. Mr. Nadeau commented that the original and new changes to the general
boiler plate of the Order of Conditions would be on the agenda for the
September 21, 1994 meeting.
MOTION - A MOTION WAS MADE AND SECONDED TO ACCEPT AND ISSUE THE DRAFT OF THE
ORDER OF CONDITIONS- FIENEMANN CIRCLE, DEP# 270-°261, RGB# 1994-15, AS AMENDED
AND APPROVED. VOTED - 3-1-0
Discussion: For the purposes of issuing the Order of Conditions for
Fienemann Circle within the twenty-one day deadline, the above vote was
reconsidered.

MOTION - A MOTION WAS MADE AND SECONDED TO ACCEPT AND ISSUE THE DRAFT OF THE
ORDER OF CONDITIONS FIENEMANN CIRCLE DEP# 270-261, RGB# 1994-16, AS AMENDED

"8:15 PM Plan Change-Lot 3 Nugent Lane, DEPT 270-248, RGB# 1992 24
James Nugent and Attorney Latham, representing Mr. Nugent, were present to
address the Commission.
Issues Presented: Mr. Latham explained that as requested by the Commission,
additional drainage calculations had been submitted for the 10 and 100 year
storm frequency as well as a statement describing the impact of these
calculations. The original, approved plan showed a footprint of 768 square
feet, and the proponent was requesting approval to increase the footprint by
approximately 400 square feet bringing the proposed dwelling a few feet
closer to the BVW. The dwelling is outside the 25' zone of no activity,
however, it does go into the 101 foundation set back. Mr. Latham commented
that a second leaching pit would solve any issues of drainage.
Issues Discussed: The Commission suggested solid, visible encroachment
barriers such as plantings. Also suggested was a covenant in the deed
indicating a restriction with no ability to move closer to the BVW. The
Commission suggested that a temporary fence be erected while the construction
is going on to prevent further encroachment. The proponent agreed with the
suggestions.
Administrator's Report: Mr. Nadeau commented that the submitted plan does
not show the replication BVW and its ZNV, and that the house is proposed over
25' from the ZNV that is shown. He added that the wetland is oversized and
that some deviation could be allowed immediately adjacent to the house.

The Commission commented that a revised plan would be required to include the
3' leeway on the back of the house, as well as the location of the permanent
barriers.
NOTION - A MOTION WAS MADE AND SECONDED THAT THE CONSERVATION COMMISSION
INTENDS THIS REQUEST TO BE AN INSIGNIFICANT PLAN CHANGE AND THAT THERE BE A
3' VARIANCE WITH THE 25' BUFFER ZONE IN THE REAR OF THE HOUSE TO ALLOW
ADEQUATE ACCESS. THE FINAL DECISION WILL BE BASED ON HAVING A COMPLETE AND
CLEAR PLAN AS DISCUSSED AT THE SEPTEMBER 7, 1994 MEETING. VOTED 4-0-0
8:50 PM Continued Public Hearing - Ashley Place III
DEP# 270-262, RGB # 1994-20
David Johnson, for Lots 21 & 22 Ashley Woods III, and Paul Marchionda of
Marchionda & Associates, Inc., Engineering and Planning Consultants, were
present to address the commission.
Issues Presented: Mr. Marchionda reported that they had addressed all the
concerns discussed at the previous meeting, i.e.: 1.) additional drainage
calculations were prepared for the 10 and 100 year storm frequency using the
rainfall depths outlined in 310 CMR 10.57.3a.; 2.) the side of the
vegetated side slope would be sloped at 3' to 110 3.) and the crushed
stone around the temporary standpipe had been reduced from 3" to 1 1/211
stone. He stated that no drainage problems would incur from this project.
Mr. Johnson agreed, upon the Commission's request, to dispose of the debris
that had been dumped in the wetlands.

9:05 PH Continued Public Meeting - 404 West Street

Administrator's Report: Mr. Nadeau explained that drainage work was being
performed at 404 West Street without approval from the Conservation
Commission. A stop work order had been placed. Mr. Nadeau continued that an
application had now been submitted for an underground driveway drain catch
basin with a drain, across the front of the lawn emptying into a crushed
stone bed.

AT 9:15 PM. VOTED - 4-0-0
NOTION - A MOTION WAS MADE AND SECONDED TO ISSUE A NEGATIVE DETERMINATION FOR
404 WEST STREET, RGB# 1994-21, WITH THE STANDARD CONDITIONS, AND THAT IT BE
INSPECTED BY THE CONSERVATION ADMINISTRATOR BEFORE COMMENCEMENT OF WORK.

s Approve Draft Restoration Plan-- Water treatment Plant Wetland
Mr. Nadeau commented that he is currently in the process of drafting the
Restoration Plan and that the completed portions would be mailed in the
packets for the next meeting. He requested that the Commission waive
the other requirements of the order to file a Notice of Intent provided
the commission has their input into the Wetlands Restoration Plan.
Sign-off - 71 Lilah Lane - Mr. Nadeau reported that he had signed off on
71 Lilah Lane. No further commission action was required. He added
that there is a mapped vernal pool to the right of the site, but that
the wetland in that location does not come up 25' away from the work.
♦ Approve Finding of Incomplete NOI - Willow Street - Mr. Nadeau reported
that he had rejected this item as it was incomplete. His recommendation
was that the Commission also reject it.
NOTION - A MOTION WAS MADE AND SECONDED TO AGREE WITH THE CONSERVATION
ADMINISTRATOR'S FINDING THAT THE FILING FOR THE WILLOW STREET SITE WAS
INCOMPLETE. VOTED - 4-0-0
• Varney Circle - Paving Stones - Mr. Nadeau reported that paving stones
have been ordered, and that a request for approval of trees at this site
would be before the Commission on September 21.
• Citizen's Time - Mr. Nadeau reported that the Board of Selectmen allow
a short citizen's time at the beginning of their meetings, and that they
suggested the Conservation Commission do the same.
Other Correspondence
Beth Klepeis: Final Decree - Map 42 Lots 28, 29, 30 Maple Street
This property, which is owned by the Town, was before the commission once
before, but not acted upon. Mr. Nadeau is placing it back before the
Commission for consideration as part of the Open Space Subcommittee.
Ms. Eaton distributed sheets relavent to the Open Space project. Mr. Nadeau
thanked her for her work on the this project.
