Minutes of March 15, 1995 Meeting No. 08

7:04 PM The meeting was called to order.
Public records law discussion. Steve Chapman left 7:15 p.m..
200 Grove Street. Order of Conditions violation. Aplicants Peg &
Charles Keniston were present.
Motion made and seconded to issue Enforcement Order 200 Grove
Street to Peg and Charles Keniston. VOTED 4-0-0
Important details of Enforcement Order:
o Work proceeded with an incorrect haybale line and without
approval of the haybale line by the Administrator.
o Pine branch pile and log pile in shall be removed from
BVW/ZNV, and natural debris shall be left alone.
o Work occurred on the slope beyond what was authorized.
o No on-site dumpster or evidence of trash hauling contract.
Debris including appliances shall be disposed of.
o Fate of two fuel storage tanks unkown - receipt for disposal
shall be provided.
o Disturbed areas of protected natural vegetation shall be re-
stored prior to other work on the site.
Response to Notice - 1127" Grove Street driveway DEP# 270-253,
RGB# 1993-17 Driveway owner Lou Silva, 19 Grove Street, and
Larry DeSanto, 15 Grove Street were present. Mr. DeSanto ran a
hose at the northwest corner of his driveway for the Commission
members who attended the weekend site visit. He reported that
the water builds up to 1-1/2" deep and very little goes into the
drywell (5% max.), some goes back toward his house, and some goes
by the drywell. Members confirmed this, adding that the water
bypassing the drywell runs off the driveway before reaching the
gravel drain strip, and that water placed at Mr. DeSanto's
walkway drains off the southeast corner of his driveway, where
there is major erosion.
The members also noted changes: rip-rap wall west side of
driveway at #19 and catchbasin at its northeast end, and front
house parking changed. Mr. Silva recommended that the gravel
around the catchbasin- be paved over to reduce maintenance. The
members concluded that the patch was not adequate and the
driveway section must be rebuilt, and the applicant shall be

required to demonstrate that all water in the catchment area
flows directly and completely to the central catchbasin as
designed and approved.
Public Hearing Lot after 150 Van Norden Road DEP# 270-xxx, RGB#
1995-08 Applicant Don Johnston and Botanist Elizabeth Wallis
were present. He proposed the cellar floor to be at plan eleva-
tion 124, garage at 123.5 and top of foundation at 127.5, with
six feet of fill around the covered deck, and the driveway to
drain toward the street. Only wetland flags around the work area
were shown on the plan. He asked to remove a half-dead veteran
white pine in the front, and to remove a lot of dead trees at
flag ##71 and a junk pile at the haybale line. Three abutters ex-
pressed their concerns with drainage. Some members had done a
site visit and questioned parts of the proposed wetland line.
The Commission considered allowing some safety work in the ZNV,
and called for a new site visit.
Motion made and seconded to continue the Public Hearing Lot after
150 Van Norden Road DEP# unknown AGB# 1995-08. to 3-29-95 at 8 PM
with consent of the applicant VOTED 4-0-0
9:25 recess. 9:34 meeting resumed.
Public Hearing - Lot before 114 Haverhill Street DEP# 270-xxx,
RGB# 1995-09 Applicant Gary Litchfield and Botanist Rob Marini
were present. Mr. Marini reviewed the proposed wetland line.
Some members had done a site visit and questioned parts of the
proposed wetland line. The Commission called for a new site
visit.
Motion made and seconded to continue the Public Hearing Lot
before 114 Haverhill Street no DEP# RGB# 1995-09 to 3-29-95 at
8:30 PM VOTED 4-0-0
Old/New Business:
o Route 93 gas spill DEP# 270-246, RGB# 1992-21 The members re-
quested that the Order be checked for the expiration date
and for any bond.
The 3-22-95 policy meeting was cancelled.
