Clifton Proctor Leo Kenney and Conservation Administrator: Donald Nadeau 7:12 Pm S. Chapman called the meeting to order. Sub-Commi ~ Reports N. Eaton reported the following concerning May; lr) n Space and Recreation Plan: a. N. Eaton is in receipt of plans (my b. Town Manager requested that Commission draft a letter regarding said plans by the middle of c. Commission agreed to review plans and discuss letter draft on 5/10/95 meeting; and d. Grant application with Middlesex Conservation District: awarded $350.00. Old Business: Plan Chan e - 200 Grove Ctr~t R dingy. MA DEP# 270-265, RBG# 199428 Site Visit of April 23, 1995 was read into record. Recommendations: Commission considered to allow plantings beyond haybale line with an approved submitted plan. Activity on house and area within 25' buffer zone approved. A "Planting Plan" including tree plantings to replace trees behind haybale line from Keniston's requested by Committee. Continued "cleaning" will be monitored by Committee. Previous violation lifted. Conservation Administrator may sign Building Permit. Motion made and seconded Applicant to that Applicant complied with enforcement action and Commission will allow proceed with construction at 200 Grove Street, Reading, MA. Voted: 6-0-0 7:43 pm Continued Public Hearin - Franklin Street Cemetery DEP# 270-269, RBG# 1995-10 (Public participants sworn in) Plan revision submitted at meeting. Points of discussion: a. 5' Pathway leading to wetlands (Conservation easement vs. Deeded easement) b. Committee requested longer review time for April 26th submitted materials; c. Committee requested that all trees along rock wall be specifically sited on plan in conjunction Tree Warden (Site visit); 3 with d. Adverse affect of 10' fill increasing slope abutting wetlandor r°-= ~==•.ti. t1Vill uwner or '6 Batchelder Road read into record; and f. Jon Ewing of Partridge Road expressed concerns. MOTION made and seconded to continue hearing for purpose of reviewing newly submitted materials with the intent that issue will be closed at the May 10, 1995 meeting. VOTED: 6-0-0 9:07 pm Public Meeting - Townwide railroad right of way RGB# 1995-11 Discussion concerned herbicidal spraying of tracks. Wayne Duffett of TEC Associates was present. He and the Administrator visited and revised "No Spray Zones" and "Limited Spray Zones". Mr. Duffett agreed to provide Material Data Safety Sheets disclosing herbicide information with the Yearly Operating Plan requested by Joshua Drexler. MOTION made and seconded To issue Negative Determination on townwide railroad Right of Way RGB #1995-11 citing in #-4 310CMR 10.03 6(b) VOTED: 4-1-0 J. Drexler against 9:45 pm Public Hearing-Plan Change, Lot #1 Carriage Estates R (66 Roma Lane) DEP# 270-236, RGB# 1991-10 (Public participants sworn in: H.Hulse abstained) April 23, 1995 Site Visit read into record. Major concern: "Too much house on too little lot." Downsizing house would violate Covenant stating 2,800 sq. ft. of living space. John Danamiller of 54 Roma Lane express concern about the stone wall boundary. Commission suggested that specific provisions be made in Purchase & Sale Agreement, Deed and Order of Conditions. MOTION made and seconded to continue Public Hearing to provide additional information on May 24, 1995 at 8:30 pm. VOTED: 4-0-1 H. Hulse abstained. 10:40 pm Violation - 352 Charles Street RBG# 1993-11 April 23, 1995 Site Visit read into record. Violations cited by Conservation Administrator were not observed during the above-mentioned site visit. MOTION made and seconded to rescind citation and fines. Work inside silt fence may continue by home owner. VOTED: 5-0-0 Old/New Business: 10:52 pm Determine RGB Jurisdiction -38 Ashley Place MOTION made and seconded to waive requirement to file, that applicant continue with plans and applicant submit a revised Plan of Land showing ZNV line. Applicant agrees to no activity in ZNV area. VOTED: 4-1-0 N. VOTED: 5-0-0 11:20 pm Partial Certificate of Co Mliance - Impervious area out of 100' Buffer Zone - Lot #5 47 Roma Lane DEW 270-227, RGB# 1990-33 RECOMMENDATION: Action on Partial Certificate of Compliance postponed due to the following reasons: a. Require as-built plans; b. Impervious area 22% exceeds zoning; c. Town Forest encroachments - status of trespass; d. Letter to Zoning Board of Appeals; and e. Applicant/Representative must be present. m 11:45 pm Joint CPDC meetiig scheduled for July 5. 1995 at 7:3012 11:50 pm Motion made and seconded to adjourn.
