Clifton Proctor Vice Chairperson: Stephen Chapman 7:17 pm Harold Hulse, Acting Chairperson called the meeting to order. MOTION made and seconded to accept Minutes of 4/12/95. VOTED: 4-0-0 MOTION made and seconded to approve Minutes of 4/26/95 as amended. VOTED: 4-0-0 Old Business: Complaint - Lot #4 Autumn Lane: Detention Area DEP #270-251, RGB# 1993-03 Present: Nancy Huntington Stage and James E. Stager: Owners Peter DeGennaro: Developer/Builder Presidential Real Estate Corporation Owners presented several specific concerns regarding the construction of the detention area stating that said construction was not as per specs of the original plan presented to them by the Developer/Builder. The poor construction has caused erosion, puddling and a less than 10' buffer zone between new dwelling on Lot #5 and existing detention area. Owners requested that detention area be brought up to standards prior to issuing Lot #5's Certificate of Occupancy. order of Conditions states that an "as ' built" plan be submitted twenty-one days prior to issuance of Certificate of Occupancy. Submission deadline: May 13, 1995. Violation -Lot #4, 5 Varney Circle DEP #270-249 RGB #1992-25 Present: Robert Connelly: Owner Peter DeGennaro: Developer/Builder Presidential Real Estate Corporation MOTION made and seconded that Commission instruct Administrator to test the site for both presence and depth of glass found; empower Administrator to determine, based upon findings, depth of fill to be removed from site; and direct Developer/Builder to remove fill to determined depth and replace same with clean fill by May 19, 1995. VOTED: 4-0-0. 8:50 pm Continued Public Hearing - 114 Haverhill Street DEP #270-XXX, RGB #1995-05 MOTION made and seconded that Continued Public Hearing - 114 Haverhill Street, DEP #270-xxx, RGB #1995-05 be closed. VOTED: 5-0-0. 9:21 pm Public Meeting - by 228-252 Main Street, RGB #1995-12 H. Hulse momentarily out of room. MOTION made and seconded that Public Meeting - by 228-252 Main Street, RGB #1995-12 be continued to June 7, 1995 at 8:30 pm at request of Applicant. VOTED: 4-0-0 9:28 pm Partial Certificate of Compliance: Lot #4, 37 Roma Lane DEP #270-227, RGB # 1990-33 H. Hulse retuned. May 7, 1995 Site Visit read into record. MOTION made and seconded that Partial Certificate of Compliance be approved for Lot #4, 37 Roma Lane, DEP #270-227, RGB #1990-33. VOTED: 4-0-1 H. Hulse abstained. 9:35 pm Partial Certificate of Compliance: Lot #5, 47 Roma Lane DEP #270-227, RGB #1990-33 May 7, 1995 Site Visit read into record. MOTION made and seconded to postpone a discission of approval/denial of Partial Certificate of Compliance to ascertain more information concerning Lot #5, 47 Roma Lane DEP #270-227, RGB #1990-33. VOTED: 4-0-1 H. Hulse abstained. 9:55 pm ZNV only-Lot 104 Sanborn Village Phase IV (71 Lilah Lane) DEP #270-171, RGB# 198712 May 7, 1995 Site Visit read into record. Discission by Commission postponed. Commission agreed to have dead trees replaced by 2" Red Maples. 10:03 pm Continued Public Hearing - Franklin Street Cemetery DEP #270-269, RGB #1995-10 Present: Robert Keating Mr. Dickey, Tree Warden Commission discussed that "Work line" to be amended on recorded Plan of Land so that it may be referenced in Order of Conditions. Easement to go all the way back to Conservation Land. Straighten line form Flags 8-11: Large Tree at Flag 10 to be preserved. MOTION made and seconded to close Continued Public Hearing - Franklin Street Cemetery DEP #270- 269, RGB #1995-10. VOTED: 5-0-0. Sub-Committee Report: Open Space & Recreation Plan MOTION made and seconded that Commission reviewed, approved of and endorses the Open Space & Recreation Plan with the one concern that the Commission be insured representation on the proposed open space body discussed in document and that said ,body ,include onemember-or _designee of the May 10, 1995 Page 2 Conservation Commission. VOTED: 5-0-0. 11:20 pm Commission discussed the draft of Order of Conditions Re: 114 Haverhill Street. 11:31 pm MOTION made and seconded to adjourn. VOTED: 5-0-0.
