Minutes of the Reading Conservation Commission
September 13, 1995 - Meeting No. i
Present: Nancy Eaton, Stephen Chapman, Harold Hulse, Joshua Drexler,
and Leo Kenney and Joan Nickerson, Associates.
David Danis present 7:30 - 8:45 pm
Michelle Keating. (new appointment - not sworn)
Absent: M. Clifton Proctor
Meeting was called to order at 7: 10 pm. Recording Secretary was not present due to illness.
Administrator was on vacation. N. Eaton welcomed Michelle Keating as anew member,
reviewed items from CPDC and Selectmen's meetings.
7:20 pm. Motion to approve and issue Emergency Certification to replace collapsed culvert in
upper Haverhill Street with appropriate erosion controls. DN should check whether DEP filing is
necessary. Vote: 4-0-0.
7.25 pm - Kristin from Presidential asked for reduction on Autumn Lane from $5,000.
Commission stated it wanted to see detention basin go through storm event. Varney Circle all
debris not removed. Will contact us when complete. Will also check driveway crossing side
slopes. Discussed 27 Grove. Side slope replanted. Not growing yet. Concern about 3-1 at end
and side of driveway. Was second parking lane added? Was this approved as a plan change?
Claim DN gave verbal permission.. Patricia Dusault from Presidential also participated.
7:40 pm. Strawberry Hill Lane - DEP 270-272, RGB 1995-14. John Ogren reviewed additional
drainage information N. Eaton distributed CDM 9-8-95 letter addressed to CPDC. Peter Ogren
addressed hard pipe versus detention basin. Hydrograph shows three scenarios: road only,
without road and total. Peak increase (2 yrs.) is less than .1%.
S. Chapman noted drain line upgrade from 12 to 18 inches. Earlier submittal shown to be existing
18. What is it? J. Ogren last portion where it joins to 48 is 18. Claim town's plan is incorrect.
What is base elevation on 100 scale plan? Difference is 105.85 between the two scales. Sewer
base plus 100 was to avoid negative numbers. No backwater analysis done on 48 inch pipe. S.
Chapman concerned about 18" pipe when full backing up. Drainage from Red Gate houses pipe
goes in at bottom.
S. Chapman stated CC was concerned about VP and downstream flooding not upstream flooding.
Concerned about hard pipe system. Want detention to be standard. Reviewed plans and
documents he reviewed.
N. Eaton read letter from Mr. and Mrs. John Richard, 52 Red Gate Lane.
J. -Drexler statedflooding of area isCC area of concern in the act. Concerned about timing of -
discharge in hard piped system. S. Chapman had discussion on ground water.
Att. Mark Favoralo noted clay dams will be required by CPDC on utility lines to prevent
backflow of water.
Brad Latham read letter requesting conditions in order, including bonds. M. Favoralo bonds for
ground water runoff difficult to quantify. Asked for opportunity to submit his own request for
conditions and to comment on B. Latham's submission. He was asked to do so promptly before
draft order was submitted.
Larry Beaulieu submitted materials showing two filled ponds in area and noted locations. Mrs.
DeAngelo stated No. 55 was renumbered to No. 89 in the 1930's. L. Beaulieu submitted memo
on house number changes. John Richards wants assurance there would be redress if flooding
problems to abutters.
Motion to close the public meeting was made and seconded. 4-0-1 with H. Hulse abstaining, at
8:45 pm.
8:48 pm. 10 Franklin Street - presented by Peter Ogren, Hayes Engineering.
Attendance: L. Kenney, L. Hulse, S. Chapman, N. Eaton, M. Keating, J. Drexler.
Flags 1-10 from 1991 delineation. Reviewed sewer and water lines, nondisturbance.
Tree plantings - species? Exemption for installation of sewer, replicate and become area of
nondisturbance.
Inquired about future activity in nondisturbance area. S. Chapman suggested grade and seed, no
mowing and asked if that was acceptable? Applicant felt it was. N. Eaton asked about fruit trees
and potential farming activity. Applicant stated they would be for personal use. L. Kenney noted
weeds coming in on upland side were wetland species. S. Chapman had some concern about
Flags 8-10 and 18-22. Flag tails missing. No CPDC hearing. ANR plan filed.
Requested waiver of showing major trees on plan.
Doug McAllister, 601 Haverhill St. stated water concerns. P. Ogren explained existing and
proposed drainage.
Robert Kinsler, 36 Franklin St. How much fill? P. Ogren noted there would be about 4 feet in
front. Max fill to grade is five feet. Must grade for garage floor and cellar floor elevations. High
ground water. Sewer grade - three feet. Explained why sewer line going to Haverhill St. and
necessity to avoid traffic island.
Neil Sullivan, 20 Franklin St. Claimed he had to build 100 feet away. Seemed he elected to move
his house out of BVW to avoid filing. H. Hulse explained process.
Moved and seconded to close public hearing at 9:25. 4-0.
9:25 pm 189 South Street, RGB 1995-25. Contractor will come through stone wall on west
side. Specs to contractor say not to use east side of house. No regrading. Existing disturbed
area activity. S. Chapman noted the plan was misleading as "proposed" language was work done
under previous order.
Motion was made and seconded to close the public hearing. 4-0. S. Chapman moved to approve
and issue an order of conditions as negative with standard conditions to include limitations on
activity as discussed with erosion controls 10 feet off existing foundation. 4-0.
DON - CHECK DUMPING at end of Hemlock. General letter to all residents about lawn debris
dumping..
9:55 pm By 9 Percy Avenue. Tom Devaney, builder. Read Administrator's notes on project.
L. Hulse moved to vote this as insignificant plan change. 4-0.
10:00 pm OLD/NEW BUSINESS - Lot 3 - Steve Caruso and Jim Sheehan were present. Chris
Coleman present as abutter. Discussed quality of fill around house. Grade raised, not cut as in
plan. Slope cut and change of grading to sewer. Added riprap - not on plan. No filter fabric
behind. Erosion problem. Mr. Sheehan felt plans were only a guide. He was told they were to be
followed to the inch and any deviations with conservation impact must be approved by the
Commission. Previous violations and developer's experience with CC were reviewed.
Filling seems to be onto Lot 2 What are plans for Lot 2? L. Hulse noted we can require all fill
to be removed and area revegetated. Explained violation and impact on drainage and design
calculations. House also flipflopped. S. Chapman moved to issue a cease and desist until plan on
Lot 2 and 3 is submitted when the issue will be reviewed. Also need engineering for riprap wall.
Noted our standard is 3-1 maximum slope.
S. Chapman suggested they start with as built plan and get engineering justification to meet
conditions previously issued. Survey grades should be noted if that is proposed finished grade.
Floor grades, cellar floor, slopes, etc.
Discussed crossing and violations on Lot 20. Requested to reestablish silt fence.
S. Chapman reemphasized no further activity on lot 3 until next meeting Motion was made and
seconded to issue cease and desist activity on Lot 3 and until proposed plan change for Lot 2 and
3 were submitted and reviewed by the Commission. Future activity will re reconsidered at
whatever meeting that material is discussed at. 4-0
LOT 8. Wall. Large stones. ? filtering. Porous. 20 feet of fill behind slope that contains fill to
swimming pool. Wall needs handwork - chink with smaller stones.
Motion was made and seconded to approve payment of IRWA municipal dues. 4-0
Discussed 51 Mill. Test holes were not refilled.
Eric's Greenhouse. Mr. Goddard did not attend meeting. Compare with plans from 1100 Main
Street for wetland line.
Questioned if pond fulfilled nonwildlife definition of VP. Send letter and if doesn't appear at next
meeting, consider at next meeting starting daily fines next day.
I Drexler stated he would be looking for bond money for damage to abutters at Strawberry
project.
