HomeMy WebLinkAbout1995-12-06 Conservation Commission MinutesREADING CONSERVATION COMMISSION Minutes of Wednesday, December 6, 1995 Meeting No. 29 Town Hall Selectmen's Meeting Room PRESENT: Chair Nancy Eaton, Vice-Chair Stephen Chapman, David Danis (7:05), Harold "Lucky" Hulse, Michelle Keating, M. Clifton Proctor; Associate Members Leo Kenney and Joan Nickerson; and Conservation Administrator Donald Nadeau ABSENT: Joshua Drexler 7:00 PM The meeting was called to order. Minutes: Motion made and seconded to accept as corrected the minutes of 11-15-95. Voted 6-0-0 7:30 RGB Extension - 200 Grove Street Mr. and Mrs. Keniston were present. The house was built outside the 100-foot Buffer Zone, the Buffer Zone is not landscaped yet. Motion made and seconded to issue a Partial Cert. of Compliance on the basis of the residence being built outside of the Buffer Zone, for the house only. Voted 6-0-0 Motion made and seconded to grant a one year extension permit until 12-22-96. Voted 6-0-0 8:00 Violation - 16 Varney Circle Parris Varney present. The boat on the trailer is on upland. He stated he will probably remove it in late spring or early summer. The Administrator verified that it was parked on plywood in the Zone of Natural Vegetation, had damaged two two-inch caliper red maples, and that the motor was sealed and not leaking. Motion made and seconded that the Administrator see that the boat is moved upland of the ZNV within one week. Voted 6-0-0 8:30 Violation - 12 Estate Lane Peter Grimm was present. A Commission member who did a site visit noted that some trees in the wetland replication area had died and some of those had stump-sprouted. Mr. Grimm said he would reseed the sand box area in the spring, and only mow a few feet around the swing set - not in the other wetland grass area. Three feet was agreed upon. 9:00 status - Lots 3, 10 Carriage Estates II The Commission acknowledges the trees will be removed down to the silt fence on Lot 10 except for the two veterans just uphill from the fence, which will remain; and the tree on Lot 3 by Lot 2 and the retaining wall will be removed to meet the 3:1 slope requirement., That work must be a priority and be finished soon. 9:30 -Cert. of Compliance - 156 Van Norden Road Motion made and seconded to issue a - Certificate of Compliance for 156 Van Norden Road. Voted 6-0-0 Reading Conservation. Commission minutes of 12-06-95 Page 2 - Plan Change - Franklin Street Cemetery The Commission will review a detail of the proposed rip-rap slope, showing size and placement of rocks, at the next meeting. Plan Change - 40 Azalea Circle Janice Hannert was present for the Fafard Companies and expressed their desire to work with the Comission to design a plan that was mutually acceptable prior to the court date in January 1996. She said they would agree to put permanent boundary markers along the ZNV and reference them in the deed, and include in the deed a permanent restriction on the ZNV/wetland. Russell Tanzer for Greenhouse Acres developers said the site is extremely sensitive for the BVW and difficult to build, and Tom Anzuoni of 30D Carnation Circle observed that Fafard had caused many problems and wouldn't be able to comply, and they had created their own problem by splitting up the lots the way they did. He was shocked that Fafard had built part of the site as part of the lawn around his unit and now wanted to build a house on it. He observed standing water at times within three feet of the lawn and twenty feet wide. Art Scali of 13B Carnation Circle didn't see how Fafard could comply. Ms. Hannert agreed to continue the discussion at the first meeting in January, and the Commission would ask Town Counsel about plan change and hearing procedures and applicable regulations, and write a letter for the court stating that it could not accomodate Fafard until the first meeting in January 1996. Public Hearing - 51 Sanborn Lane Steve Chuha was present. Paul Finocchio submitted a new plan and stated there will be a five-foot wide block pool apron, and that even if it were solid concrete, the lot impervious area would still be within limits. Walter Kittredge submitted a plant list and stated that the BVW line was not based on buckthorn. Bill Ebrecht, 45 Sanborn Lane, stated the BVW was up to his lot line when his house was built, and he bermed and planted a privet hedge to demarcate the edge. The Town DPW file topo plan by Dana Perkins 3-20-84 revised 5-7-84 shows no BVW on [Ebrecht's] lot. The Commission required more documentation, preferably in the new DEP format, of the BVW line 1-5, including soils transects across points 2 and 4. Motion made and seconded to accept the 1996 meeting schedule as presented. VOTED 6-0-0 Motion made and seconded to continue the Public Hearing [with the applicant's consent] to January 10, 1996 at 9:00 PM at the same place. VOTED 6-0-0 Public Hearing - Cory Lane Estates Jack Rivers was present. Paul Finocchio noted the proposal is to move the catchbasins from the end of Cory Lane uphill. The applicant agreed to remove BVW flag 7, do a plant plot to relocate flags 9 and 10, and to provide a P.E. stamp on the drainage calculations. L. Kenney noted vernal pools evident on Lot 3 and rare animal species habitat on the site. Wm. Griset -68 Sanborn Lane; reported rare species spotted regularly for eight years and is concerned for them. Reading Conservation Commission minutes of 12-06-95 Page 3 Motion made and seconded to continue the Public Hearing for Cory Lane Estates to January 10, 1996 at 9:30 PM at the same place. VOTED 6-0-0 N. Eaton updated the Commisison on the Capital Improvement Grant requests for FY 1997. The Commission asked the Administrator to research the procedure for hiring an outside consultant.
