7:13 p.m. Nancy Eaton called the meeting to order.

Present: Attorney Favaloro, Esq.
Site Visit: Sunday, March 17, 1996, 11:20 a.m.; Nancy Eaton summarized
into record.
Commission holding enforcement order - unratified. H. Hulse stated, "if
there is a single further violation on subject property, then an immediate
fine process will go into effect, including, but not limited to, any state
violations."
Commission gave notice to Attorney Favaloro that a Site Inspection will be
scheduled for March 30,1996,12:00 noon. Any and all materials due to
administrator should be in by March 25, 1996. April 3, 1996, 8:30 p.m.
reserve time for next meeting.

Paul Finocchio made a presentation summarizing and listing the timely
submitted package to the Commission. Administrator, Donald Nadeau,
summarized the response from Natural Heritage stating that correspon-
dence concerning rare species habitat for Corey Lane Extension, 48 and 51
Mill Street and Sanborn Lane, would be applicable to the above-stated pre-
mises. Chairperson N. Eaton requested amendments for association trust
documents and Attorney Latham concurred. The Commission summarized
the following outstanding items that should be addressed by next meeting:
1. To obtain DEP#;
2. Confirming total loss area of wetland;
3 Amendments to legal documents;
4. Plan change Section AA - roadway with block wall on edge;
5. Source of plants for planting,
6. ZNV lines of plan;
7. No separate letter from National Heritage; and
8. Letter from 'T'own Engineer on drainage.

MOTION trade and seconded to consider proposed plan change for Lot
10, Carriage Estates, Phase II, DEP #270-236, RGB #1191-10 as being
an insignificant plan change. VOTED: 6-0-0
MOTION made and seconded to find the proposed activity shown down-
gradient of the rip-rap slope on Lot 11, Carriage Estates, Phase II, DEP
#270-236, R GB #1111-10, house and. € riveway to be considered an
insignificant plan change. VOTED: 4-2-0

Discussion concerning Title V (septic system) Policy. N. Eaton read DEP
Title V Policy into record. Townspeople contributing to discussion were:

Terry Bastion - 96 Haverhill Street
Gina Schneider - I I Dana Terrace
Selectman MacDonald`s concerns were with the Town`s water resource,
the Ipswich River, and requested that the Commision be most
conservative with their ruling.
MOTION made and seconded to extend continued Public Hearing 51
bill Street "Marion Road" DEP #270-279, RGB #191529 to April 26,
1996, at 7:30 p.m. at the request ofthe Applicant. VOTED: 64-0
