Minutes of Wednesday, April 3, 1996
Town Hall Selectmen's Meeting Room
PRESENT: Chair Nancy Eaton, Vice-Chair Stephen Chapman, Harold "Lucky" Hulse,
Michelle Keating, M. Clifton Proctor; Associate Members Leo Kenney and Joan Nickerson; and
Conservation Administrator Donald Nadeau
ABSENT: David Danis, John Kilborn (just appointed) and Recording Secretary Carla
Gerber-Weintraub
7:00 PM The meeting was called to order.
Public Meeting - 89 Main Street RGB# 1996-02 Elizabeth Wallis from Hayes Engineering
described the BVW line to be the line already approved by the Commission, and noted that no
work is proposed in this request. The Chair and administrator answered abutters' questions.
Motion made and seconded that the public meeting 89 Main Street RGB# 1996-02 be closed.
VOTED 5-0-0
Motion made and seconded that a Positive Determination be found for 89 Main Street RGB#
1996-02, and the existing marking of the wetland boundary lines be accepted as referenced in the
[Commission's] site visit report.
VOTED 5-0-0
Wildlife report L. Kenney reported new local vernal pool breeding activity, and his recent
observation of a pair of spotted turtles in Fairbanks Marsh near the 51 Mill Street site.
Continued Public Hearing - 40 Azalea Circle RGB# 1989-3 Abutter Thomas Anzuoni by
letter requested a continuance due to a scheduling conflict, and Janice Hannert of the Fafard
Companies by letter agreed to continue to 5-1-96.
Motion made and seconded to continue the continued public hearing 40 Azalea Circle RGB#
1989-3 to May 1, 1996 at 8:30 PM in the same place. VOTED 5-0-0
MGL Extension - Nugent Lane (Lot 3) DEP# 270-248 (RGB# 1992-24)
Motion made and seconded to grant an extension to Lot 3 Nugent Lane DEP# 270-248 until
12-31-96. VOTED 5-0-0

Annual Town Meeting recommendations
Article 1 i - purchase ten acres and access on the end of Pasture Road, less an approximately
20,000 square foot house lot and its access. The Commission directed that Town counsel advise
on who should own the driveway.
Subject to that clarification, motion made and seconded to support Article 11 at Town Meeting.
VOTED 5-0-0
Article 13 - fund park and recreation improvements.
Motion made and seconded for the Conservation Commission to support Article 13 with regard
to the enhancement of open space in keeping with the goals and objectives of the Open Space and
Recreation Plan; however, the Conservation Commission recognizes that several of these sites
are subject to Massachusetts General Law the Wetlands Protection Act and Reading General
Bylaws for wetlands protection. VOTED 5-0-0
Public Hearing - 128 Van Norden Road DEP# 270-xxx RGB# 1996-03 David Giangrande
presented for his brother Louis the plan to build a 24 ft. by 38 ft, single family dwelling sited
closest to Van Norden Road on the lot, having a basement elevation at 120 ft. NVGD with fill and
about one foot of excavation, and a swale to drain the drive and back yard toward the
watercourse. The Chair read the Commission site inspection report. Comments: wetland
vegetation beyond the boundary of BVW flagged by Mary Trudeau, so the line needs
- dominance plots or other justification; recommend to not excavate or swale near the
watercourse, but use the existing contour and add a stone filter strip for driveway runoff; the
plan note #2 "minimum work limit" should not say "minimum"; remove note #4; as Mr. Boni is
still the owner, review past violations on the rest of the lot and issue a violation letter to him as
appropriate.
Mr. and Mrs. Boornazian of 9 Harold Ave. reported a wet depression north of their lot and a
stream from it to the present watercourse, all of which had been filled in the 70's, at which time
their basement flooded. They said it stopped flooding when they went on sewer, but in a hard
rain water still sheets across the road.
Motion made and seconded to continue the public hearing 128 Van Norden Road DEP#
270-unknown, RGB# 1996-03 to May 1 at 9:00 PM here. VOTED 5-0-0
Violations - 1090 & 1100 Main Street Attorney Mark Favaloro was present for Thomas
Goddard. Comments: the addition is done, with erosion controls in place and the stockpile
removed, so the matter is resolved except for the formality of a Request for Determination, which
was submitted to the Commission at this meeting. The wetland flags need to be rehung and the
woodpile moved over 25 feet from the wetlands, and another site visit will be scheduled, all prior
to the next status meeting to be 4-17-96 at 8:30 PM.
Eagle Scout Proiects: James Tucker - Conservation Area Information Signs information need
needs a written proposal.

10:00 L. Kenney recommended that a form letter be designed stating the conditions of
Commission approval of volunteer projects, with a copy to go to the scoutmaster for Scout
projects.
RGB Extension - by 25 Brook Street (DEP# 270-245) RGB# 1991-06
Motion made and seconded to grant an extension of the local Order of Conditions to coincide
with the date of the Superseding Order of Conditions. VOTED 5-0-0
Administrator sign-offs: Lot 4 Lynn Village Way final building plan 173 Haverhill Street -
remove tree in front of house The Administrator reported.
