HomeMy WebLinkAbout1996-10-02 Conservation Commission MinutesC READING CONSERVATION COMMISSION Minutes of Wednesday, October 2, 1996 Town Hall Selectmen's Meeting Room PRESENT: Chair Nancy Eaton, Members Harold "Lucky" Hulse, David Danis,Clifton Proctor, John Kilborn; Consultant Leo Kenney (7:23); and Conservation Administrator Donald Nadeau. 7:12 PM The meeting was called to order. Jonathan Edwards, Director of Community Development spoke to the Commission about goals and priorities. S. Chapman expressed concern over the amount of work that was being designated to the The Administrator with regard to his present duties and the undertaking of flagging at the landfill. J. Edwards assured the Commission that now that the The Administrator has instituted new office hours there shouldn't be a problem and said that the flagging would become a priority. The Administrator said he should have the flagging done by the end of the month. 7:35 PM 147 Haverhill St. Site Visit Notice, reference 9-29-96 notes. S. Chapman commended the owner for taking care of the problem and stated he felt there was no intent to do harm. The job was acceptable as observed with no further fill over the hill. Owner advised he would be fencing it off in the future. Chair Eaton thanked Mr. Grimmer for his cooperation. 7:49 PM Cont'd Public Hearing - 89 Main St. "Leaning Elm Farm" DEP# 270-288, RGB#1996-16 Mr. Rich Williams from Hayes Engineering, Inc. handed out Definitive Site Plan, revised 10/1/96. Town Engineer's memo dated 10/2/96 also reviewed. Applicant has met with Joe Delaney, Town Engineer. Infiltration Report handed out dated 10/1/96. S. Chapman noted stream elevation 160, questioned if there wouldn't be an increase in the water level. L. Kenney mentioned there was a spring coming out of the ground on O'Keefe lot. S. Chapman also questioned the west detention. Chair Eaton asked Mr. Williams if any soil reports had been done; he stated that he hadn't. Some discussion was had regarding the 25' min ZNV. The Administrator recommended that where vegetation was crossed, that more than 25 be done if possible. S. Chapman agreed, but given the elevation only a 10-20' gain at the most. Motion was made and seconded to close hearing. Voted: 64-0. Motion was made and seconded to reconsider closing. Voted: 5-1-0. Motion was made and seconded to reopen. Voted: 5-1-0. Reading Conservation Commission Minutes 10/2/96 Page 2 Some discussion was made about the silt fence line and the limit of work line. The Administrator recommended that it would be easier to enforce one line as boundary markers were inquired upon. Owner stated that 1 "in diameter iron pipes would be installed. L. Kenney was concerned that a dangerous condition would exist. Possible other alternatives were suggested such as rock or stone. Chair Eaton suggested that the master "condo" agreement should be reviewed with Tom Devaney for possible wording to be included in it. It was agreed that a new silt fence line would be shown on the revised plan. Motion was made and seconded to close public hearing pending receipt of the revised plan. Voted: 6-0-0. 8:30 PM 19 Harold Avenue, RGB#1996-18. Atty. Robert Scarano was representing Mr. Andella for a Request for Determination of Applicability of WPA. Plans were reviewed among the Commission and Mr. Scarano was given a copy of the site visit report. After reading the report, Mr. Scarano realized that there were matters that needed to be addressed by Mr. Garneau. He advised the Commission that Mr. Garneau would be in contact with the Administrator and asked if he could be put on the agenda for the next meeting. The Administrator told him that he would probably have to wait until the 10/30 meeting due to the corrections that would have to be made to the plans. Some suggested corrections: rework the wetland line and flag 16, over by the Bonnie property, needs to be moved N., NE towards the boulders so that it includes a 14" maple. Chair Eaton noted that there was historical fill and heavy vegetation. She was concerned with flags 3, 4, 5, & 6 that they could fall into regulations regarding vernal pools. She also requested that the statement that he had reviewed plan containing the Administrator's name be removed from the plan. The Administrator also recommended that they use a more permanent marker for the wetland flags. Mr. Scarano agreed not to rush to get on the 10/16 meeting so he signed the extension, and was put on the agenda for 10/30. Motion was made and seconded to continue public meeting to 10/30 at 8:30. Voted: 6-0-0. No further public notice. Recess taken. 9:05 PM Tree pruning, removal -195/201 Salem St. Site visit done at 201 Salem St. Commission felt the work was done appropriately. Chair Eaton thanked Dr. Boschetti for his cooperation. Old/New Business: Motion made and seconded to accept minutes of 8-7-96. Voted: 4-0-2 (D. Danis and H. Hulse abstaining) The Administrator advised the Commission that the backed up minutes will be put to the board two at a time to catch them up to date. Reading Conservation Commission Minutes 1012/96 Page 3 48 Mill St. L. Kenney mentioned a problem with the Conservation Restriction, which had not yet been drafted, about Natural Heritage access to the property, wanting better access. He said that Ms. Huckery said that they. wanted any number of people at any time with reasonable notice. The Administrator advised that the wording put into the Order was that the Natural Heritage would be allowed access for program related purposes, all program related purposes. Atty. Latham said he would work it out with Natural Heritage. 285 Main Street and 295 Main Street The Administrator said work was done very satisfactorily but that he did require that they put mulch and that Mr. Tux get a certified arborist to do the work which he will follow up on. Motion made and seconded for issue of compliance. Voted: 6-0-0. "Family Circle" (Lot 2) DEP#270-234, RGB#1991-09 Notice sent to Zannis with respect to the lawn and not the trees. The Administrator advised they had already taken care of the plantings. Site inspection done: 6 shrubs in, equally spaced, and grass is full. Motion made and seconded to issue Cert. of Compliance. Voted: 6-0-0. Motion made and seconded to release bond in the amount of $500. Voted: 6-0-0. Lot 11 Fairwood Acres (99 Fairchild Drive) - DEP# 270-170, RGB#1987 Site inspection done. Motion made and seconded to issue Partial Cert. of Compliance. Voted: 6-0-0. Lot 12 Cory Lane - DEP# 270-287,RGB# 1996-15 Commission reviewed Order of Conditions. The Administrator recommended additional conditions - ZMV markers along the N. buffer zone - a zone of vegetation and the 100' buffer zone is valuable. J. Kilborn thought that in paragraph 3, line 3 after or instead of "near" to clarify at N. side of pool add parenthetical "uphill" or "upgradient of." The Administrator put in "uphill" . S. Chapman mentioned clarification of retaining walls (pg 2, 2nd line), clarify height above footing. The Administrator would like to say in paragraph 11 "foundations and footings." After discussion among the members it was agreed to delete the 1st sentence in paragraph 12 and also delete 1 st. sentence. paragraph 13. H. Hulse remarked on the 1 to 1 slope. Chair Eaton reminded that that was the compromise to save the upland vegetation, also S. Chapman remarked that 1 to 1 is usually too steep, but 1 to 1 was approved before. The Administrator remarked that they did a very good job before. Chair Eaton questioned if the request for certificate should be a numbered paragraph, which it should. Also added: the 100' buffer of the N. wetland is for, but not limited to, rare species habitat. Motion made and seconded that Order of Conditions with corrections be approved. Voted: 6-0-0. 2, Reading Conservation Commission Minutes 10/2/96 Page 4 The Committee had no comment on the Administrator's minor project sign-off on fence re-bar at 21 Keith Road.
