HomeMy WebLinkAbout1996-12-04 Conservation Commission MinutesREADING CONSERVATION COMMISSION Minutes of Wednesday, December 4, 1996 Town Hall Selectmen's Meeting Room PRESENT: Chair Nancy Eaton, Members Harold "Lucky" Hulse, David Danis (7:45), Clifton Proctor, John Kilborn (7:10), and Conservation Administrator Donald Nadeau. ABSENT: Steve Chapman, Mark Gillis, and Consultant Leo Kenney (prior notice given) 7:08 PM The meeting was called to order. 7:08 PM Minutes. Minutes of 11/06/96 were reviewed. Motion was made and seconded to accept the minutes with corrections. Voted 4-0-1. J. Kilborn abstaining. Minutes of 3/6/96 were reviewed. Motion made and seconded to accept the minutes with further corrections. Voted: 4-0-1. J. Kilborn abstaining. Minutes of 3/20/96 reviewed. Motion was made and seconded to accept the minutes with further corrections. Voted: 4-0-1. J. Kilborn abstaining. Minutes of 4/3/96 reviewed: Motion made and seconded to accept the minutes with corrections. Voted: 5-0-0. 7:40 PM Shed in ZNV - 178 West St. Mr. Bowe was present for the meeting. The site visit was reviewed. Owner is willing to move the shed. The Commission advised him to chip up the brush in the wetlands, and the woodpile could be kept where it was but he couldn't add to it. The Commission and the owner agreed that he should try to have the shed moved by 12/18196. The Commission also advised the owner to check with the Building Inspector for shed requirements. 7:50 PM 382 Charles St. The Administrator reviewed his site visit with tho'-C-ommission. He stated they did a good job. The Administrator brought to the Commissi"n attention that some work has been done in the neighbor's yard within the wetlands. He stated he doesn't plan on taking any action. N. Eaton suggested that he send an educational letter. 7:52 PM 45 Brook Street - abutters concerns. Mr. Pacunas of 19 Brook St. and Mr. Burt also of Brook St. were present for the meeting. The two men expressed their concern over the newly constructed home. They feel that since the house went in, the flooding problems in their neighborhood have worsened. Mr. Burt told the Administrator that the letter he received 11/18/96 mentioned three enclosures which were not with the letter. The Administrator said he would get them to him. The Administrator read the Final Order of Conditions dated 11/18/96, Certificate of Compliance and Inspection Report. Mr. Pacunas mentioned the fact that the original house plans which had called for only a house on a slab had been denied by the Commission. The Administrator explained that in the court settlement the slab requirement was removed. Mr. Peter Hechenbleikner, Town Manager, stepped into the meeting, and he was asked what could be done to alleviate the problem. Mr. Hechenbleikner suggested that better cleaning and maintenance by DEP could be done in the area. The Administrator advised that because Reading Conservation Commission Minutes of 12/04/96 Page 2 of the rare species and vegetation in that area that DEP would need a permit to clean. Town Manager suggested that he could have engineering take a look at the problem and then come to Conservation for a filing. 8:35 PM Recess taken. 8:40 PM Partial Certificate of Compliance - Lot 15 Sanborn Village III (7 Verde Cir.) DEP# 270-132, RGB# 1985-3. Mr. and Mrs. Pirone were present for the meeting. A site visit was done by the Commission. A motion was made and seconded to grant a Partial Certificate of Compliance. Voted: 4-0-1. H. Hulse abstained. 8:50 PM Plan Change - Lot 2/3 Carriage Estates H DEP# 270-236, RGB# 1991-10. The Commission felt the owners were in violation. They advised the Administrator to send a letter of violation with corrections to be made by 12/18/96. 8:55 PM Certification of Compliance - Lots 8, 9, 10 Carriage Estates H DEP# 270- 236, RGB# 1991-10. Chair Eaton and the Administrator were out at the site. They advised that there was no loam or seed on Lot 8, no loam on Lot 9, and Lot 10 the grass was germinated. 8:57 PM Status 1090/1100 Main St. The Commission commented that there are XMass trees in the ZNV area. Atty. Favaloro is to follow up on the trees. The Commission acknowledged that Mr. Goddard has put the markers in but commented that he is not abiding by them. H. Hulse stated Mr. Goddard should clear the ZNV area and this area should never be used again. He should be given a date to have the material removed by and after that date, more fines levied. D. Danis agreed with him. The Commission suggested material should be removed by 12/10/96 and after that date then the Commission would issue fines. H. Hulse felt fines should not be negotiable and collected in cash. Commission decided that 1) Mr. Goddard is to clear the trees by 5:00 on 12/09/96, 2) Keep insisting on current fines in monetary form. If a criminal filing is inevitable, N. Eaton is to ask the Magistrate for the full amount of the fines, approximately $14,500. 9:17 PM Notice Yard Waste: rear 530 West Street, Reading Open Land Trust Dumper will cooperate. Removal date by first meeting in January'97. N. Eaton advised that Chestnut saplings have been planted. The Administrator was advised to educate the Dumper on property boundaries and that a permit should be obtained for any activity in Open Space property. 9:26 PM Status Report of 38 Old Farm Road The Administrator reported a fence _wou - be installed soon and a hedge planted in the spring, _ Reading Conservation Commission Minutes of 12/04/96 Page 3 9:27 PM Draft educational letter to contractors, tree services, landscapers, etc. The Commission discussed methods of making outgoing correspondence easier to understand. 9:56 PM Certificate of Compliance Bond Release - Lynn Village Way Town Planners letter dated 11/05/96 to Mr. DeGermano reviewed. The Commission felt that work still needed to be done. Motion was made and seconded to release half of the $2,000.00 bond and retain $1,000.00 for survival of plantings and permanent stabilization and release half of the $500.00 bond being held on Lot 5. VOTED: 4-0-1. H. Hulse abstained. 10:09 PM Anson Lane Motion was made and seconded to release the bond. VOTED: 5-0-0. 10:10 PM Lot 3 Eden Vale, 86 Haverhill St. Motion was made and seconded to have the Administrator sign-off on certificate of occupancy. VOTED: 5-0-0. 10:11 PM 1997 Meeting Schedule The Administrator expressed his appreciation to the members for changing the meeting night from Wednesday to Thursday to accommodate his schedule. Motion was made and seconded to accept the Conservation Regular Meeting Schedule as presented with amendments. VOTED: 5-0-0. 10:25 PM Motion was made and seconded to adjourn. VOTED: 5-0-0.
