HomeMy WebLinkAbout1997-01-09 Conservation Commission MinutesJ READING CONSERVATION COMMISSION Minutes of Thursday, January 9, 1997 Town Hall Selectmen's Meeting Room PRESENT: Chair Nancy Eaton, Members; Stephen Chapman, Harold "Lucky" Hulse, David Danis, Clifton Proctor, John Kilborn, Mark Gillis, Consultant Leo Kenney, Conservation Administrator Donald Nadeau, and Recording Secretary Kathy Morgan. 7:07 PM The meeting was called to order. 7:08 PM Continued Public Meeting - "Reading Business Park" between 8 & 88 Walkers Brook Dr. RGB# 1996-22. J. Edwards, Town Planner, and James Laurila a representative from CDM presented plans dated 12/31/96 to the Commission members. After a review of the plans, a motion was made for a positive determination of the line delineated on the plan with the understanding that the line will terminate at the nearest headwall end at the areas where there is not closure. The swale on the S.W. corner of the project with four Willows in it will be further examined at another time and is not part of the determination of the line at this time. Chair asked for any comments or questions from the audience - there were none. A motion was made and seconded to close the Public Meeting. Voted: 7-0-0. The main motion on the table was then seconded. Voted: 7-0-0. 7:35 PM Public Meeting - Mass. Highway Depot, Causeway St. at Lowell St. RGB# 1996-24. Andy Brydges, a representative of Rizzo and Assoc. and Ken Leach, Mass. Highway Hazardous Materials Coordinator/Geologist came before the Commission for a request to install two test pits due to petroleum products found in this area and to install a ground water monitoring well to further define contamination found in that area. A site visit was conducted on 1/7/97 and a copy of the report was given to Mr. Brydges. Mr. Leach advised the Commission that the vehicle on the property is going to auction, and he also described for the Commission their standard procedures for storing contaminated materials. N. Eaton commented that on the Commission's site visit they observed more than the one stain reflected on Mr. Brydges' plans. She also mentioned that in their cover letter, submitted with their RDA application, it states that no work would occur within 10' of the fence or to the west of the fence, and on the Commission's site visit it was noticed that the stain does go within 10' of the fence. The Commission questioned the applicants what they would do if after they started digging they discovered a much bigger spill than anticipated. Mr. Brydges stated that based on the wells in that area they feel there is no evidence that the spill will be that large. Mr. Leach advised the Commission that if they did find a substantial spill they would probably try to isolate the area with plastic and haybales. Mr. Brydges stated that their information is based on RMW 4 and RMW 2. Mr. Brydges read from his report previously conducted and gave the contaminants found. D. Danis questioned what kind of clean up would be done. Applicants stated that just the area of the test pits would be cleaned up, loamed and seeded. Chair asked for any additional questionsor comments from the audience. Mr. - Reading Conservation Commission Minutes of 1/09/97 Page 2 Thomas Conneen from Ransom Environmental Consultants, who is also doing work in that area, clarified a description of other activities at the site. A motion was made and seconded to close the Public Meeting. Voted: 6-0-1. S.Chapman abstaining. A motion was made and seconded to issue a negative determination of applicability conditioned on the applicant submitting its most recent site evaluation, second that the applicant will submit other site evaluations as completed, and that the RDA is only on the test pits applied for and any further work will require an additional RDA and/or NOI. Plus additional conditions for haybales, sediment control, and use of polyethylene in excavation to minimize the spread of contaminants. Also daily logs from the project foreman during activity. Voted: 6-0-1. S. Chapman abstaining. 8:20 PM Public Meeting - Mass. Highway Depot, Causeway St. at Lowell St. RGB# 1996-25. Mr. Thomas Conneen from Ransom Environmental Consultants, Inc. and Ken Leach from Mass. Highway came before the Commission with a presentation explaining the process they would like to take in the removal of a storage tank. Mr. Leach advised the Commission that the tank was tested in the fall and passed. The applicants were asked what they would do if they found contaminants. Mr. Conneen stated that if they found anything they are required to file a report. Chair stated that she would like the Administrator on site when the tank is removed. Chair asked for any additional comments or questions from the audience- there were none. A motion was made and seconded to close the Public Meeting. Voted: 6-0-1. S. Chapman abstaining. A motion was made ` - and seconded for a negative determination with the condition that the silt fence be placed in the field as shown on the map as presented tonight and all work be done according to the application and the Administrator be notified so he can be present on site at the time of removal and daily logs be submitted by the MHT consultant. Voted: 6-0-1. S. Chapman abstaining. 8:35 PM Recess taken. 8:40 PM Continued Public Meeting Salem St., between 196 & 236 RGB# 1996-23 Mr. Redmond, engineer for the project, was in attendance and requested a continuance. N. Eaton mentioned to him that the Commission had made 2 site visits and had allowed 2 continuances already. The applicant was given site visit reports of 12/16/96 and 1/4/97. S. Chapman stated that the plans were not acceptable as submitted due to being inaccurate and they do not reflect what is in the field. Chair asked for any comments or questions from the audience. J. Pineau of 6 Libby Avenue requested that the abutters be informed. Chair advised him of the regulations. A motion was made and seconded to close the Public Meeting. Voted 6-0-1. H. Hulse abstaining. A motion was made for a positive determination, with the note that the plan and wetland line on the plan and the topographic information noted on the plan are not accepted as submitted as it does not depict field observations. An amendment was offered stating the Commission has previously Reading Conservation Commission Meeting 1/9/97 Page 3 requested a corrected plan and vegetative analysis which had not been submitted as requested. A motion was made and seconded to accept as amended. The maker accepted the amendments. Voted: 6-0-1. H. Hulse abstaining. 9:05 PM Partial Certificate of Compliance wetland replication construction / Plan Change 350 sq. ft. wetland replication - "Old Mill Village" 48 Mill St. DEP #270- 283, RGB# 1995-31. N. Eaton turned the Chair over to S.Chapman. Grant of Conservation restriction reviewed with applicant. Attorney Brad Latham was present and explained the changes made to the document. The Commission went over the document and conditioned the following: Items 1-10 require Commission approval for future needs, approval not applicable to 7, 8 & 10. All other changes were also acceptable to the applicant. The Old NO Residents Assoc. Trust was reviewed with Attorney Latham. Site visit report of 1/4/97 passed out to members and reviewed. The applicant, David Hurley, advised the Commission that he has seeded the replication area. The Commission acknowledged that the applicant is making an effort to comply. Will Finch of 51 Mill St. is concerned that the Commission's approval does not become a precedent on future projects. A motion was made and seconded to issue Partial Certificate of Compliance for restoration and replication areas as currently constructed, noting the remaining work. Voted: 6-0-1. N. Eaton abstaining. A motion was made and seconded to accept Plan Change as insignificant for restoration and replication as it currently exists with the condition that the applicant fully plant the replication area prior to May 30, 1997, and ` - request Certificate of Compliance by June 5, 1997. Voted: 6-0-1. N. Eaton abstaining. The Commission agreed that the current signs are ok for now. S.Chapman requested the applicant to come in and update the Commission. 10:22 PM Status 201 Salem St., 532 West St. A site visit was conducted. The Administrator recommended a fence. 532 West St. - the Administrator advised the owner to clean up all that shouldn't be there. 10:25 PM Partial Certificate of Compliance - Lot C (#86) Haverhill St., DEP# 270- 260, RGB# 1994-14. A site visit was conducted. A motion was made and seconded to issue Partial Certificate of Compliance. Voted: 7-0-0. 10:27 PM Commission reviewed the drafted 1996 Annual Report. A motion was made and seconded to accept as amended. Voted: 7-0-0. 10:40 PM 40 Azalea Circle (Fafard v. Town) DEP# 270-232. Town Counsel is to discuss a draft copy with applicant's attorney. 10:52 PM "Cory Lane Estates" DEP# 270-280. A motion was made and seconded to ratify the appeal. Eaton reviewed the status of the Thomas Goddard trial with the other members. The trial is set for Wednesday, February 5th at 9:00 AM. 11:20 PM A motion was made and seconded to adjourn.
