READING CONSERVATION COMMISSION
Minutes of Wednesday, October 22, 1997 Town Hall Selectmen's Meeting Room
PRESENT: Chair Nancy Eaton, Members: Vice Chair Stephen Chapman (7:10), Clifton
Proctor, Harold "Lucky" Hulse, Mark Gillis, J. Kilborn, David Danis (7:21), Consultant
Leo Kenney, Conservation Administrator Donald Nadeau, and Recording Secretary Kathy
Morgan.
7:15 PM Meeting was called to order.
7:17 PM VOTE/Sign Amended Order of Conditions "Cory Lane Estates" EP#
270-280, R T # 1995-34 Present were Atty. Senior, Mr. Finocchio, Mr. Perrina, and
Town Counsel, Cheryl Blaine. Mr. Finocchio submitted a conservation restriction plan.
Members reviewed the amended order of conditions and the Administrator will make the
necessary changes. A motion was made and seconded that the Order of Conditions for
Cory Lane Estates as amended be accepted, approved, and issued.Voted: 7-0-0. A
motion was made and seconded to allow Town Counsel to enter into an agreement for
judgment or stipulation of dismissal in accordance with the Order of Conditions voted at
the Conservation Commission meeting of 10/22/97. Voted: 7-0-0.
8:17 PM Public Meeting - 71 Red-Gate Lane R B# 1997-29 A request was made by
The Leahys for the installation of a pool. The Administrator advised the members that the
owner is required to clear a ditch that is located on the property. Chair read the site visit
notes. S. Chapman noted that the owners plan a pool over the drainage easement. The
Administrator advised that DPW has allowed patios with the owner understanding that the
town may at some time have to remove if necessary. John Cafazzo, 67 Red Gate Lane
advised the members of a brook that runs under his land, and he is concerned with being
flooded out. Louise Callahan, 7 Indiana Ave., is concerned with flooding in her basement.
Larry Beaulieu, 62 Red Gate Lane, showed a plan of the area. He stated that 3 ponds
were filled and diverted into the drainage system installed by the town in the area. He read
the restriction deeded on all the properties regarding sloping on the properties and an
amendment which strikes all references to the brook and refers to the drainage easement.
He also referred to order 18 of the Order of Conditions on Lot 198. Mr. Nichols, 25
Avon St., questioned whether the Commission had a report from the Town Engineer and
if there was room for a fence around the pool and what the book and page was for the.
Order of Conditions on the property. The Administrator stated that he had referred the
issue to the Town Engineer but had not received any word from him. He said that the
plan showed the fence, and he then read him the book and page number.
Mr. Beaulieu raised the issue of back washing the pool. The applicant agreed to an
extension for the Commission to obtain additional information. A motion was made and
seconded to extend the meeting to 11/5/97, at 8 PM, this room. Voted: 7-0-0.

9:07 PM Continued Public Hearing "Marion Rd., " by 51 Mill St., DEP# 270-279
RGB# 1995-29 The applicant requested to continue. A motion was made and seconded
to continue the Public Hearing to 11/19/97 at 8:30 PM. Voted: 7-0-0.
9:10 PM RGB Extension - 10 Franklin St., RGB# 1995-24 The Administrator advised
that one house is under construction and there is a foundation in on the second one. A
motion was made and seconded to grant an extension from 10/27/97 to 10/27/98. Voted:
7-0-0.
9:16 PM Public Meeting - by 35 Dunbar Rd., RGB #1997-30 The owner stated to the
members that the lot was approved by the town some time ago. Chair went over the site
notes of 10/18/97. Herbert Gravlin questioned where the house would be on the lot, and
the applicant advised that it would be determined by the wetlands. A motion was made
and seconded to close the Public Meeting. Voted: 7-0-0. A motion was made and
seconded to issue a positive determination of applicability and establish a line in
accordance with site notes. Voted: 6-0-1, H. Hulse abstaining.
9:20 PM Pasture Rd., DEN 270-242. RGB# 1992-07 A motion was made and
seconded that work at the end of Pasture Rd., to be an insignificant plan change if
approved the by Town Engineer and Building Inspector. Voted: 7-0-0.
_ 9:30 PM RRequest plan change/bond reduction - Lot 6 Carriage Estates H A motion
was made and seconded that a "significant" determination be made. Voted: 7-0-0.
9:40 PM Continued Public Hearing - "Sunset Rock" - 341 Franklin St., DEP# 270-
,295. RGB# 1997-26 H. Hulse abstained and left the room. Present were Atty. Brad
Latham, the applicant, and Mr. Bergeron. The applicant was given a copy of the site
notes.
Mr. Bergeron explained the plan changes; 11 house lots instead of 12, 120 sq. ft.+ deeded
as a conservation restriction of which 64% is upland area. M. Gillis asked what
percentage of the property would be under the conservation restriction; Mr. Bergeron
stated 30%. S. Chapman reviewed the site notes taken at the replication areas located in
N. Reading and N. Andover. Chair asked for clarification of the marked trees on the site.
S. Chapman asked if a ground water monitoring system was going in. Mr. Bergeron said
they hadn't planned on it. Chair read the wetland regulations. S. Chapman questioned if
the fire chief had given his okay for the driveways on Lots 4 & 9. The Administrator
stated his opposition to the tree line being the line for the ZNV. Chair asked if the public
had any comments. John Kachichian, 11 Joseph Way, thanked the Commission for their
concerns of the replication areas. Ed Bahia, 5 Sandra Ln., is concerned with the runoff
upward to the adjacent neighbors. Kathy Kachichian, 11 Joseph Way, is concerned about
water in her basement. Mrs. Finigan, 50 Kieran Rd., asked why they are being able to
build on wetlands. Chair explained wetland regulations. John Kachicbian-asked if there

was a vernal pool; L. Kenney stated that no one has shown that it is nor does he feel there
is from the habitat. Gloria Brown, 378 Franklin St., thanked the Commission and said the
neighbors will remember that the Commission said that all requested items will be adhered
to or the project will be denied. A motion was made and seconded to continue the Public
Hearing to 11/5/97 at 8:30 PM at the request of the applicant with no further notice to
abutters. Voted: 5-0-1, H. Hulse abstaining.
11:30 PM Administrator sign-offs: larger deck, replant lawny shrubs, replace fence
12 Johanna Dr. A motion was made and seconded that the Commission endorse the
Administrator to sign-off. Voted: 7-0-0.
11:35 PM A motion was made and seconded to adjourn. Voted: 7-0-0.
