Minutes of Wednesday, November 5, 1997 Town Hall Selectmen's Meeting Room
PRESENT: Chair Nancy Eaton, Members: Vice Chair Stephen Chapman, Clifton
Proctor, Harold "Lucky" Hulse, Mark Gillis, J. Kilborn (7:15), David Danis, Consultant
Leo Kenney, Conservation Administrator Donald Nadeau, and Recording Secretary Kathy
Morgan.
7:05 PM Meeting was called to order.
7:06 PM Plan Change - "51 Sanborn Lane" DEP# 270-281, RGB# 1995-35
Mr. Chuha submitted written responses to the Commission's site visit report he had
received earlier and showed the members pictures of the property. He outlined certain
trees that he would like to remove. The Administrator read a part of the Order from
Natural Heritage where they wrote that this project would adversely affect the wetlands.
Mr. Chuha stated that the Order was written prior to Natural Heritage visiting the site.
Members suggested to Mr. Chuha to plot out a planting plan.
7:45 PM Notice - 36 Dunbar Rd. and end Mr. Skinner, the owner, showed the
members pictures of before and after the debris was removed. Chair thanked him for his
prompt compliance.
` 7:50 PM Plan Change - "Lot 4 Old Mill Village" (4 Old Mill Ln) DEP# 270-283,
RGB# 1995-31 Mr. Hurley presented the Commission with a plan of Lot 4 showing the
shifting of the house. He advised the members that there is now 1250 sq. ft of impervious
area instead of 1500 sq, ft. A motion was made and seconded that the Commission vote
that the plan change be deemed insignificant. Voted: 7-0-0.
8:00 PM Notice: Lot 19 "Carriage Estates H" (54 Zacharv Lane) DEP# 270-236.
RGB#1991-10 Mr. Shawn Carney, the site contractor, apologized to the. Commission for
not having the haybales in the proper place as outlined in the Order. The Administrator
stated that the haybales are only 8 P away from the vernal pool and the difference between
that and the 100' mark has been disturbed. The members advised Mr. Carney to read the
Order of Conditions. Mr. Carney was given a copy of the site notes. A motion was made
and seconded that the Administrator sign-off on the building permit upon receipt of
$2,000.00 bond and a plan showing detail of impact upon place of remediation and
agreement that the applicant will move haybales to the right location with the
understanding that the Commission will not issue Certificate of Compliance until satisfied
of the accomplishment of all work. Voted: 7-0-0.
8:30 PM Continued Public Meeting - 71 Red Gate Lane RGB# 1997-29 Chair
advised that Town Counsel's opinion is that the only permanent condition in the COC on
the property is for maintaining the swale on the side of the lot. "Commission "conducted a

site visit 11/1/97, and the applicant was given a copy. Chair reviewed some of the
observations made while on site. Mr. Wendell Holmes, the pool contractor, explained to
the members that the shallow end (3' deep) would be located by the garage and that at the
deep end (8' deep) they maybe in ground water about 4'. He explained his procedures for
removal of material and the materials used in the construction. Larry Beaulieu, 62 Red
Gate Lane, raised the question of a restriction on the property. He also warned the
Leahys of what the water damage could do to their pool. Kris Holmes, 77 Red Gate
Lane, asked what future recourse neighbors would have if they have water problems.
Chair advised her that there are legal procedures she could take. Peter Newhall is
concerned with water problems on his property. John Cafazzo, 67 Red Gate Lane, is
concerned with water in his basement. Mr. Holmes stated that neighbors should be more
concerned with surface water than the underground water. S. Chapman restated that the
ground water flow would not change and that the pool would take up some surface water.
He asked Mr. Holmes what they would do if they hit peat. Mr. Holmes state the peat
would be removed and rip rap installed. He also stated that if more than 22' of peat
needed to be removed, he would not advise putting in the pool. A motion was made and
seconded to close the Public Meeting. Voted: 7-0-0. A motion was made that the
Commission issue a negative applicability with standards for control of water during
construction to include as a minimum a line of silt fence or haybales and a means of
filtering water prior to discharge and that controls are reviewed and accepted by the
Administrator, seconded. N. Eaton asked if the maker would amend the motion to add,
that maintaining swale on easterly side of garage and the swale crossing the lot in front of
the garage be cleared during construction or in perpetuity. The maker amended to his
motion, north, east, and west sides of the lot swales shall be maintained free and clear
during construction. The seconder accepted the makers amendment to his motion.
Voted: 7-0-0.
9:17 PM Continued Public Hearing - "Sunset Rock" - 341 Franklin St DEP# 270-
295. RGB# 1997-26 Chair read the Public Hearing announcement and the attendees were
sworn in. The members introduced themselves and Mr. Hulse abstained and left the room.
A site visit was conducted on 11/1/97, and Atty. Latham was given a copy. The applicant
submitted at the site visit a new topography plan and a new planting plan. Atty. Latham
requested a continuation and listed reasons for it: 1) A letter from Dr. Sanford, 2) A new
replication plan, 3) Concerns with the piping system, 4) CPDC would like the road
shortened more, 5) the location of the driveway at Lot 9. Atty. Latham requested that
the Commission do another site visit prior to the next Public Hearing. Will Finch, 51 Mill
St., thought the owner was making a good gesture of the CR but still feels they are within
the buffer and feels that the 25 buffer is not enough. John Kachichian, 11 Joseph Way,
read an article he brought that urged the protection of open space. He is also concerned
with the replication of the wetlands and said that trees should not be removed. He also
stated that the stream contributes to the Ipswich River and houses in the development
might use pesticides which could get into the water system and into the drinking water. A

motion was made and seconded to continue the Public Hearing to 12/3/97, at 7:30 PM, in
this room. Voted: 6-0-1, H. Hulse abstaining.
Old/New Business
9:35 PM Approve sign-offs - 27 Lilah Lane Owner had hand dug a hole and removed
material prior to the Administrator inspecting the project. A motion was made and
seconded to approve sign-off. Voted: 7-0-0.
9:38 PM Tracking procedure for conservation acquisitions A motion was made and
seconded that the Commission approve the procedure for tracking information. Voted:
7-0-0.
9:40 PM Bare Meadow encroachments - 739 Pearl St., 1257+ Main St The
Administrator advises that the problem has been taken care of.
9:42 PM 116 Van Nord-en Rd. The Administrator advised members of a violation at the
premises. There had been rocks and material dumped at the back of the property. The
owner stated he would take care of it.
9:57 PM RFP Consultant Members discussed obtaining a consultant to review the
crossing and the replications. The Administrator will find out names of consultants, their
availability and obtain bids. H. Hulse stated that he favors bridging over crossings.
10:00 PM The Administrator advised the members that there has been fill dumped at the
gas spill restoration site without prior consent. The Administrator will issue a cease and
desist.
10:08 PM A motion was made to go into Executive Session to discuss ongoing litigation
and real estate matters and not to return to Public Session. Roll-call vote taken: 7-0-0.
