PRESENT: Chair Nancy Eaton, Members: David Danis, Clifton Proctor, John Kilborn,
Harold "Lucky" Hulse, Consultant Leo Kenney, Conservation Administrator Donald
Nadeau, and Recording Secretary Kathy Morgan.
ABSENT: Vice Chair Stephen Chapman and Mark Gillis
7:10 PM Meeting was called to order.
7:15 PM Minutes: A motion was made and seconded to accept as amended the minutes
of 7/23/97. VOTED: 5-0-0. A motion was made and seconded to accept the executive
minutes of 7/9/97 as amended. VOTED: 4-0-1, Mr. Hulse abstained. A motion was
made and seconded to accept the 7/9/97 minutes as amended. VOTED: 4-0-1,
Mr. Hulse abstained.
7:20 PM Chair advised members that there had been a fire at the Kurchian Woods
Conservation area. The cause of the fire is still under investigation. After researching,
Chair informed other members that there is $1,700.00 in the Conservation Trust Fund.
Old/New Business
7:30 PM DPW watercourse maintenance - Henzie St DEP #270-241, RGB #1991-25
A site visit was conducted and it was uncertain whether cleaning out the watercourse
would drain the vernal pool. Members discussed putting a berm around the pool.
Members will inspect again.
7:35 PM DPW watercourse maintenance - 905 Main St DPW advised that they have
done no work on the east side of Main St. other than at Waiter Mack's house. A motion
was made to direct landowner to refill or repair the watercourse within 30 days of
postmark of their notice. An amendment was made to the motion that the landowner take
the necessary action within 14 days. Maker accepted the amendment, seconded.
VOTED: 5-0-0.
7:43 PM Public Hearing Notice proposed Zoning Articles first draft of articles
Chair asked members to read the articles and if there were any questions, she would bring
them to CPDC.
7: 45 PM Status Old Mill Village PRD 48 Mill St., DEP# 270-283, RGB# 1995-31
Mr. Hurley came before the Commission and advised that the plantings were completed.
The Administrator asked for the Commission's permission to sign-off on the foundation
_ permiton Lots 1 & 5. Chair asked Mr. Hurley what the status of the detention basin was.

W. Hurley stated that the detention basin was in but that it wasn't foamed or seeded. A
motion was made to extend the time for receiving the planting report until 8/22/97 and
authorizing the Administrator to sign-off on foundation permits on Lots 1 & 5, seconded.
VOTED: 5-0-0.
Status of Litigation Chair gave a brief synopsis of the Eric's Greenhouse litigation. She
stated that the judge felt he couldn't assess total ticket fines because there were only two
complaints. The Court has appointed a Master to see that Mr. Goddard complies with the
provisions.
8:00 PM Public Meeting- 22 Ashley Place RGB# 1997-21 Mr. Tenaglia presented a
plan for construction of a swimming pool and requested the Commission to relocate 3
maples. Steve Zagorski, engineer for the pool, said he had spoke to both the
Administrator and Mr. Delaney. Mr. Delaney wanted them to add 17to the proposed
wall. Mr. Zagorski felt that 10' was ample and that he had concurred with the
Administrator. Mr. Zagorski was asked that he show changes on his plan of the erosion
controls and the retaining wall that Mr. Delaney required . Mr, Brian Mahoney, 30 Ashley
Pl., asked the applicant in which direction the downspout to the pool would go. The
applicant stated possibly around the house and under the deck. A motion was made to
close the Public Meeting. VOTED: 5-0-0. A motion was made and seconded to issue a
negative determination of applicability with the changes made to the plan submitted with
RDA. VOTED: 5-0-0. The applicant was advised that the Administrator would need to
inspect the erosion controls before work begins.
8:15 PM Status of 232 Salem St tree house, dog run The Administrator stated that the
applicant is going to appeal. He spoke with Town Counsel and asked if violations could
be served prior to the appeal; Town Counsel will research. After a site visit to the
adjacent property, L. Kenney questioned whether the items in violation are on Mr. Pratt's
property because the plans that were submitted on the adjacent property show the
property line over further. Members decided to wait and see what happens with the
appeal process.
8:30 PM Public Meeting - 220 Charles St RGB #1997-20 Mr. Glen Thompson and
Ms. Donna Secher, owner, presented plans to make the house wheelchair accessible.
Applicant amended plans to show the removal of trees and the slope change. Chair and
the Administrator gave reports of their site visit and their opinions to remove or not
remove certain trees. Due to a swale going back into the wetlands, Chair gave concerns
about grading off the slope. The Administrator gave reasons why he felt the grading on
the slope could be done. A motion was made and seconded to close the Public Meeting.
VOTED: 5-0-0. A motion was made and seconded to issue a negative determination of
applicability with the removal of trees 1, 2, & 6, tree 3 to be trimmed or dropped at the
advice of an arborist, tree 4 to be cut and dropped, and tree 5 to stay. The applicant is to
add erosion controls to the submitted plan and the Commission will allow grading on the

south-westerly side as shown on the plan to be approved by the Administrator prior to
being done. VOTED: 5-0-0.
9:05 PM Public Meeting 196/232 Salem Street RGB #1997-17 Mr. Hulse abstained
from the meeting and left the room. Atty. Cicatelli and Mr. and Mrs. Williams were
present. The applicants requested an extension due to documents being received too late
for consideration by the members. Mr. Cicatelli told the members of problems with
vandals moving the flags. Chair mentioned that vegetation plots were hard to locate.
Members suggested marking trees and giving points off those trees. Chair requested an
additional pit be dug in the area between flags 6A & 22. The Administrator asked for an
additional pit near S26 & 27. A motion was made and seconded to extend the meeting to
8/20/97, at 7:30 PM, in the Selectmen's Meeting room with no further notice. VOTED:
4-0-1,
Mr. Hulse abstaining.
9:25 PM A motion was made and seconded to adjourn. VOTED: 5-0-0.
