Minutes of Wednesday, December 17,1997 'T'own Hall Selectmen's Meeting Room
PRESENT. Chair Nancy Eaton, Members: Clifton Proctor, Harold "Lucky" Hulse,
David Danis., John Kilborn, Consultant Leo Kenney, Conservation Administrator Donald
Nadeau, and Recording Secretary-Kathy Morgan.
ABSENT: Mice Chair Stephen Chapman, Mark Gillis
T30 PM Meeting was called to order.
7:31 PM Minutes A motion was made and seconded to accept the minutes of 11/19/97
as amended. Voted; 4-0-1, D. Danis abstaining„
7.32 PX1 Approve sign-off 57 Lilah Lane A site visit was conducted 11/29/97, and the
Chair read the site notes into the record. The owner, Peter Cerbone stated that a
contractor would complete the job. L. Kenney felt that the more trees removed from the
area the more damage to the resource area and habitat. He also mentioned that in 1991
the owner agreed to build only a one car garage instead of a two car which was then
requested. A motion was made and seconded to approve the sig,-i-off of three of the s
closest trees and to add other ground cover species other than lawn in the area that the
trees are coming out of Voted. 5-0-0. The applicant asked what recourse he had and
the Chair explained the appeal process to him.
7.55 PM Continued Public Hearing "Sunset Rack" by 341 Franklin 5t. IDEP# 270-
291-5. RGB# 1997-26 The public hearing notice was read and the attendees sworn in.
H. Hulse abstained and left the room. The applicant, Mr. Bergeron and Atty. Brad
Latham were present. Mr. Bergeron submitted additional information and revised plans
dated 12/8/97. CPDC has agreed with the narrowing of the roadway. Chair mentioned
that face sheets 5 & 6 which should be 5A & 6A were not carried over to the topo plan.
w1r. Bergeron stated that because of Rule 22 under the old zoning regulations it was noted
on the plans. The Administrator stated lie hadn't had time to review the changes. The
Town Engineer hasn't remarked to the Commission on the new plans. Chair questioned
the construction sequence of the replication area on Lot 8. Mr. Bergeron stated they
would start at the rear side of Lot 8. Chair remarked on Para. 11, "mulch bed for
reducing erosion." Mr. Bergeron said he would eliminate the word "reduce".
X11r. Bergeron noted that the crossing width has been narrowed to 37'. L. Kerley
suggested using native high bush blueberries on site instead of small hybrid blueberries and
also more red maples; the owner agreed to double the number and size of red maples.
L. Kenney also stated that trees should marked if they are to be cut. Members discussed
restaking for accuracy. Limiting activity on Lot 8 was discussed. Atty. Latharn explained
the conservation restriction around Lot 8 and how it would be worded into the deed and
feels they have met the criteria. L. Kenney suggested eliminating Lot 8 to make up for the
clearing of resources in Lots 4 & 5. Mr. Bergeron feels that with the conservation

restriction and other changes they have made they have taken sufficient mitigating
measures. Atty. Latham- urged the Commission to close the public hearing. Chair took
comments and questions from the public. Charles McDonald doesn't want any-thing done
because of the environment and existing habitat. John Kachichian, 11 Joseph Way, feels
that we are responsible to the environment. He mentioned the water supply, habitat,
wetlands. He asked how the Commission will know if the applicant follows the
construction process and what happens if they violate it_ Chair infortned him that the
Administrator would be checking up and fines or replication would be done if they violate
the order. John asked where the water discharge will go in the field. Chair explained that
the applicant is grading the area so water doesn't flow toward Joseph Way. Mr. Bergeron
stated that no ature water would flow onto Joseph Way. Dave Osbourn, 33 Joseph Way
asked if all the construction vehicles would be coming in frorn Franklin St. Chair stated
CPDC would have jurisdiction over that- Gloria Brown, 378 Franklin St., asked the
Commission if this is a good site for homes and if the builder, in the spirit of Christmas,
would donate the land to the town. Mr. Bergeron stated they have put a conservation
restriction on 33% of the land. Kathy Kachichian, 11 Joseph Way, asked why the hearing
is being closed. She feels the public has the right to know what's going on and is
concerned with the drainage and would like some hydraulic information. Mr. Bergeron
explained the elevation levels of Joseph Way and that the hydraulic information shows that
-measures are lowering. Gloria Brown told the Commission that she feels that the site isn't
good for new homes. C. Proctor advised her that it's not up to her to make that decision.
Mr. Edwards, Town Planner, came into the meeting at 8:50 PM. He advised the attendees
when CPDC would be holding a meeting on this project. He advised the Commission to
act on their information and CPDC will act accordingly. Atty. Latham again asked the
Commission to close the Public Hearing. Mr. McDonald asked what recourse the public
would have if other issues should arise after the hearing is closed. Chair advised hire of
the appeal procedures. The applicants stipulated that no structure would be done any
ffa user south or east on the house box shown on the purls at Lot 8, only a walkout
basement and patio. A motion was made and seconded to close the Public Hearing.
Voted: 4-0-1, H. Hulse abstained.
9:09 PM J. Kilborn left the room.
9:10 RN't Public Meeting - 24-30 Baystate Road RGB# 1997-32 A letter was received
from Hayes Engineering for a continuance. A motion was made and seconded to
continue until 1/7/98 at 9:30 PM. Voted: 4-0-0.
9:15 PM Public Afeetimg - Route I29/Later-state 3 interchange MGL only(RGB#
1997-33 Present were Bernie Raftery, Environmental Scientist at Rizzo Assoc. and
Mike Paiewonsky from Mass. Highway. A site visit was conducted and applicants
received a copy of the notes. It was mentioned that the drawings submitted were 60 scale
and that Revay brook and other streams in area 5 were not listed; applicant will have their

included on the next plaits. Chair mentioned that the Coats-nission had delineated a line at
the DPW garage. L. Kenney stated that wetland area 3 drainage calculations were only
calculated on one rainfall. Mr. Ra#lery advised that only once a year calculations are
required to qualify for isolated land subject to flooding, which is b" and this area was only
4". Chair asked for comments and questions from the public. Gina Snyder, 11 Jadem
Terrace, is concerned with the area around the wells. Will Finch, 51 Mill St., pointed out
where he has seen an endangered species and ask that they take that into account. The
Administrator mentioned that if an incident occurs in the Wilmington buffer, Wilmington
would have the jurisdiction even if it continues into the Reading buffer zone. Indiria
Balkissoon, 12 Wakefield St., asked if Wilmington and Reading Conservation
Commissions could communicate information. Members seemed to favor the idea. A
motion was made and seconded to continue the Public Meeting to 1/7/98 at 7.15 PM in
this room with no further notice. Voted: 4-0-0.
9:50 PM Carriage Estates Phase JAI Lot #19 Applicant explained correction made to the
haybale line and proposed plantings. The Administrator will make a site visit and report to
the Commission at their next meeting.
10:00 PM Lot 5 Old Mili VillaVillage DEN 270-283, RGB#1997-3 Dave Hurley reported
that the conservation signs are posted and bonds still in place. He requested the
Administrator to sign-off on the Certificate of Occupancy. The house has rotated from its
- original position but was reduced in size. A new as-built plan was received dated
12/12/97. A motion was made and seconded to allow the Administrator to sign-off on
the Certificate of Occupancy. Voted: 4-0-0.
10:09 PM J. Kilborn came back into the meeting.
10:10 PM Public Meeting - between 38 c& 56 Cross Mr. Pacillo, his wife, daughter
and son-in-law were present. The applicant submitted plans for a single family home and
requests a wetland delineation; he states the lot is not subject to flooding. He also stated
that the land is recorded as a "130" - a buildable lot. A site visit was conducted. Mr.
Pacillo showed staked areas. The area is a red maple area and Chair explained that based
on a USGS map the stream is presumed to fall under the Quad sheet. Pauline Castanino,
56 Cross St., explained the water problems she has had even with drains and berms
installed. She feels this project will cause additional problems. She suggested that if
permits are granted that mitigative measures be taken. Fred Giannelli, 45 Shackford Rd.,
asked if plans were available so that he could see how his house would be affected. Chair
stated that the applicant should establish a wetland line along the street and east side and
then the applicant could come back to the Commission with an RDA or NOI. A motion
was made and seconded to continue the Public Meeting to 1/21/98 at 7:30 FM in this
room with no further notice. Voted: 4-0-1, D. Danis abstaining.

10:45 PM Second Notice - 1364/1375 Main Street The Administrator was advised to
continue with the violation process.
11:00 PM A motion was made and seconded to adjourn. Voted; 5-0-0.
