Minutes of Wednesday, August 12,11-008 't'own Nall Selectmen's Me ~rgy,ppod ~ ` 2 PRESENT: Chair Nancy Eaton, Members Harold "Lucky" Hulse, Will Finch, John Casciano, Kathy Smith, Consultant Leo Denney, Conser~ration Administrator Donald Nadeau and Recording Secretary Kathy Morgan ABSENT: Stephen Chapman and Mark Gillis 7:17 PM The meeting was cared to order. 7:20 PM Status - 28 Fox Run Lane Administrator advised that the owner would like to wait until the first fiost to clean up due to allergies. Members advised the Administrator to tell the owner that fines will". be issued if the work is not completed by 9/9/98. 7:30 PM Zachaa Lane Hamid Sorornejad, owner of Lot 6, is concerned with the dumping on Lot 7. Chair explained the process that the landowner is going through. The Administrator will speak with the owner about the dumping. 7:40 PM !Carriage Estates II, Lot 7, DEP# 270-287, RGD# 1996=15 A motion was :Wade and seconded that a one year extension be granted to expire on 11/21/99 with conditions as discussed. Voted: 5-0-0. 7:42 PM Lot 12, Cory .Lane, DEP## 270-236., RGD# 1991-10 A motion was made and seconded that a one year extension be granted to expire on 10/3/99 with the discussed conditions. Voted: 5-0-0. 7:45 PM Continued Public Hearing - Coolidge Middle School, 89 Birch Meadow Dr. DEP# 270-306, RGB# 1998-17 The public announcement was read and attendees sworn in. Ms. Golden explained the changes, outlined in her memo dated 8/6/98, made to the new plan submitted, revised date of 8/5/98. Members were satisfied with the changes. She then reviewed the temporary and permanent waivers also outlined in her memo dated 8/6/98. The drainage into the storm drain outlet into the 25' ZNV was discussed and decided that it should be written down as a permanent waiver. The Administrator stated he would like to see a splash guard 5-6 ft. wide for the drainage, pulled back away from the wetland as far as possible. A motion was made and seconded to close the Public Hearing. Voted: 5=0=0. 8:15 PM Draft Order of Conditions - Coolidge Middle School A motion was made and seconded that an Order of Conditions as amended be approved and issued. Voted: 5-0-0. 0 :57 PML Recess taken. Reading ConseMation Conn nission Minutes of 8/12/9 Wage 2 9:07 PM Public Meeting - 91 Whittier Rd., RSR# 1998-21 Mr. Downing advised members that he is a member of a committee in town and is bringing this project before them as a private citizen. Ater reviewing the project, a motion was traad and seconded to close the Public Meeting. Voted: 5-0-0. A motion was made and seconded that a negative decision be issued with conditions as discussed. Voted: 5=0-0. 9:10 PM Approve Minor Project -.116 Van Nordean Rd. W Boni explained that he has taken down the shed. The Administrator was Satisfied With the work on his site visit. A motion was made and seconded to allow Administrator to approve as a minor project the moving of the dog pen to the new area. Voted: 5=0=0. 5:12 PM Continued Public Hearing land between 196-232 Salem Street, DEP# 270-305, RGR# 1998-18 The public announcement was read and attendees sworn in. Mir. Hulse abstained and left the meeting. The Mlilliams, Atty. Posner, Mr. Melberg, and Mr. Redmond were present. Chair reviewed discussions of the compensatory area with Town Counsel and the Town Engineer and felt because of the size of this project they could waive it. Nor. Posner read 10.57(4)(1) of the General Performance Standards for Lands bordering wetlands, and explained how it relates to flooding of other improved properties. The Administrator stated that the law not only applies just to improved lands of flooding. He mentioned how DEP appealed the case at Cedar Swamp. Mr. Posner stated that the land beyond the wetland line, including the upland area - the narrow portion of the tongue, 6A - 23, would be included in the conservation restriction. Atty. Posner was concerned with having public access because of trespassing but stated the applicant would consider passive use. Chair stated the Commission would like to have an access point to Timberneck Swamp Conservation area. Chair asked about the deed restrictions mentioned in his submitted draft conservation restriction. 'Mr. Posner stated that he hadn't intended to reflect on the geographical area. W. Finch questioned why the conservation line was so close to the vernal pool. The Administrator recommended that the --conservation restriction line be coincidental with the ZNV line to protect habitat. Atty. Posner said they are making the conservation restriction a condition of the Order of Conditions. The applicants were advised that they would need to install boundary markers. L. Kenney stated he would like the compensatory storage where it is proposed and in other places for removal of fill such as near flag 29, 30, and 31 where there is a significant slope. Atty. Posner proposed they get something in writing for the permit and then have the Administrator meet in the field with the botanist or contractor to decide what would be practicable. W. Finch stated he would rather the project come in for only one house lot. L. Kenney stated he would like to see the bike path regraded with a layer of clean loam, saill and mulch and allowed to revegetate. 1'.r1r. Mr. Posner expressed his appreciation to the Conunission for compromising with them and will endeavor to comply -with their wishes. A motion was made and seconded to close the Public Hearing. Voted: 4-0-1, Mr. Hulse abstained. Members discussed the proposed house on this lot so close to the vernal pool. L. Kenney is concerned with the runoff and suggested a bean. He felt there would be no difference having one house with a big yard or two houses with small yards. After some discussion, the Administrator drew a proposed line reflecting the conservation restriction line which was mutually agreeable to both the members and the applicant. Chair mentioned that the house at Strawberry Lane is also close to a vernal pool. She felt this area wouldn't be any =,vorse off with two houses built on it and restoration of the bike path. T Denney disagreed. K. Smith felt one house would be preferable but felt that for what the town is getting in return it is worth letting the two houses go u~. J. Casciano felt the Commission should vote for the best interests of the site and not because of any threats. 10: 55 PM Plan Change - increase 8' x 114 patios to 14' x 14' =1lnits 10. 11, 12 Leaning Elm Farm A motion was made and seconded that this is an insignificant plan change. Voted: 4=0=1, J. Casciano abstained. 10:57 PM A motion was made by H. Hulse to go into Executive Session for the purpose of discussing litigation and not to return to public session. J. Casciano seconded the motion. Roll=call vote taken; .1. Casciano = yes, W. Finch =yes, H. Hulse = yes, N. Eaton - yes, K. Smith - yes. 5-0=0.
