Minutes of Wednesday, October 21, 1998 Town Hall Selectmen's Meeting Room
PRESENT: Chair Nancy Eaton, Members Stephen Chapman, Harold "Lucky" Hulse,
Will Finch, Kathy Smith, Consultant Leo Kenney, Conservation Administrator Donald
Nadeau and Recording Secretary Kathy Morgan

7:08 PM The meeting was called to order.
7:09 PM Minutes A motion was made and seconded to accept the minutes of 9/23/98,
as amended. Voted: 4-0-1, W. Finch abstained.
7:12 PM Extension - Old Mill Village PRD DEP# 270-283, RGB# 1995-31
Mr. Hurley received a copy of the site visit. He said he would start taking care of the
items outlined in the site notes. Chair was concerned with the canopy in the replication.
The Administrator was instructed to verify the replication of planting survival as instructed
and also verify the wetland line. Members felt a 6" concrete marker with a piece of rebar
through it would be sufficient for the markers. A motion was made and seconded that the
Commission grant an extention until 8/13/99. Voted: 5-0-0.
` A motion was made and seconded to allow the removal of the silt fence and haybales with
the exception of the front sidewalk. Voted: 5-0-0. A motion was made and seconded to
authorize reduction of the bond on silt fence by $500, haybales by $500, detention by
$1,000, Lots 1 & 2 by $2000, Lots 2, 3, & 4 by $4,000, leaving new totals of detension
$500, wetland replication $2,000, Misc. $2,000, Cont. $2,028, and Lots 2, 3, & 4 $500.
Voted: 5-0-0.
A motion was made and seconded that the Commission determine a request for plan
change for concrete posts in lieu of metal posts an insignificant plan change and the
approval for the applicant to use 6" markers instead of 8", with a single piece of rebar
placed within it. Voted: 5-0-0.
7:30 PM Continued Public Rearing - 511/67-Sanborn T n DEP# 270-xx , R #
1998-20 A motion was made and seconded to issue an extension until 11/18/98 at
7:30 PM with no further notice to abutters. Voted: 5-0-0.
7:36 PM Vote/sign Amendment to Order - 80 New Crossing Rd DEP# 270-2983
RGB# 1998-01 Members were concerned with paragraph 28 concerning the execution of
the conservation restriction. Mr. Fuller agreed to the wording that no activity other than
what was originally approved under the subsequent Order of Conditions take place prior
to execution of a conservation restriction which is satisfactory to the Commission. It was

then amended to mean any construction on the second floor addition. A motion was
made and seconded that the Commission approve and issue as discussed the amendment
to the Order. Voted: 5-0-0.
7:45 PM Public Hearing 3981/420 Haverhill St DEP# 270- xx, RGB# 1998-24
Paul Finocchio, P.J.F. Assoc. explained the proposal for a single dwelling consisting of
2600 sq. ft. and a driveway consisting of 600 sq. ft. He also stated that right now the
foundation will be a slab foundation. Walter Kittredge, wetland scientist, summarized the
area having red maples, the adjacent upland area being flat, a drop in elevation to the
wetland at which point the vegetation changes. He stated that the soil is mostly fill, rocky,
and sandy. Chair summarized the site visit notes taken on10/17/98. S. Chapman asked
what the limit of wetland protection was. Mr. Finocchio stated at the 82 contour line.
S. Chapman was concerned with the construction around the haybales and asked if foot
traffic would go through the exit near the west side adjacent to the ZNV. Mr. Finocchio
indicated there may be but on limited basis.
Mr. Finocchio hadn't done any drainage calculations and, therefore, couldn't answer some
of the abutters questions regarding that. Joanne Perry, 356 Charles St., asked about the
culvert that runs under Haverhill St. which helps take water out of her yard. Mr.
Finocchio stated they wouldn't be doing any work in that area. Jim Divito, 251 Haverhill
St., asked about the 40' right of way easement adjacent to the house lot. Mr. Finocchio
stated the easement was from the previous development and no longer exists. Andrew
Herlihy, 432 Haverhill St., questioned the intermittent stream. Members reviewed the
USGS quad sheet and found that the stream is not shown on it. Roger D'Entremont, 398
Haverhill St., explained how the stream flows and how development in the area has
increased the flow to the point that now the stream goes up to the culvert. Donald Hall,
392 Haverhill St., is concerned with drainage and flooding. Salvatore Bramante, 61 Grey
Coach Rd., stated he has retention ponds on his property. Mr. Finocchio advised that the
area where this property lies the stream runs downstream away from his property.
Chair advised that the applicant should submit the plan to Natural Heritage. S. Chapman
suggested Mr. Finocchio show more detailed spot grades around the structure. W. Finch
was concerned with the area at the back of the house being only 10' away from the
wetlands and would like a definite marker at the limit of activity line. The Administrator
suggested stone markers. Members made it known to the applicant that they would not
like to see a deck or anything similar to close in the "L" section. S. Chapman stated he
would like to see the 25' buffer maintained but felt the applicant could go into the 100'
buffer to clean up debris. S. Chapman would like to see the building design and have an
idea of the roof runoff. W. Finch suggested that any planting in the area be more native
species. A motion was made to continue the Public Hearing to 11/18/98, at 8:00 PM, in
the Selectmen's room, with no further notice to abutters. Voted: 5-0-0.

9:23 PM Town Meeting Warrant Members will discuss more at their next meeting
when more information is available.
9:40 PM 1090/1100 Main Street The Administrator advised that Mr. Goddard is eager
to get the greenhouses installed. Chair stated that Mr. Goddard should submit a filing and
the Commission can react to it. Chair also stated that Mr. Lenthall, from MRCS, advised
that it is up to the Commission to decide if what he is doing is agricultural. A delineation
line has to be established, and when the filing is submitted, abutters must be notified.
