ZONING BOARD OF APPEALS
MINUTES OF FEBRUARY 18, 1999

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of
the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Mr. Vaccaro swore
in, under oath, those present that would be addressing the Board this evening.
Case #99-02, K. Krekorian, Trustee for Greenhouse Acres Condominiums,
Carnation Circle, Reading, MA.
Attorney Steven Singer was present for the petitioners. Attorney Cohen Town Counsel
was also present. The petitioners are seeking an official document from the ZBA
authorizing the town to establish rubbish collection at the property. Currently there is
private rubbish removal but as a result of Town Meeting changing the old bylaw that
townhouses provide their own trash pick up, the town will start rubbish collection. This
complex requires a document that would authorize the town to start collection. The town
manager advised the petitioner to get that authorization from the ZBA. Members felt this
matter was not within their jurisdiction but in an attempt to ratify the situation the
following motion was made.
A motion was made that the Commission modifies its special permit, issued under Case
#1987-08 and instructs the trustees of Greenhouse Acres Condominiums submit a plan to
the town for rubbish collection which modifies the earlier plan submitted following the
2/25/87 accord, Case #1997-8, such plan to be consistent with current town laws and such
plan to be submitted to the Board of Selectmen for their consideration. The motion was
withdrawn.
A motion was made and seconded that the Board modifies its special permit issued under
Case #1987-08 to instruct the trustees of Greenhouse Acres Condominium to submit a
plan to the town which modifies the earlier plan required under Item III,B,2b of the
decision of the Zoning Board of Appeals of February 25, 1987, concerning rubbish
collection, such plan to be consistent with current town laws and policies concerning
municipal rubbish collection, and such plan to be submitted to the Board of Selectmen for
their consideration. Voted: 3-0-0. Special permit so modified.
10 Sylvan Rd., Lot 21, belonging to James G. Lenox and Catherine M. Lenox. The
owners have installed a swimming pool on Lot 21. Members questioned whether a
f swimming pool would be classified an accessory use. It was felt that by installing the pool

on Lot 21 the owners might have merged the three lots where one lot had been given a
special permit for separation. Members felt the contract made between the building
inspector and the homeowners may be considered as a variance on the special permit.
Members will discuss the matter further when it comes up on the agenda.
Case #99-03, Mark McInerney, 144 Village Street, Reading MA.
The two-story house is now a nonconforming structure in the front, back and on the side
yard of the house. The new construction will only be nonconforming in the front.
Although no abutters were present, it was felt that the amount Mr. McInerney would be
changing to the roofline wouldn't cause a hardship on his neighbors.
A motion was made and seconded that the Commission grant to Mark McInerney, for the
property located at 144 Village Street, a special permit under section 6.3.3.4 of the Zoning
bylaws for the purpose of raising the roofline approximately 4' at the eves as described on
plan submitted with this application. Voted: 3-0-0.
A motion was made and seconded to adjourn. Voted: 3-0-0.
