HomeMy WebLinkAbout1999-12-16 Zoning Board of Appeals MinutesTOWN OF READING _ fie ZONING BOARD OF APPEALS MINUTES OF DECEMBER 16, 1999 52 MEMBERS PRESENT: CHRISTOPHER VACCARO, CHAIR IAN` JOHN COOTE, VICE CHAIRMAN MICHAEL LARKIN BERNARD O'SHAUGHNESSY SUSAN MILLER, ASSOCIATE MEMBER A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Building Inspector Glen Redmond was also present. Case #99-25 A Public Hearing on the petition of Richard Bowen who seeks a variance and or special permit under Section(s) 5.0/6.3.3.4 of the Zoning By-Laws in order to add a second level to anon-conforming structure on the property located at 67 Vine Street in Reading, Massachusetts. The Chairman swore in the applicants. Mr. Bowen owns a single family dwelling with a gambrel roof with dormers. The side yard is 8' on the issue side and 11' on the other side. He would like to add a second level above an existing 8' x 16' room. The addition does not change the existing footprint of the building. Christopher Vaccaro stated it is the Boards policy to allow people to build straight up on an existing structure without a variance, only a special permit. On a motion by John Coote, seconded by Michael Larkin, the Zoning Board of Appeals voted to close the Public Debate on Case #99-25. The motion was approved by a vote of 3-0-0. On a motion by Michael Larkin, seconded by John Coote, the Zoning Board of Appeals voted to grant the petitioner a special permit under Section 5.0/6.3.3.4 provided the project doesn't extend beyond the existing 8' x 16' room on the South Easterly side of the building. The motion was approved by a vote of 3-0-0. On a motion by John Coote, seconded by Michael Larkin the Zoning Board of Appeals voted to grant the petitioner to withdraw their petition for a variance. The motion was approved by a vote of 3-0-0. Zoning Board of Appeals Minutes of 12/16/99 page 2 Case #99-26 A Public Hearing on the petition of Marriott Senior Living Services, Inc. who seeks a special permit under Section(s) 4.3.1.4 of the Zoning By-Laws in order to construct a 115 unit assisted living facility on the property located at 40-42 West Street in Reading, Massachusetts. The Chairman swore in the applicants. Atty. Mark Favaloro represented the applicants. The 115 unit assisted living facility is on a 7 acre site on the westerly side of Reading. The original plan was submitted in May 1998 an approved by Town Meeting. CPDC approved this plan on 4/1/99. The new plan, submitted on December 10, 1999, differs from the original on lot P1 and lot P2. Lot P1 will be deeded to the Town as a recreational area. This will change the size of the site to 4.3 acres with frontage of 353'. The building is 132' from the property line. The height of the building is 34'8" from the natural grade. The natural grade is consistent with the first floor. Other additions to the December 10, 1999 plan are: 1. The facility is not closer than 100' to any existing building. 2. The loading area is marked. 3. The location of the plantings is marked. Atty. Favaloro also stated that 10% of the facility is affordable housing. An "agreement in principle" has been reached with CPDC. He believes they have met the requirements under Section 4.3.1.4. The Zoning Board reviewed the requirements under Section 43.1.4 and found the applicant deficient under conditions B, E, G, I and K. The applicant hasn't received final approval from the Town Engineer. CPDC approval of the trees is probably 4 weeks away. The agreement is in place, but not in writing with the housing authority. The Building Inspector needs a plan with the proper set backs and parking. The Zoning Board asked the applicant to come back when he has a new site plan and approval from the Town Engineer. On a motion by John Coote, seconded by Michael Larkin the Zoning Board of Appeals voted to continue the Public Hearing on Case #99-26 until January 6, 2000. The motion was approved by a vote of 3-0-0. The Zoning Board recommended Michael Larkin as Board's representative for the Ad hoc Commission for evaluation of legal services. On a motion by John Coote, seconded by Michael Larkin, the Zoning Board of Appeals voted to approve the Minutes of the October 7, 1999 meeting as amended. The motion was approved by a vote of 5-0-0. On a motion by John Coote, seconded by Michael Larkin, the Zoning Board of Appeals voted to approve the Minutes of the November 4, 1999 meeting as amended. The motion was approved by a vote of 5-0-0.
